Measures of Wuhan Municipality on the Administration of Urban Roads and Bridges

Chapter I General Provisions Article 1 In order to strengthen the management of urban roads and bridges in this Municipality, protect urban roads and bridges and their ancillary facilities, give full play to their traffic functions, ensure safe and smooth traffic, and keep the city clean and tidy, these Measures are formulated in accordance with the relevant provisions of the State and in light of the actual situation of this Municipality. Article 2 These Measures shall apply to the occupation, excavation, maintenance and management of urban roads and bridges in this Municipality.

Roads and bridges include:

(a) motor vehicles, non-motor vehicles, sidewalks, shoulders, slopes, embankments, ditches and public squares;

(2) Bridges, interchanges, overpasses and underground traffic passages;

(three) road signs, road signs and other ancillary facilities of roads and bridges. Article 3 The competent department of urban roads, bridges and their ancillary facilities in this Municipality is the municipal and district municipal construction management department. Article 4 Urban roads in this Municipality are divided into main roads, secondary roads, separated roads and streets. Chapter II Management Responsibilities Article 5 The responsibilities of the municipal and district municipal construction management departments are:

(1) To be responsible for publicizing and implementing the laws, regulations and these measures of the state concerning the maintenance and management of roads and bridges;

(two) to strengthen the maintenance of roads and bridges, keep roads flat and bridge facilities in good condition, and improve the traffic capacity;

(three) to inspect and improve the conditions of roads, bridges and their ancillary facilities, and give full play to their functions;

(four) in accordance with these measures, cooperate with the public security department to manage the occupation and excavation of roads. Article 6 The public security department shall, in accordance with the Regulations of the People's Republic of China on Road Traffic Management, be responsible for road and bridge traffic management, remove road obstacles, ensure smooth traffic, and examine and approve the issuance of temporary occupation permits and road excavation permits. Seventh planning, industry and commerce, sanitation, landscape and other departments in accordance with their respective responsibilities, actively cooperate with the management of roads and bridges. Article 8 The property right unit, the user unit or the management responsible unit shall be responsible for the maintenance and management of the organs, organizations, troops, schools, enterprises, institutions, parks, blocks, residential areas, roads in bridges and culverts and roads in alleys managed by the real estate department.

Roads built by units or financed by funds that meet the technical standards stipulated by urban road planning and the state can be used as urban public roads, bridges and culverts and handed over to the municipal construction management department, which is responsible for maintenance, repair and management. Chapter III Management of Temporary Occupation of Roads Article 9 Without approval, the following acts are prohibited on urban roads:

(a) occupy the road to engage in business;

(two) occupation of roads, construction work, scaffolding and other structures;

(3) Wash and mix stone, digest and mix lime, set up a stove and burn waste. Article 10 If it is really necessary to occupy roads due to bazaars, stalls, taxi parking lots, social parking lots, etc., the municipal planning, public security, municipal administration, industry and commerce departments shall jointly formulate a fixed-point plan for operating roads, which shall be strictly implemented after being approved by the Municipal People's Government.

Main roads, secondary roads, fire exits, intersections, traffic jams and other sections that need to be controlled, public squares shall not be planned as business occupied places.

Before the implementation of these measures, if the occupation of roads has been approved for business, the public security and municipal departments shall re-approve the location and area of the occupied roads in accordance with the fixed-point planning of the occupied roads for business, and go through the examination and approval procedures. Article 11 Units and individuals that need to temporarily occupy roads to engage in business operations shall hold relevant approval documents, fill in an application form for temporary occupation of roads and attach a schematic diagram of the occupation location, report it to the municipal construction and management department for examination and approval, pay the occupation fee to the municipal construction and management department after approval by the public security department, and operate only after the public security and industrial and commercial departments issue temporary occupation permits and business licenses. Article 12 Units and individuals that need to temporarily occupy roads due to national construction, public facilities construction and other related matters shall hold the planning red line map and relevant approval documents, fill in the application form for temporary occupation of roads and attach a schematic diagram of the occupation location, and pay the occupation fee and deposit to the municipal construction management department after reporting to the municipal construction management department for approval. And only after registering in the sanitation management department and issuing temporary occupation permit by the public security department can they occupy the road.

Set up billboards (columns) and unit signboards (frames) on urban roads, apply for the consent of the municipal construction management department, go through the examination and approval procedures according to the relevant provisions, and pay the occupation fee to the municipal construction management department.

Small public facilities, such as posting boxes, public telephone booths, public security kiosks, public transportation and sanitation stations, shall be set up in the occupied roads, and the examination and approval procedures for temporary occupation of roads shall be handled in accordance with the provisions of the first paragraph of this article, and the temporary occupation permit shall be obtained, and the occupation fee may be exempted. Thirteenth motor vehicles and bicycles must be parked in the area jointly designated by the public security and municipal departments, and shall not damage road facilities. Fourteenth units and individuals that use the approved temporary occupation of roads shall abide by the following provisions:

(a) Suspension of the temporary occupation permit;

(two) shall not lease or transfer the temporary occupation permit; Shall not change the nature of occupation, expand the occupied area and extend the occupied time without authorization; If it is really necessary to extend the occupation time, it shall apply for an extension seven days in advance according to the provisions of Article 11 or Article 12 of these Measures;

(three) shall not damage the road and its ancillary facilities;

(four) to keep the location and its surrounding environment clean and tidy, and not to discharge sewage or dump wastes around the location;

(5) Safety measures must be taken when the road is occupied by the construction, and a fence with a height of one to two meters should be temporarily built around the occupied place to ensure the safety of pedestrians.
