Chapter I General Provisions

Article 1 These Provisions are formulated in accordance with the Civil Aviation Law of People's Republic of China (PRC), the Basic Flight Rules of the People's Republic of China and the Regulations on the Administration of Civil Airports in order to ensure the flight safety of civil aircraft and standardize the flight procedures and minimum operating standards management of civil airports.

Article 2 These Provisions shall apply to the formulation, approval, use and maintenance of the minimum standards for flight program design and operation of China civil airport (including the civil part of the civil-military airport), as well as navigation service research activities related to the minimum standards for flight program and operation.

Article 3 The flight procedures mentioned in these Provisions refer to a series of maneuvers required for the aircraft to operate in the airport area, such as the regulations and restrictions on the flight area, track, altitude and speed, which generally include departure procedures, approach procedures, go-around procedures and waiting procedures, and are divided into instrument flight procedures and visual flight procedures. Instrument flight procedures include traditional navigation flight procedures and performance-based navigation (PBN) flight procedures.

The minimum standard of airport operation refers to the operational restrictions that an airport can use for takeoff and approach landing, including visibility (VIS), runway visual range (RVR), minimum descent height/height (MDA/H), decision height/height (DA/H), cloud bottom height, etc.

Article 4 Transport airports shall establish instrument flight procedures and visual flight procedures as required. General airports can establish instrument or visual flight procedures.

Article 5 The Civil Aviation Administration of China (hereinafter referred to as CAAC) shall be responsible for the supervision and management of the minimum flight procedures and operating standards of civil airports nationwide, formulate relevant policies and technical standards, and manage flight program designers and units.

Article 6 China Regional Civil Aviation Administration (hereinafter referred to as Regional Administration) is responsible for the examination and approval and management of flight procedures and minimum operating standards of civil airports within its jurisdiction, organizing airport flight tests, supervising and inspecting the implementation, and being specifically responsible for the daily supervision of flight program designers and units.

Article 7 The airport management agency shall be responsible for drafting, revising, optimizing, maintaining and approving the minimum standards for the design and operation of airport flight procedures.

Airport management agencies shall establish and constantly improve the systems and procedures for the design and operation of minimum flight procedures.

Chapter II Formulation of Minimum Standards for Flight Program Design and Operation

The first section basic requirements

Article 8 The following principles shall be followed in formulating the minimum standards for the design and operation of flight procedures:

(a) to ensure that the aircraft has a prescribed obstacle-crossing height on the proposed flight route and altitude, and can safely fly over or avoid obstacles;

(2) It meets the performance requirements of the aircraft, is convenient for pilots to operate, and is conducive to improving the safety, normality and efficiency of aircraft operation;

(3) Conforming to the requirements of airspace use, being conducive to providing air traffic services, reducing the possibility of flight conflicts, and improving airport capacity and efficiency;

(4) Conducive to environmental protection, reducing noise impact and reducing oil consumption;

(5) Coordinating with urban construction planning;

(6) Popularizing and applying new navigation technologies.

Article 9 The following factors shall be considered in designing and formulating the minimum standards of flight procedures:

(a) the characteristics of terrain and obstacles and clearance treatment scheme;

(2) Conditions for ensuring airport facilities and equipment;

(3) Category, performance and airborne equipment of the aircraft;

(four) the failure of the first take-off requires emergency procedures;

(5) the driver's operation;

(6) Airspace conditions;

(7) Connection with relevant air routes and air routes;

(eight) air traffic service mode;

(9) Characteristics of aviation meteorology;

(10) Environmental impact, airport development and urban planning.

Article 10 The minimum standards for the design and operation of flight procedures shall conform to the International Civil Aviation Organization (ICAO) air navigation service procedures-Aircraft Operation (Doc

8 168), other relevant technical standards and the relevant provisions of the Civil Aviation Administration. If it is really necessary to deviate from the above standards due to terrain conditions, airspace use and other reasons, a safety assessment shall be conducted and special approval shall be obtained from the Civil Aviation Administration.

Article 11 The minimum standards for the design and operation of flight plans may be completed by the airport management agency itself or by entrusting the flight plan design unit.

Article 12 In the process of drafting the minimum standards for flight procedure design and operation, the drafting unit shall solicit the opinions of aircraft operators, air traffic management departments and other relevant units, and the above-mentioned units shall cooperate.

Thirteenth airport management agencies are responsible for coordinating the relevant military and civil aviation units and local governments to solve the airspace conditions needed for flight program design.

Section 2 Flight Program Design for New Construction, Reconstruction and Expansion of Transport Airport

And setting minimum operating standards.

Article 14 The design of flight procedures and the formulation of minimum operating standards for new construction, reconstruction and expansion of transport airports shall be carried out simultaneously with the site selection, planning and construction of airports, which are generally divided into four steps:

(1) Pre-study of flight procedures;

(2) Research on flight program scheme;

(3) Preliminary design of flight procedure;

(4) Formal design of flight procedures.

Article 15 Pre-study of flight procedures? In the stage of airport site selection or project proposal (pre-feasibility study), according to the basic elements of flight operation environment, the alternative sites or schemes are comprehensively analyzed and compared from the aspect of flight procedures, and the sites or schemes that are more conducive to aircraft operation and air traffic management are selected. The main contents include:

(1) customs clearance conditions;

(2) airspace conditions;

(3) Meteorological factors;

(four) the basic configuration and operation mode of the runway;

(five) the basic scheme of navigation facilities;

(six) the route and the basic plan of entry and exit;

(seven) the impact on urban planning and environmental protection;

(eight) for the complex terrain and airspace, it should also include the specific calculation and explanation of take-off and final approach, as well as other materials needed for demonstration;

(9) Military and civil aviation coordination opinions.

Article 16 Study on flight plan? In the feasibility study stage of transportation airport construction and the overall airport planning stage, the basic flight plan is determined according to the determined site and the conclusion of pre-feasibility study, or according to the overall airport planning scheme. The main contents include:

(1) Runway configuration and location;

(2) airspace planning scheme;

(3) air routes and entry and exit plans;

(four) the layout of navigation facilities and visual AIDS;

(five) take-off, final approach procedures and minimum operating standards;

(six) the basic requirements of clearance control and clearance treatment scheme;

(seven) coordination of military and civil aviation flight procedures and conclusions.

Article 17? Preliminary design of flight procedure? After the feasibility study of transportation airport project is approved, according to the approved construction scale and overall planning, clearance treatment scheme, airspace coordination scheme and navigation site pre-selection, the specific design scheme of flight procedure is put forward. The main contents include:

(a) Type and location of navigation facilities;

(two) the specific plan of route planning;

(3) Detailed design and demonstration conclusion of flight procedures;

(4) Minimum obstacle-crossing height/height and minimum operation standard;

(5) Altimeter calibration procedure;

(6) Airport clearance treatment and protection scheme;

(seven) according to the requirements of airport operation, solicit the opinions of aircraft operators and air traffic control departments.

Article 18? Formal design of flight procedures? At the completion stage of transportation airport construction, the formal flight procedures are determined according to the actual runway, navigation facilities, visual navigation AIDS, obstacles and airspace restrictions. The main contents include:

(1) Detailed process and conclusion of flight program design;

(2) Minimum obstacle-crossing height/height and minimum operation standard;

(3) Altimeter calibration procedure;

(four) standard instrument approach procedures;

(5) Procedures for standard instruments leaving Hong Kong;

(6) Instrument approach procedure;

(7) Visual flight procedures (if necessary);

(eight) the situation of soliciting opinions from aircraft operators and air traffic control departments;

(9) Other relevant navigation information.

Nineteenth flight program design report shall be compiled in accordance with the relevant specifications of the Civil Aviation Administration.

Section 3 Modification and Optimization of Flight Procedures and Minimum Operating Standards of Transport Airports

Article 20 Under the following circumstances, the transport airport management agency shall evaluate the flight procedures and minimum operating standards as necessary, and make modifications and optimizations if necessary:

(1) Adjustment of airspace or air routes and air routes, and changes in control and operation modes;

(two) changes in navigation facilities and visual AIDS and the use of new navigation technologies;

(3) The type of aircraft in operation has changed;

(four) the obstacles have changed;

(5) Changes in runway conditions;

(six) the flight program design specifications and minimum operating standards have changed;

(7) Significant changes have taken place in the airport operation requirements;

(eight) other circumstances that may affect the execution and normal use of flight procedures.

Twenty-first flight procedures and minimum operating standards may refer to the requirements of Articles 16, 17 and 18 of these Provisions, and be modified or optimized according to specific conditions.

Chapter III Approval, Verification, Flight Test and Publication of Flight Procedures and Minimum Operating Standards

Article 22 The pre-study of flight procedures shall be completed when the site selection report of the transport airport and the proposal of the transport airport project (pre-feasibility study report) are compiled, and the study of flight procedure scheme shall be completed when the feasibility study report of the transport airport project or the airport master plan report is compiled. The expert review of flight procedure pre-research and flight procedure scheme research is carried out simultaneously with the expert review of airport construction.

Article 23? Preliminary design of flight procedure? The report shall be submitted by the transport airport management agency to the regional administration for review and comments.

Article 24? Formal design of flight procedures? The report shall be submitted by the transport airport management agency to the regional administration for approval.

After the flight procedures are approved, the flight procedures shall be verified in accordance with the provisions of Article 27, and the airport flight test shall be conducted. Transport airport management agencies shall submit flight procedure verification to the regional administration, and the verification results and corresponding work arrangements shall be implemented in accordance with Article 28.

Twenty-fifth transport airport flight plan verification by the airport management agencies, by the Civil Aviation Administration flight verification agencies in accordance with the relevant norms.

Article 26 The on-board equipment and performance of an aircraft carrying out the task of verifying flight procedures shall meet the requirements of verifying flight procedures.

The crew performing the flight procedure verification task should know the relevant knowledge about the design of flight procedures and the formulation of minimum operating standards, have the ability to verify flight procedures, and be familiar with the verified flight procedures.

After the verification of flight procedures, the flight verification institution shall submit a verification report to the airport management institution.

Article 27 Airport flight tests shall be organized under the following circumstances:

(1) After the flight procedures and minimum operating standards of the newly built, rebuilt or expanded transport airport are approved;

(2) Significant changes have taken place in the flight procedures and minimum operating standards of the airports that have been operated;

(3) due to the application of new navigation technology, the flight procedures and minimum operating standards of the airport have been revised.

The airport flight test shall be organized and implemented by the regional administration in accordance with the relevant provisions of the Civil Aviation Administration.

Twenty-eighth after the flight procedure calibration or airport flight test, the regional administration shall organize the relevant units to evaluate the calibration or flight test results. If it is necessary to revise flight procedures and minimum operating standards, the Airport Authority shall revise them again and report them to the regional administration for approval.

Article 29 The flight procedures and minimum operating standards of transport airports shall be promulgated by the aviation information service agency of the Civil Aviation Administration in accordance with relevant regulations.

Chapter IV Use and Maintenance of Flight Procedures and Minimum Operating Standards

Article 30 Pilots, flight dispatchers, air traffic controllers and air traffic management personnel of airport management agencies should master the basic knowledge of flight procedures and minimum operating standards, be familiar with the requirements for the use of flight procedures, organize and implement flight and operation support in accordance with the published flight procedures and minimum operating standards, and provide air traffic services.

Thirty-first aircraft operators, air traffic management departments and other units or individuals shall report to the airport management agency in time when they find defects, errors or unsafe factors in flight procedures or minimum operating standards. The airport management agency shall establish corresponding methods and working procedures, collect and use flight procedures and suggestions, reply in time and revise and optimize them.

Article 32 Airport management agencies should strengthen airport clearance inspection, monitor the changes of buildings, structures, trees and other fixed or movable obstacles that may affect flight procedures and minimum operating standards, and if necessary, coordinate relevant departments to conduct safety assessment and propose solutions in accordance with the relevant provisions of the Civil Aviation Administration.

The air traffic management department shall promptly consult and report the relevant contents of Items (1) and (2) of Article 20 of this unit to the relevant airports and regional administrations, so that the airport management agencies can modify the airport flight procedures and minimum operating standards.

Article 33 When the navigation facilities, visual navigation aids or meteorological observation facilities fail or other unexpected events affect the safe operation, and it is necessary to temporarily change the flight procedures and raise the minimum operating standards immediately, the airport management agency shall immediately modify them and notify the relevant operating units and personnel in the form of a navigation notice, but it shall report to the regional administration in time and obtain approval afterwards. After the emergency is eliminated, the original flight procedures and minimum operating standards shall be restored in time and reported to the regional administration.

Navigation facilities and meteorological observation facilities belong to the air traffic management department. When the facilities fail or other emergencies affect the safe operation, the air traffic management department shall promptly notify the airport management agency.

Article 34 When there are special operational needs, with the approval of the regional administration, the aircraft operator may formulate special flight procedures and minimum operational standards by himself and notify the airport management agency and air traffic management department, otherwise it may not operate.

Chapter V Management of Flight Plan Designers and Units

Article 35 CAAC shall be responsible for organizing the formulation of the training plan for flight program designers.

Article 36 A flight programmer shall be engaged in flight program design for more than one year.

Thirty-seventh flight plan design units should have more than three designers, have the corresponding office space, equipment, design software and other conditions, establish the corresponding quality assurance system, and file with the Civil Aviation Administration.

Thirty-eighth flight program design units shall ensure that their flight program designers have the necessary knowledge and skills related to flight program design, be familiar with relevant flight program design specifications, and participate in basic training and regular training.

The basic training and regular training of flight program designers shall meet the requirements of the training program formulated by the Civil Aviation Administration.

For the airport management agency that completes the flight program design work by itself, the agency shall ensure that its flight program designers meet the requirements of this article.

Chapter VI Supervision and Inspection

Article 39 CAAC and regional administrations shall, in accordance with their duties, supervise and inspect the flight procedures and minimum operating standards of civil airports.

Article 40 The Civil Aviation Administration shall be responsible for checking the implementation of the training plan for flight program designers. If it is found that the actual implementation is inconsistent with the training outline during the inspection, the training unit shall submit an explanation to the Civil Aviation Administration and obtain the approval of the Civil Aviation Administration. During this period, the training unit shall not continue to carry out flight program designer training.

Forty-first regional administrations shall supervise and inspect the filing of flight program design units and the training, qualification and filing of flight program designers.

Forty-second regional administrations shall inspect the work of airport management agencies. If it is found in the inspection that the civil airport management agency has not strictly implemented the relevant requirements of Article 7, the regional administration shall order it to make corrections within a time limit.

Chapter VII Legal Liability

Forty-third in violation of the provisions of article twentieth, transport airport management agencies failed to timely modify and optimize the flight procedures and operating minimum standards, the regional administration shall order it to correct, and give a warning; Overdue correction, a fine of ten thousand yuan; If the circumstances are serious, a fine of thirty thousand yuan shall be imposed.

Forty-fourth in violation of the provisions of article thirty-third, the airport management agency fails to timely adjust the flight procedures and minimum operating standards and release relevant information, the regional administration shall order it to make corrections and give a warning; If the circumstances are serious, a fine of thirty thousand yuan shall be imposed.

Forty-fifth in violation of the provisions of article thirty-seventh, the flight plan design unit has not been filed with the Civil Aviation Administration of China, and the regional administration shall order it to make corrections and give a warning; If no correction is made within the time limit, a fine of ten thousand yuan shall be imposed.

Chapter VIII Supplementary Provisions

Article 46 These Provisions shall come into force as of 20071October 2065438+ 1 day. Provisions on the formulation and implementation of the minimum standards for aircraft airport operation (CAAC Order No.98 +0) which came into effect on February 26th, 2006, and CAAC Decision on Amending the Provisions on the formulation and implementation of the minimum standards for aircraft airport operation (CAAC Order No.65438 +0 19) which came into effect on June 6th, 2003.

The latest revised Administrative Regulations on Minimum Standards of Flight Procedures and Operation of Civil Airports (CCAR-97FS-R3, hereinafter referred to as the Regulations) will come into effect on 20 17 1. At the same time, the specific technical standards that do not involve management principles are separated from the regulations and published separately in the form of technical specifications and advisory notices, which is convenient for timely revision in the future and ensures the seriousness and long-term applicability of the regulations.

199 1 Civil Aviation Administration issued the Provisions on the Formulation and Implementation of Minimum Standards for Airport Operation (Order No.20), and 200/kloc-0 issued the Provisions on the Formulation and Implementation of Minimum Standards for Aircraft Airport Operation (Order No.98). In 2003, Order No.98 was revised for the second time. Under the historical conditions of the basic integrated operation of civil aviation at that time, the above three regulations not only realized the comprehensive integration of flight procedures and minimum operation with ICAO standards, but also played a vital role in improving the overall safe operation level of civil aviation. The Civil Aviation Administration will hold a special training meeting on the Regulations on June 5438+065438+ 10 to discuss the implementation of the Regulations. Next year, colleges and universities will be organized to carry out flight program design training. At the same time, the regional civil aviation administration will organize the supervision bureau of the jurisdiction to carry out supervision and inspection on the administrative counterparts such as flight plan design units and airport management agencies through the flight standards supervision and management system (FSOP).
