Chapter I General Provisions Article 1 In order to strengthen the supervision and management of farmers' markets, maintain market order, and protect the legitimate rights and interests of farmers' markets' promoters, operators and consumers, these Measures are formulated in accordance with the Regulations on the Administration of Commodity Exchange Markets in Qinghai Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 The term "farmer's market" as mentioned in these Measures refers to the trading market where the promoters provide fixed places and facilities, the operators enter the market to conduct centralized and public trading of agricultural and sideline products, and are registered by the administrative department for industry and commerce. Article 3 These Measures shall apply to the establishment, operation, supervision and management of farmers' markets within the municipal area of this Municipality. Article 4 The farmer's market shall be managed in a territorial way, and the principles of unified planning, standardized management, market operation and government support shall be followed. Article 5 The municipal and district people's governments shall strengthen their leadership over the management of farmers' markets, establish a long-term coordination mechanism for the management of farmers' markets, and ensure the healthy development of farmers' markets. Article 6 The municipal administrative department for industry and commerce shall be responsible for the supervision and management of the trading order of the city's farmers' market. The district administrative department for industry and commerce shall be specifically responsible for the supervision and management of the trading order of the farmers' market within its administrative area.

The municipal administrative department of commerce is responsible for the organization, promotion, coordination, guidance, supervision and management of the construction of the city's farmers' market. The administrative departments of land and resources, planning and construction, public security and fire control, health, food and drug supervision, quality and technical supervision, taxation, price, agriculture and animal husbandry, animal epidemic prevention, and urban management administrative law enforcement shall, according to their respective functions and duties, cooperate with each other and do a good job in the supervision and management of farmers' markets according to law. Article 7 The Municipal People's Government shall, according to the special planning of the farmers' market and the principle of reasonable resources and convenience for the masses, organize the preparation and implementation of the layout planning and construction management plan of the farmers' market. Article 8 Citizens, legal persons, other organizations and overseas investors are encouraged to invest in building, rebuilding and expanding farmers' markets in various forms in accordance with the principle of "whoever builds benefits".

The legitimate rights and interests of farmers' markets held according to law are protected by law, and no organization or individual may infringe upon them. Ninth farmers' market operators can independently establish or join trade associations according to law. Trade associations shall be established according to law, and establish and improve rules and regulations, democratic management, code of conduct and industry self-discipline. The special planning of the farmers' market shall be prepared by the municipal administrative department of commerce in accordance with the principles of rational layout, convenience for the people and coordinated development, in conjunction with the departments of planning and construction, land and resources, real estate, public security and fire control, industrial and commercial administration, and urban management administrative law enforcement. , promulgated and implemented after the approval of the Municipal People's government.

In principle, the special plan for farmers' markets is revised once every five years. If there are special circumstances that need to be revised and adjusted, it should be submitted for approval according to the original examination and approval procedures. Article 11 The municipal administrative department of commerce shall, jointly with the departments of development and reform, industrial and commercial administration, planning and construction, public security and fire control, urban management administrative law enforcement, health, environmental protection, quality and technical supervision, formulate the standards for the construction of farmers' markets in Xining, and implement them after being approved by the Municipal People's Government. Twelfth the preparation of farmers' market layout planning, shall meet the following requirements:

The District People's Government shall, on the basis of fully soliciting the opinions of residents, prepare the layout plan of the farmers' market and report it to the municipal administrative department of commerce for the record. Thirteenth new construction, renovation and expansion of farmers' markets shall meet the following requirements:

(a) in line with the layout planning and construction standards of farmers' markets;

(two) there are fixed sites, facilities, management institutions and full-time management personnel suitable for the scale of the farmers' market;

(3) Having funds commensurate with the scale of the farmers' market;

(4) Other conditions stipulated by laws and regulations. Article 14 To start a farmer's market, it shall go through the industrial and commercial registration in accordance with the law, obtain a business license, and file with the business department at the same level of the administrative department for industry and commerce at the place of registration within 60 days after obtaining the business license. If it is necessary to go through other examination and approval procedures such as construction and land use, it shall be handled in accordance with relevant regulations. Fifteenth farmers' market construction shall not occupy urban roads and hinder traffic.

The farmer's market project supporting the new residential area or the transformation of the old city should be designed, constructed and delivered at the same time as the main project.

The farmers' market shall not change the nature of use without authorization. No unit or individual may occupy or destroy the sites and facilities of the farmers' market. Sixteenth farmers market operators, should establish and improve the market management system, do a good job in the daily management of the market:

(1) Signing a site lease and management agreement with the operator to clarify the rights and obligations of both parties; Establish the operator's file and record the basic situation and credit status of the operator. ;

(two) the establishment of consumer complaint service stations, the implementation of special personnel to accept consumer complaints, and according to the specific circumstances of the complaint, report to the relevant administrative departments; The consumer complaint service station shall be equipped with measuring instruments (hereinafter referred to as qualified measuring instruments), suggestion boxes and supervision telephones that have passed the compulsory verification by the municipal legal metrological verification institutions;

(3) Establish and improve the publicity system, and set up publicity columns and publicity columns at the gate of the farmers' market to publicize the basic and major issues related to the transaction to consumers, including: operator's license, records of violations of laws and regulations, market management system (including agricultural and sideline products access management system), consumer complaint telephone numbers, sampling results of agricultural and sideline products, delisting of unqualified products, etc.

(4) Set up a special organization, equipped with managers and animal epidemic prevention coordinators, responsible for maintaining market order, environmental sanitation, food hygiene, public security management, fire safety, building safety, price, information publicity and maintenance of facilities and equipment; Establish a responsibility system for market managers, conduct regular training and assessment, and work with certificates;

(five) to urge operators to equip and use qualified measuring instruments suitable for their business;

(six) to urge operators to clearly mark the sale of agricultural and sideline products.
