Knowledge expansion:
First, pay compulsory insurance.
The so-called compulsory insurance refers to the insurance that all units or individuals within the prescribed scope must participate whether they like it or not according to the relevant laws and regulations promulgated by the state. For example, all countries in the world generally stipulate motor vehicle third party liability compulsory insurance as compulsory insurance. Because compulsory insurance in a sense shows the intervention of the state on individual wishes, the scope of compulsory insurance is strictly limited. China's "Insurance Law" stipulates that insurance companies and any other units shall not force others to conclude insurance contracts except in cases stipulated by laws and administrative regulations.
Compulsory traffic accident liability insurance is the first compulsory insurance system implemented by national laws in China.
The Regulations on Compulsory Motor Vehicle Traffic Accident Liability Insurance [hereinafter referred to as the Regulations] stipulates that compulsory traffic insurance is compulsory liability insurance in which insurance companies compensate victims [excluding people on board and the insured] for personal injuries and property losses caused by road traffic accidents of insured motor vehicles within the limits of their liability.
Second, the classification of compulsory insurance
According to different legislative departments, compulsory insurance can be divided into three types:
1. Compulsory insurance is implemented nationwide.
According to legal procedures, laws passed by the national legislature and compulsory insurance regulations promulgated and implemented by the central government, such compulsory insurance is generally provided by insurance institutions authorized by the state and enforced by administrative means. This compulsory insurance stipulates the specific scope of the insurer, the insured and the subject matter of insurance. Whether the insured or the insurer agrees or not, there is no choice. The rights and obligations of both parties are bound by laws, such as: China's compulsory insurance regulations for personal accidents of passengers on airplanes, trains and ships, as well as social insurance such as unemployment insurance and endowment insurance.
The characteristics of this kind of insurance:
(1) mandatory;
(2) Failing to pay the insurance premium in accordance with the provisions, a late fee shall be paid;
(3) Ensure the unification of standards
2. Implement compulsory insurance locally.
According to the relevant national laws, local governments provide insurance through the promulgation and implementation of local regulations. For example, 24 provinces and cities in China have adopted compulsory insurance for motor vehicle third party liability insurance.
3. Compulsory insurance implemented in specific industries
According to the relevant laws and regulations issued by some administrative organs of the government, it is stipulated that anyone who engages in certain business activities must take out insurance, otherwise he may not engage in production and business activities. For example, China's commercial banks stipulate that mortgage loans to enterprises or individuals must be insured when real estate is used as collateral for loans.
