What are the requirements for real estate development qualification?
In order to strengthen the management of real estate development enterprises and standardize the behavior of real estate development enterprises, the Ministry of Construction issued the Regulations on the Qualification Management of Real Estate Development Enterprises in March 2000. Enterprises that have not obtained the qualification certificate of real estate development shall not engage in real estate development business. The construction administrative department is responsible for the qualification management of real estate development enterprises nationwide, and the local real estate development departments at or above the county level are responsible for the qualification management of real estate development enterprises within their respective administrative areas.
The newly established real estate development enterprise shall, within 30 days from the date of obtaining the business license, file a copy of the business license, the articles of association, the capital verification certificate, the identity certificate of the legal representative of the enterprise, the qualification certificate of professional and technical personnel, the labor contract and other documents deemed necessary by the real estate development department with the real estate development department for the record. The competent department of real estate development shall issue a "Temporary Qualification Certificate" to qualified enterprises within 30 days after receiving the filing application, and the validity period of the "Temporary Qualification Certificate" is 1 year.
Implement hierarchical examination and approval
The competent department of real estate development may extend the validity period of the Temporary Qualification Certificate depending on the operation of the enterprise, but the extension period shall not exceed 2 years. If there is no development project within 1 year from the date of receiving the temporary qualification certificate, the validity period of the temporary qualification certificate will not be extended. A real estate development enterprise shall apply to the competent department of real estate development for qualification grade verification before the expiration of the temporary qualification certificate 1 month, and the competent department of real estate development shall verify the corresponding qualification grade according to its development and operation performance.
Temporary employment or part-time management and technical personnel are not included in the total number of enterprise management and technical personnel, and the qualification level of real estate development enterprises is subject to grading examination and approval. Enterprises that have passed the qualification examination shall be issued with corresponding qualification certificates by the qualification examination and approval department. The qualification certificate shall be uniformly produced by the construction administrative department of the State Council. The qualification certificate is divided into original and duplicate, and the qualification examination and approval department may issue several qualification certificates as required.
