Legal analysis: supervisory organs. These Provisions shall apply to the staff of institutions appointed by administrative organs, staff of institutions authorized by laws and regulations that do not refer to the Civil Service Law of People's Republic of China (PRC), and staff of institutions entrusted by state administrative organs to engage in public affairs management activities according to law. However, if the supervisory organ's investigation and handling procedures for the above-mentioned personnel's violations of law and discipline and the authority to make a disciplinary decision, and the staff of the institution as the object of supervision refuses to accept the disciplinary decision and lodge a complaint with the supervisory organ, it shall be handled in accordance with the Administrative Supervision Law of the People's Republic of China and its implementing regulations.

Legal basis: Article 24 of the Interim Provisions on the Punishment of Staff in Public Institutions shall be handled in accordance with the following procedures: (1) If further verification is needed after a preliminary investigation of violations of discipline and law by staff in public institutions, the case shall be filed with the approval of the person in charge of the public institution or the consent of the relevant departments in accordance with the authority of cadre and personnel management; (two) the violations of law and discipline of the staff of the institutions under investigation shall be further investigated. Collect and verify relevant evidence materials and form a written investigation report. 3) Inform the staff of the institution under investigation of the facts found and the basis for the proposed punishment, listen to their statements and arguments, and review and record the facts, reasons and evidence put forward by them. If the facts, reasons and evidence put forward by the staff of the institution under investigation are established, they shall be adopted. 4) According to the authority of the punishment decision, make a decision to give punishment, exempt from punishment or dismiss the case to the staff of public institutions. 5) The penalty decision unit shall issue a penalty decision. 6) Inform the staff of the punished institution and relevant units in writing, and publish it within a certain range. 7) Store the punishment decision in the employee file of the punished institution. The punishment decision shall take effect as of the date it is made.
