Regulations on Protection of Famous Historical and Cultural Cities, Towns, Villages and Traditional Villages in Fujian Province

Chapter I General Provisions Article 1 In order to strengthen the protection and management of historical and cultural cities, towns, villages and traditional villages, and promote the development of outstanding historical and cultural heritage, according to the State Council "Regulations on the Protection of Historical and Cultural Cities, Towns and Villages" and other relevant laws and regulations, combined with the actual situation in this province, the formulation of these Regulations. Article 2 The protection and management of famous historical and cultural cities, towns, villages and traditional villages within the administrative area of this province shall be governed by these regulations.

The protection and management of historical and cultural neighborhoods and historical buildings within the administrative area of this province shall be implemented in accordance with the relevant provisions of these regulations. Article 3 The protection of historical and cultural cities, neighborhoods, towns and villages, traditional villages and historical buildings shall follow the principles of scientific planning, strict protection, maintain and continue their traditional patterns and historical features, maintain the authenticity and integrity of the historical and cultural heritage, and correctly deal with the relationship between the protection of inheritance and development and utilization. Article 4 local people's governments at all levels are responsible for the administrative area of the historical and cultural cities, neighborhoods, towns, villages, traditional villages and historical buildings protection and management, and will be included in the civilized cities, civilized villages and towns to create the scope of work.

The competent departments of urban and rural planning (construction) of the local people's governments at or above the county level, together with the competent departments of culture (cultural relics) of the people's governments at the same level, shall be responsible for the specific work of the protection and management of the famous historical and cultural cities, neighborhoods, towns, villages, traditional villages and historical buildings in the administrative area.

Local people's governments at or above the county level, development and reform, finance, land resources, tourism, fire and other relevant departments shall, in accordance with their respective responsibilities, do a good job in the protection of historical and cultural cities, neighborhoods, towns and villages, traditional villages and historical buildings.

Village (neighborhood) committees shall cooperate in the protection of historical and cultural cities, neighborhoods, towns and villages, traditional villages and historical buildings. Article 5 The local people's governments at or above the county level shall arrange in the annual budget for the protection of special funds for historical and cultural cities, neighborhoods, towns, villages, traditional villages and historical buildings, planning, protective repairs, related infrastructure construction and improvement of the living environment. Article 6 The local people's governments at or above the county level and their relevant departments shall strengthen the publicity and education for the protection of famous historical and cultural cities, neighborhoods, towns and villages, traditional villages and historical buildings, popularize the knowledge of protection and raise public awareness of protection. Article 7 The local people's governments at or above the county level and their relevant departments shall, in accordance with the relevant provisions of the units and individuals who have made outstanding contributions to the protection of famous historical and cultural cities, neighborhoods, towns and villages, traditional villages and historical buildings, give commendations and rewards. Article 8 Any unit or individual shall protect the famous historical and cultural cities, neighborhoods, towns and villages, traditional villages and historical buildings in accordance with law, and shall have the right to complain and report illegal acts. Relevant authorities receive complaints or reports, shall investigate and deal with according to law. Chapter II Declaration and Recognition of Article IX historical and cultural cities, towns and villages are divided into national and provincial historical and cultural cities, towns and villages.

National historical and cultural cities, towns and villages of the declaration, approval and direct determination of the conditions and procedures, in accordance with the State Council "Regulations on the Protection of Famous Historical and Cultural Cities, Towns and Villages". Article 10 Cities, towns and villages which have the following conditions may be declared as provincial famous historical and cultural cities, towns and villages:

(1) relatively rich in preserved cultural relics;

(2) historical buildings are concentrated in patches;

(3) preserving the traditional pattern and historical style;

(4) having served historically as a center of political, economic, cultural and transportation or a military stronghold or having experienced important events. military strongholds, or important historical events have occurred, or its traditional industries or major projects constructed in history have had a significant impact on the development of the region, or can reflect the cultural and ethnic characteristics of the region in a focused manner;

(e) rich in intangible cultural heritage resources.

Declared provincial historical and cultural cities, in the declared historical and cultural cities within the scope of protection should also have more than one historical and cultural neighborhoods. Article 11 Neighborhoods with the following conditions can be declared as historical and cultural neighborhoods:

(1) retaining relatively complete historical features and historical buildings;

(2) the historical features, historical buildings and environmental elements constituting them shall have authenticity;

(3) the land area of the historical and cultural neighborhoods is not less than one hectare;

(4) the historical and cultural neighborhoods are rich in cultural relics, monuments and historical buildings. (d) The land area of cultural relics and monuments, historical buildings as well as buildings and structures that can show the characteristics of the local historical features within the area reaches more than fifty percent of the total land area of the buildings within the protection area. Article 12 The declaration of provincial historical and cultural city or historical and cultural district, by the location of the city, county people's government to apply, by the provincial people's government department in charge of housing and urban-rural construction, in conjunction with the competent department of culture (cultural relics) at the same level to organize the relevant departments, experts for the argumentation, put forward the review opinion, and reported to the provincial people's government for approval to publish. When making the declaration, materials describing the following shall be submitted:

(i) historical evolution, local characteristics and historical and cultural values;

(ii) the current status of traditional patterns and historical features;

(iii) the scope of protection and construction control zones;

(iv) a list of immovable cultural relics, historical buildings and intangible cultural heritage;

(v) status of protection work, protection objectives and protection requirements.

Declaring the provincial historical and cultural city, it should also submit the list of historical and cultural neighborhoods and explanatory materials.
