People deprived of political rights according to law are not recruited. Citizens who are being investigated, prosecuted, tried or sentenced to fixed-term imprisonment, criminal detention or public surveillance shall not be recruited.

Article 4 The number, requirements and time of annual conscription throughout the country shall be stipulated in the conscription orders of the State Council and the Central Military Commission (CMC).
