How to apply for a registered trademark

There are two ways for individuals to apply for registered trademarks. The first is that the applicant applies directly, and the second is that the applicant entrusts an agency to apply. The process of registration is to design the trademark structure first, and then inquire about the trademark filing. Prepare the registration materials, then submit the registration application, and finally wait for the registration notice.

Materials required for applying for trademark registration:

1. Domestic legal person or other organization: submit copies of valid certificates such as business license, legal person registration certificate, institution legal person certificate, social organization legal person certificate, law firm practice certificate and medical institution practice license; School license, periodical certificate, organization code certificate and other documents can not be used as the applicant's identity documents.

2. Domestic natural persons: photocopies of valid identity documents such as ID card, passport and household registration certificate, and photocopies of business licenses of individual industrial and commercial households or rural land contract. The scope of goods and services that a natural person applies for trademark registration shall be limited to the business scope approved by its business license or relevant registration documents, or to the self-operated agricultural and sideline products.

3. Legal persons or other organizations from Hong Kong, Macao, Taiwan or abroad: a copy of the registration certificate of the region or country to which they belong shall be submitted. Copies of the registration certificates of foreign enterprises' offices and resident representative offices in China are invalid. If the above documents are in foreign languages, a Chinese translation shall be attached; If it is not attached, it shall be deemed that the document has not been submitted.

4. Hong Kong, Macao and Taiwan natural persons (handled by themselves): a copy of the pass is required; If the applicant is a foreign natural person and handles it on his own, he shall submit a copy of his passport and a foreigner's permanent residence permit, foreigner's residence permit or foreigner's residence permit valid for more than one year issued by the public security department.

Legal basis: Article 22 of the Trademark Law of People's Republic of China (PRC).

The applicant for trademark registration shall fill in the category and name of the goods using the trademark in accordance with the prescribed commodity classification table and apply for registration.

An applicant for trademark registration may apply for the registration of the same trademark for many kinds of goods through one application.

Applications for trademark registration and other relevant documents may be submitted in written form or in the form of data messages.

Article 28

The Trademark Office shall, within nine months from the date of receiving the application documents for trademark registration, complete the examination of the trademark applied for registration. If it meets the relevant provisions of this Law, it shall make a preliminary examination and make an announcement.
