Laiyang Tomb-Sweeping Day Regulations

On April 5th, Tomb-Sweeping Day (a legal holiday), overtime pay shall be paid separately at 300% of the average daily wage or hourly wage; On April 6th and 7th (these two days are public holidays), overtime pay shall be paid separately at 200% of the average daily wage or hourly wage. It is worth noting that the salary base of overtime pay shall not be lower than the employee's own post salary. If it is lower than its original salary, it shall be implemented according to the latest minimum wage standard. One day, plus three weekends * * * If the holidays are not adjusted, only April 5 is a legal holiday. Tomb-Sweeping Day has a three-day holiday, and the statutory holiday refers to the rest time for celebration and holiday, which is uniformly stipulated by national laws according to the customs and commemorative requirements of various countries and nationalities. The legal holiday system is an important reflection of the national political, economic and cultural system, involving many aspects of the economy and society and the vital interests of the broad masses of the people. It is a holiday for all citizens, including: New Year's Day (10/day 1 day), Spring Festival (Lunar New Year's Eve and the second day of the first month are closed for three days), Labor Day (May 1 day 1 day) and National Day (/kloc).

; If the employing unit arranges the laborer to work overtime on April 4th, it shall pay overtime pay not less than 300% of the laborer's daily or hourly wage. The employing unit shall not refuse to pay overtime wages in the name of taking a leave or taking a vacation. If workers are arranged to work overtime on weekends, it belongs to working overtime on rest days, and equal time should be arranged for compensatory rest. If compensatory time off cannot be arranged, overtime pay not less than 200% of the daily or hourly wages of the workers shall be paid.

It should be noted that State Taxation Administration of The People's Republic of China has made it clear that overtime pay does not belong to the subsidies and allowances issued by the state, and should be incorporated into wage income and taxed according to law.
