Provisions on the Administration of Internet Information Service Algorithm Recommendation

Chapter I General Provisions Article 1 In order to standardize Internet information service algorithm recommendation activities, carry forward socialist core values, safeguard national security and social interests, protect the legitimate rights and interests of citizens, legal persons and other organizations, and promote the healthy and orderly development of Internet information services, according to the Network Security Law of the People's Republic of China, the Data Security Law of People's Republic of China (PRC), and Personal Information of People's Republic of China (PRC). Article 2 These Provisions shall apply to the application of algorithm recommendation technology to provide Internet information services in People's Republic of China (PRC) (hereinafter referred to as algorithm recommendation service). Where laws and administrative regulations provide otherwise, such provisions shall prevail.

The application algorithm recommendation technology mentioned in the preceding paragraph refers to providing information to users by using algorithm technologies such as generation and synthesis, personalized push, sorting and selection, retrieval and filtering, and scheduling decision. Article 3 The national network information department is responsible for coordinating the governance of algorithm recommendation service and related supervision and management. The State Council Telecom, public security, market supervision and other relevant departments are responsible for the supervision and management of algorithm recommendation services according to their respective responsibilities.

The local network information department is responsible for coordinating the governance of algorithm recommendation service and related supervision and management within its administrative area. Local telecommunications, public security, market supervision and other relevant departments shall be responsible for the supervision and management of algorithm recommendation services within their respective administrative areas. Article 4 The provision of algorithm recommendation services shall abide by laws and regulations, respect social morality and ethics, observe business ethics and professional ethics, and follow the principles of fairness, openness, transparency, science, reasonableness, honesty and credibility. Article 5 Relevant industry organizations are encouraged to strengthen industry self-discipline, establish and improve industry standards, industry guidelines and self-discipline management systems, urge and guide algorithmic recommendation service providers to formulate and improve service specifications, provide services according to law, and accept social supervision. Chapter II Information Service Specification Article 6 Algorithm recommendation service providers should adhere to the mainstream value orientation, optimize the algorithm recommendation service mechanism, actively spread positive energy, and promote better algorithm application.

The algorithm recommendation service provider shall not use the algorithm recommendation service to engage in activities prohibited by laws and administrative regulations, such as endangering national security and social interests, disrupting economic and social order, infringing upon the legitimate rights and interests of others, and shall not use the algorithm recommendation service to spread information prohibited by laws and administrative regulations, and shall take measures to prevent and resist the spread of bad information. Article 7 An algorithm recommendation service provider shall implement the main responsibility of algorithm security, establish and improve management systems and technical measures such as mechanism review, science and technology ethics review, user registration, information release review, data security and personal information protection, anti-telecommunication network fraud, security assessment and monitoring, and emergency handling of security incidents, formulate and disclose relevant rules of algorithm recommendation service, and provide professionals and technical support commensurate with the scale of algorithm recommendation service. Article 8 An algorithm recommendation service provider shall regularly review, evaluate and verify the mechanism, model, data and application results of the algorithm mechanism, and shall not set up an algorithm model that induces users to indulge and consume excessively and violates laws, regulations or ethics. Article 9 An algorithmic recommendation service provider shall strengthen information security management, establish and improve a feature database for identifying illegal and bad information, and improve warehousing standards, rules and procedures. If it is found that the unmarked algorithm produces synthetic information, it should be marked conspicuously before continuing transmission.

If illegal information is found, it shall immediately stop transmission, take measures such as elimination, prevent information from spreading, keep relevant records, and report to the network information department and relevant departments. If bad information is found, it shall be disposed of in accordance with the relevant provisions on ecological governance of network information content. Article 10 Algorithm recommendation service providers shall strengthen the management of user models and user tags, improve the rules for recording points of interest and user tags in user models, and shall not record illegal and bad information keywords in user interest points or push information as user tags. Eleventh algorithm recommendation service providers should strengthen the ecological management of algorithm recommendation service pages, establish and improve the mechanism of manual intervention and users' independent selection, and actively present information that conforms to the mainstream value orientation in key links such as the first screen of the home page, hot search, selection, list category and pop-up. Article 12 algorithmic recommendation service providers are encouraged to comprehensively use strategies such as content de-duplication and decentralized intervention to optimize the transparency and interpretability of rules such as retrieval, sorting, selection, push and display, so as to avoid adverse effects on users and prevent and reduce disputes. Article 13 Where an algorithmic recommendation service provider provides Internet news information services, it shall obtain an Internet news information service license according to law, standardize Internet news information editing and publishing services, reprinting services and communication platform services, and shall not generate synthetic false news information or disseminate news information published by units outside the scope prescribed by the state. Article 14 Algorithm recommendation service providers shall not use algorithms to falsely register accounts, illegally trade accounts, manipulate user accounts or falsely praise, comment or forward, and shall not use algorithms to block information, over-recommend, manipulate lists, rank search results, control the presentation of information such as hot search or selection, or conduct acts that affect online public opinion or evade supervision and management.
