Provisions on major administrative decision-making procedures in Henan Province

These Provisions shall apply to the formulation and adjustment procedures of major administrative decisions of the people's governments at or above the county level (hereinafter referred to as decision-making organs) within the administrative region of this province. The major administrative decision-making matters mentioned in these Provisions (hereinafter referred to as decision-making matters) include:

(a) major public policies and measures involving employment, social security, education, science and technology, health care, culture and sports;

(two) major public policies and measures involving market supervision, social management and environmental protection;

(three) major public policies and measures for the development, utilization or protection of important natural resources such as water, land, energy, minerals and biology;

(four) major public policies and measures for the development, utilization or protection of important cultural resources such as historical and cultural blocks, traditional villages and scenic spots;

(five) important development planning, spatial planning, special planning and regional planning in economic and social development;

(6) Major public construction projects implemented within their respective administrative areas;

(seven) other major issues that have a significant impact on economic and social development and involve major public interests or the vital interests of the public.

Where there are other provisions in laws and administrative regulations on the decision-making procedures for matters specified in the preceding paragraph, those provisions shall prevail. These Provisions shall not apply to macro-control decisions, government legislative decisions and emergency response decisions. Decision-making organs may, in accordance with the provisions of Article 3 of these Provisions, formulate the catalogue and standards of decision-making matters in combination with their responsibilities and authorities and local conditions, and announce them to the public with the consent of the Party committee at the same level, and make adjustments according to the actual situation.

: After studying and demonstrating the suggestions on decision-making matters put forward by various parties in accordance with the following provisions, report them to the decision-making organ to decide whether to start the decision-making procedure:

(a) the implementation of the arrangements made by the people's government at a higher level or the suggestions made by the leaders of decision-making organs on decision-making matters shall be studied and demonstrated by the relevant units;

(two) the decision-making organs subordinate departments or the people's government at the next lower level put forward suggestions on decision-making matters, which are studied and demonstrated by the suggesting units;

(three) deputies to the National People's Congress and members of the CPPCC put forward suggestions on decision-making matters through suggestions and proposals, which shall be studied and demonstrated by the handling unit;

(four) citizens, legal persons or other organizations put forward written suggestions on decision-making matters, and the relevant units shall conduct research and demonstration.

The research and demonstration of suggestions on decision-making matters mentioned in the preceding paragraph shall demonstrate the main problems to be solved, the reasons and basis for making suggestions, the preliminary plan for solving problems and its necessity and feasibility.

Legal basis: Provisions on Major Administrative Decision-making Procedures in Henan Province Article 1 In order to improve the scientific, democratic and legal decision-making mechanism, improve major administrative decision-making procedures, standardize major administrative decision-making behaviors, improve decision-making quality and efficiency, and clarify decision-making responsibilities, these Provisions are formulated in accordance with the State Council's Provisional Regulations on Major Administrative Decision-making Procedures and other laws and regulations, combined with the actual situation of this province.
