Is it necessary to implement the audit conclusion of project funds?

Legal analysis: the Supreme People's Court's official reply on how the people's court confirms the audit conclusion issued by the financial evaluation center in the trial of construction contract disputes stipulates that the evaluation and audit of financial investment by the financial department is the state's supervision and management of the capital construction funds of the construction unit and does not affect the effectiveness and performance of the contract between the construction unit and the contractor. However, if the construction contract clearly stipulates that the financial investment audit conclusion shall be the settlement basis, the audit conclusion shall be the settlement basis.

Although government investment projects need to be audited and supervised, it is only an administrative supervision and management behavior. Whether the price settlement of government investment projects should be based on the financial evaluation conclusion is not uniformly stipulated by law, but should be based on the contract signed by both parties. If the contract clearly stipulates that the audit conclusion is the settlement basis, the audit conclusion is the settlement basis of the project price; If the audit conclusion is not clearly stipulated in the contract as the basis for settlement, the project price shall not be settled by the audit conclusion, and both parties shall settle according to the principles and methods of price settlement in the contract.

Forty-first construction projects in the warranty scope and warranty period of quality problems, the construction unit shall fulfill the warranty obligations, and be responsible for the losses caused.
