Three levels and four elements of criminal law

Legal analysis: one is the system of progressive crime in civil law countries, and its constitutive elements are due, illegal and responsible. The other is the two-level crime constitution system in common law countries. One is the ontological elements, including criminal intent and criminal behavior, and the other is defense, including coercion, defense, police trap and juvenile delinquency. This is the coupling crime constitution system of the former Soviet Union and China, which consists of four elements: criminal subject, object, subjective aspect and objective aspect.

Legal basis: People's Republic of China (PRC) Criminal Law.

Article 8 This Law may be applied to foreigners who commit crimes against People's Republic of China (PRC) or People's Republic of China (PRC) countries or citizens outside the territory of People's Republic of China (PRC), provided that the minimum penalty stipulated in this Law is fixed-term imprisonment of not less than three years, except those who are not punished according to the laws of the place where the crime is committed.

Article 9 This Law shall apply to People's Republic of China (PRC)'s exercise of criminal jurisdiction over crimes stipulated in international treaties concluded or acceded to by People's Republic of China (PRC) within the scope of its treaty obligations.
