Provisional Regulations on the Protection of Traditional Arts and Crafts in Jiangsu Province

Chapter I General Provisions Article 1 In order to inherit the traditional culture and art of Hongchang nationality, further protect and develop traditional arts and crafts, and safeguard the legitimate rights and interests of scientific research, production and operation units and technicians of traditional arts and crafts, these Regulations are formulated in accordance with the provisions of relevant national laws and regulations and in light of the actual situation of this province. Article 2 The term "traditional arts and crafts" as mentioned in these Regulations refers to arts and crafts with a long history, unique national style and distinctive local characteristics. Article 3 These Regulations shall apply to state-owned, collective, private, foreign-invested, joint-stock enterprises and individual producers and operators engaged in the research, development, production and operation of traditional arts and crafts within the administrative region of this province. Article 4 All organizations and individuals have the obligation to protect traditional arts and crafts. Have the right to discourage, stop, report and accuse acts that destroy or endanger traditional arts and crafts. Article 5 Adhere to the policy of "protecting, developing and improving" and serving modern life, strengthen the research and development of traditional arts and crafts, and improve the technical level and product quality. Article 6 The administrative departments of arts and crafts of local people's governments at or above the county level shall exercise unified supervision and management over the protection of traditional arts and crafts within their respective administrative areas, and be responsible for the implementation of relevant laws, regulations and these Regulations. Article 7 The Arts and Crafts Industry Association is a social organization that protects and promotes the development of traditional arts and crafts, and assists the administrative departments of arts and crafts in implementing relevant laws, regulations and these regulations within their respective administrative areas. Chapter II Administration Article 8 Protected traditional arts and crafts shall meet the following conditions:

(1) generally starts production before 1840;

(2) mainly using natural or traditional raw materials;

(three) based on traditional crafts and hand-made, with superb skills;

(four) production in a certain area, and enjoy a high reputation at home and abroad;

(5) Having practical value or appreciation value. Article 9 The protected varieties of traditional arts and crafts shall be appraised by the provincial traditional arts and crafts appraisal committee, and shall be announced after being approved by the provincial arts and crafts administrative department and submitted to the provincial people's government. Tenth local people's governments at or above the county level shall be responsible for the administration of arts and crafts:

(a) responsible for formulating and organizing the implementation of traditional arts and crafts development plan;

(two) in conjunction with relevant departments to support the development of traditional arts and crafts;

(three) to guide, serve and coordinate the scientific research, production and operation of traditional arts and crafts;

(four) commend and reward the units and individuals that have made remarkable achievements in the protection and development of traditional arts and crafts;

(five) to investigate and deal with violations of these regulations;

(six) other duties as prescribed by laws and regulations. Eleventh varieties of traditional arts and crafts approved by the provincial people's government, whose products meet the technical standards, can use the unified certification mark of traditional arts and crafts in Jiangsu Province.

Jiangsu traditional arts and crafts certification mark is a symbol of protected traditional arts and crafts products.

The style and usage of Jiangsu traditional arts and crafts certification marks shall be formulated and promulgated by the provincial arts and crafts administrative department. Twelfth technicians who design and produce traditional arts and crafts products in Jiangsu Province can use their own marks on their works.

At the same time, those who meet the following conditions may apply to use the celebrity seal of Jiangsu traditional arts and crafts in their works:

(a) can independently complete the design or production of key processes;

(two) superb skills, enjoy a high reputation in and outside the province;

(3) having the title of senior technician or craftsman or above or mastering certain stunts.

The use of Jiangsu traditional arts and crafts celebrity imprint shall be approved by the provincial arts and crafts administrative department. It is forbidden to forge or falsely use other people's marks or celebrity marks. Thirteenth Provincial Traditional Arts and Crafts Appraisal Committee is specifically responsible for the evaluation and appraisal of the varieties and technical standards of traditional arts and crafts in Jiangsu Province, as well as the certification of traditional arts and crafts in Jiangsu Province and the use of celebrity seals.

The Provincial Traditional Arts and Crafts Appraisal Committee may set up several professional appraisal groups according to the needs of the work. The professional appraisal team assists the appraisal committee of traditional arts and crafts in our province to carry out the appraisal of related majors. Fourteenth traditional arts and crafts production and business units and individuals should strengthen quality management, to ensure the quality of products, it is strictly prohibited to fake the real, shoddy. Chapter III Protection of Production and Operation Article 15 Units and individuals engaged in the production and operation of traditional arts and crafts shall apply to the administrative department for industry and commerce for a business license and register with the local administrative department for arts and crafts for the record. Sixteenth of the traditional arts and crafts development funds that have a significant impact are indeed difficult, the relevant departments have the responsibility to give support. Seventeenth traditional arts and crafts production units and individuals that have real difficulties in paying taxes may apply to the tax authorities for tax reduction or exemption. Eighteenth relevant departments should support the traditional arts and crafts production and business units to carry out foreign economic and trade activities, and set up tourist attractions and sales outlets. Nineteenth traditional arts and crafts production and business units should enhance their self-protection ability and promote and guarantee the development of traditional arts and crafts. No unit or individual may occupy traditional arts and crafts for free.

If it is really necessary to stop production or change production, the production unit and the competent department shall take measures to ensure that the traditional arts and crafts are not lost.
