Regulations of Nanjing Municipality on the Protection and Utilization of Red Cultural Resources

Chapter I General Provisions Article 1 In order to strengthen the protection and utilization of red cultural resources, carry forward revolutionary traditions, inherit red genes, and cultivate and practice socialist core values, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics, the Law of People's Republic of China (PRC) on the Protection of Heroes and Martyrs and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the investigation, identification, protection, management, inheritance and utilization of red cultural resources within the administrative area of this Municipality. Article 3 The term "red cultural resources" as mentioned in these Regulations refers to the advanced cultural resources in material form and immaterial form formed by the Chinese production party in the period of revolution, construction and reform, and in the great practice of Socialism with Chinese characteristics in the new era. Article 4 The protection and utilization of red cultural resources shall follow the principles of Party committee leadership, government responsibility, departmental cooperation and social participation. Adhere to comprehensive protection and key protection, and promote rescue protection and preventive protection, ontology protection and surrounding environment protection as a whole; Adhere to rational utilization, innovative development, highlight social benefits, strengthen educational functions, and maximize the historical authenticity, integrity and cultural continuity of red cultural resources. Article 5 The municipal and district people's governments and the administrative organs of Jiangbei New District shall strengthen the organization and leadership of the protection and utilization of red cultural resources within their respective administrative areas, and incorporate the protection and utilization of red cultural resources into the national economic and social development plan, and the required funds into the fiscal budget at the corresponding level.

The town people's government and sub-district offices shall, under the guidance of the departments of party history, culture and tourism, assist in the protection and utilization of red cultural resources within their respective jurisdictions. Article 6 The administrative department of culture and tourism shall be responsible for organizing the investigation and identification of red cultural resources, the management of signs, the implementation of the system of protecting responsible persons and the development of red tourism industry.

The administrative department of planning and natural resources is responsible for the planning and management of immovable red cultural resources.

The competent administrative department of civil affairs shall be responsible for the examination of red place names, supervise the use of place names, the setting and management of place name signs, strengthen the construction of volunteer teams of red cultural resources and the management of volunteer services, and guide the donation of red cultural resources.

The administrative department of veterans affairs is responsible for the protection and utilization of memorial facilities for heroic martyrs.

The education administrative department is responsible for carrying out publicity and education on red culture in schools of all levels and types, and promoting the construction of red culture in schools.

Public security, finance, housing security and real estate, transportation, urban and rural construction, urban management, emergency management, local chronicles, archives and other departments and units shall do a good job in the protection and utilization of red cultural resources in accordance with their respective responsibilities.

Trade unions, the Communist Youth League, women's federations and other people's organizations should give full play to their respective advantages and organize the protection and utilization of relevant red cultural resources. Article 7 This Municipality shall establish a joint conference system for the protection and utilization of red cultural resources, make overall plans for the protection and utilization of red cultural resources, coordinate major issues across departments, study and solve important problems in the protection and utilization, and urge the implementation of important work for the protection and utilization of red cultural resources.

The joint meeting consists of propaganda, party history, culture and tourism, planning and natural resources, civil affairs, retired military affairs, education, public security, finance and other departments, as well as online information, local chronicles, archives and other institutions. The office of the joint meeting is located in the propaganda department. Article 8 An expert committee on the protection and utilization of red cultural resources shall be established in this Municipality, which shall be responsible for demonstrating and evaluating the identification and classification of resources and the preparation of special plans. The expert committee is composed of professionals in the fields of party history, culture, cultural relics, planning, education and archives. Article 9 All units and individuals have the obligation to protect red cultural resources, and have the right to dissuade, stop, report or accuse the acts of destroying, damaging or distorting, vilifying or desecrating red cultural resources.

The municipal and district people's governments and the management institutions of Jiangbei New District shall commend and reward the units and individuals that have made remarkable achievements in the protection and utilization of red cultural resources. Chapter II Investigation and Determination Article 10 The administrative department of culture and tourism shall, jointly with the departments of party history, planning and natural resources, civil affairs and retired military affairs, organize the investigation, collection and collation of red cultural resources within their respective administrative areas, do a good job in the rescue and protection of physical historical materials and oral materials, and establish an electronic file database of red cultural resources. Eleventh archives, museums, memorial halls, libraries and other collection and research institutions should strengthen the collection of red cultural resources and materials.

Encourage units and individuals to donate or lend red cultural resources such as documents and commemorative items to collection and research institutions according to law. Collection research institutions shall respect the wishes of donors or lenders, properly collect, keep and display donations or lenders' articles, and issue certificates to donors or lenders. Article 12 The municipal administrative department of culture and tourism shall, jointly with the municipal departments of party history, planning, natural resources, civil affairs and retired military affairs, formulate the identification and classification standards of red cultural resources in this Municipality, and report them to the joint meeting of the protection and utilization of red cultural resources in the city for approval. Article 13 The administrative departments of culture and tourism in the District and Jiangbei New District shall, according to the investigation, collection and arrangement of resources, put forward a list of suggestions for the identification of red cultural resources in conjunction with the party history department, and report it to the joint meeting on the protection and utilization of red cultural resources in the city with the consent of the district people's government and the management institutions of Jiangbei New District.

The joint meeting of the protection and utilization of red cultural resources in the city shall organize an expert committee to identify and evaluate the resources, put forward a list of red cultural resources, and publish it after being approved by the Municipal People's government.

The relevant units and individuals may apply to the administrative department of culture and tourism and the party history department for the identification of red cultural resources, and the identification procedures shall be implemented with reference to the provisions of the preceding paragraph.
