Measures of Wuxi Municipality on the Administration of Outdoor Advertising

Article 1 In order to strengthen the management of outdoor advertising in urban areas of this Municipality and promote the healthy and orderly development of outdoor advertising, these Measures are formulated in accordance with the Advertising Law of People's Republic of China (PRC), the Urban Planning Law of People's Republic of China (PRC) and the Regulations of the State Council on the Administration of City Appearance and Environmental Sanitation, and in combination with the actual situation of this Municipality. Article 2 All units and individuals engaged in outdoor advertising activities within the urban area of this Municipality must abide by these Measures. Article 3 Outdoor advertisements as mentioned in these Measures refer to the following advertisements that directly or indirectly introduce goods or services through outdoor media:

(1) Advertisements published in the form of billboards, neon lights, electronic display screens, electronic steering devices, light boxes, physical models, cloth pieces, signboards and posters. , located outside the building or road; ?

(2) Setting up, drawing and posting advertisements by means of transportation (including all kinds of floating objects on water and flying objects in the air);

(3) Advertisements published in outdoor media in other forms. ?

The term "outdoor advertising (including public service advertising) facilities" as mentioned in these Measures refers to the fixed special facilities for publishing outdoor advertisements after unified planning.

The term "outdoor advertising location" as mentioned in these Measures refers to the spatial location of the land and its affiliated buildings (structures) that can be used for the construction of special outdoor advertising facilities. Article 4 The administrative department for industry and commerce is the registration authority for outdoor advertisements. Without the registration of the administrative department for industry and commerce, no unit or individual may publish outdoor advertisements.

The administrative department in charge of urban management is the administrative department in charge of setting up outdoor advertising facilities (positions) in urban areas.

The planning administrative department is the planning administrative department of urban outdoor advertising facilities (positions).

City Administration and Law Enforcement Bureau is the law enforcement department that imposes administrative penalties on illegal outdoor advertising facilities.

Public security, municipal utilities, gardens, transportation, prices and other departments are responsible for the supervision and management of outdoor advertising related matters according to law. Fifth outdoor advertising settings adhere to the principles of unified planning, standardized management, total control and paid use. Sixth city planning administrative departments shall, jointly with relevant departments, according to the relevant provisions of the detailed urban planning, planning management technical regulations and these measures, prepare and publish the outdoor advertising facilities (positions) planning.

The municipal administrative department of urban management shall, according to the planning of outdoor advertising facilities (positions), the technical specifications of provincial and municipal planning management and the standards of urban appearance, prepare the technical specifications of outdoor advertising facilities (positions) and publish them. Article 7 The setting of outdoor advertisements shall meet the following requirements:

(1) The contents of advertisements are true and lawful, which meet the requirements of socialist spiritual civilization construction, and shall not deceive or mislead consumers; ?

(two) advertising facilities (positions) in line with the planning and technical specifications of outdoor advertising facilities (positions), advertising facilities must be set with energy-saving materials that meet the requirements of environmental protection, and shall not affect the normal life of surrounding residents;

(three) the use of Chinese characters, Chinese Pinyin, units of measurement, symbols, etc. In accordance with state regulations, if a foreign language is used, it shall be marked in Chinese at the same time and published according to the contents approved by the administrative department for industry and commerce; ?

(4) The outdoor advertising registration certificate number issued by the administrative department for industry and commerce is marked on the lower right corner or outside of the advertising screen;

(five) regular maintenance, maintenance, keep clean, safe and beautiful. Eighth in any of the following circumstances, outdoor advertising shall not be set up:

(a) the use of traffic safety facilities, traffic signs; ?

(two) the impact of municipal public facilities, traffic safety facilities, traffic signs and urban public green space greening; ?

(three) hinder the production or people's life, damage the appearance of the city and the appearance of the building;

(four) the construction control zone of state organs, cultural relics protection units, outstanding historical buildings and scenic spots;

(five) the laws and regulations and the people's governments at or above the county level prohibit the establishment of outdoor advertising areas and scope. Ninth outdoor advertising positions are divided into public positions and non-public positions. Non-public posts refer to buildings and sites. Owned or used by enterprises, individuals, social organizations and private non-enterprise units that do not use financial allocations; Public position refers to the municipal facilities, public facilities, roads and their facilities, squares and other buildings (structures) and non-public positions that the administrative department of city management has obtained the right to use according to law.

The specific scope of the post of * * * is proposed by the municipal administrative department of urban management in conjunction with the municipal planning administrative department and other departments, and implemented after being approved by the Municipal People's government.

If outdoor advertising facilities are set up in public positions, the right to use the positions shall be obtained through auction and bidding.

The specific measures for the auction and bidding of the right to use public positions shall be formulated separately by the municipal administrative department of urban management in conjunction with the relevant departments of finance, municipal administration, prices, gardens, transportation and so on. Tenth use of non-public positions to set up outdoor advertising facilities, through unified planning, the right to use the position can be obtained through agreement, bidding, auction and other means; Not included in the unified planning, units or individuals use their own buildings (structures) to set up outdoor commercial advertising facilities, and the transfer of their right to use shall be implemented with reference to these measures. Eleventh outdoor advertising facilities (positions) transfer of the right to use, according to the actual situation of the overall planning of outdoor advertising facilities, and gradually adopt a combination or group way to transfer the right to use.
