How many monopolistic behaviors are regulated by the Anti-Monopoly Law? What are these monopolistic behaviors?

The Anti-Monopoly Law passed at the 29th meeting in the National People's Congress Standing Committee (NPCSC) on 30th stipulated three kinds of monopolistic behaviors, namely: the operators reached a monopoly agreement; Operators abuse market dominance; Concentration of operators that have or may have the effect of eliminating or restricting competition.

According to the law, a monopoly agreement refers to an agreement, decision or other concerted action that excludes or restricts competition.

The term "dominant market position" as mentioned in this Law refers to the market position in which an operator can control the price, quantity or other trading conditions of commodities in the relevant market, or can hinder or affect the ability of other operators to enter the relevant market.

Concentration of operators refers to the following three situations: merger of operators; Operators obtain control over other operators by purchasing equity or assets; Operators obtain control over other operators through contracts or can exert decisive influence on other operators.

According to reports, international anti-monopoly law usually includes three systems, namely, prohibiting monopoly agreements, prohibiting abuse of market dominance, and controlling concentration of operators. China made full use of international experience when formulating its anti-monopoly law.
