Regulations on Protection of Traditional Villages in Jiangcheng Hani and Yi Autonomous County of Yunnan Province

Article 1 In order to strengthen the protection, development and rational utilization of traditional villages, maintain the traditional style and carry forward the excellent historical and cultural heritage of the nation, in accordance with the Law of the People's Republic of China on Urban and Rural Planning, the Law of the People's Republic of China on Intangible Cultural Heritage, the Regulations on the Protection of Famous Historical and Cultural Cities, Towns and Villages and other relevant laws and regulations, and in conjunction with the actuality of the Jiangcheng Hani and Yi Autonomous County (hereinafter referred to as the Autonomous County). formulate these regulations. Article 2 These Regulations shall apply to the protection, development and utilization of traditional villages within the administrative area of the autonomous county. Article 3 The traditional villages referred to in these Regulations refer to villages with cultural heritage in tangible and intangible forms, with high historical, cultural, scientific, artistic, social and economic values, and listed in the list of traditional villages. Specifically, it includes: Bo Bie Zhai group of Mai and other villages in Guoqing Township, Mantan group of Mantan Village in Chengdong Township, Chengzi Sanzhai (Man He group, Man He Jing group, Man Jing Zhai group), Man Kuan group, Man Po group, Man Bian group, Man Cai group, Man Jing Wan group and other villages in Chengdong Village in Chengdong Township. Article 4 The protection and management of cultural relics in traditional villages shall comply with the provisions of relevant laws and regulations on cultural relics protection. Article 5 The protection, development and utilization of traditional villages shall follow the principles of scientific planning, overall protection, living heritage, rational utilization, government-led, villagers' autonomy and social participation. Article 6 The people's governments of autonomous counties shall strengthen the leadership of the protection and development of traditional villages, incorporate them into the national economy and social development planning, improve the infrastructure of traditional villages, public **** service facilities, improve the public **** environment, and the required funds are included in the financial budget at the same level.

Encourage natural persons, legal persons and unincorporated organizations to participate in the protection and development of traditional villages through donations, investments, shares, leases and other means. Article 7 The administrative department of housing and urban-rural construction of the people's government of an autonomous county shall be responsible for the protection and management of traditional villages, and shall specifically perform the following duties:

(1) organizing the preparation of the protection and development plan of traditional villages;

(2) guiding, supervising and inspecting the protection, development and use of traditional villages;

(3) establishing archives in accordance with the one-village-one-file;

(4) encouraging natural and illegal organizations to participate in the protection and development of traditional villages through donations, investments and leases. p>

(4) building management information systems and digital museums for the protection of traditional villages;

(5) other duties related to the protection of traditional villages.

The people's governments of autonomous counties shall, in accordance with their respective responsibilities, do a good job in the work related to the protection and development of traditional villages in terms of development and reform, education and sports, nationalities and religions, finance, natural resources, agriculture and rural areas, culture and tourism, forestry and grasslands, emergency management and other administrative departments. Article 8 traditional village protection and development planning should highlight the local ethnic characteristics, including the scope of protection, protection content, protection measures, industrial layout, habitat improvement. Traditional village protection and development planning should be linked with territorial spatial planning, cultural and tourism development planning, as well as other special planning, and reserve space for new population housing and public **** space. Article 9 The scope of protection of traditional villages is divided into core protection areas and construction control areas, the specific scope of which shall be delineated by the administrative department of housing and urban-rural construction of the people's government of the autonomous county on the basis of the approved planning for the protection and development of traditional villages, and the establishment of protection markers, which shall be announced to the society. Article 10 The people's governments of the townships (towns) where the traditional villages are located are responsible for the implementation of the traditional village protection and development planning, the implementation of relevant construction projects, the organization of the traditional village protection of publicity and education, and do a good job in the day-to-day management of the specific implementation of ecological environmental protection, fire safety, prevention and control of natural disasters, pests and diseases, and to guide the villagers' committees to carry out the protection of traditional villages inheritance work. Article 11 The village committee shall guide the villagers to do a good job in the protection and inheritance of traditional villages, inheritance and carry forward the outstanding cultural practices and morals, the intangible cultural heritage for living heritage.

Support the traditional village protection requirements and principles of benefit distribution into the village rules and regulations. Article 12 The protection and inheritance of traditional villages shall focus on traditional architecture, traditional culture and ecological environment, and maintain the integrity of cultural heritage and the authenticity of villagers' production and life. Article 13 The administrative department of housing and urban-rural construction of the People's Government of the autonomous county shall set up signboards of traditional villages at the main entrances of traditional villages. No unit or individual shall set up without authorization, move, alter or damage the traditional village signboard.

Article 14 The construction activities within the scope of protection of traditional villages should be consistent with the requirements of traditional village protection and development planning. The people's governments of autonomous counties may, in accordance with the law, take compensation, replacement and other means for the protection of the scope of the existing and traditional villages within the overall style of the building (structure) buildings, demolition, remodeling and repair. Article 15 The owner or the right of use of traditional buildings should be in accordance with the requirements of the traditional village protection and development planning, is responsible for the maintenance and repair of traditional buildings. Traditional buildings do not have the owner or the right to use, the villagers' committee is responsible for the maintenance and repair.

Traditional building owners or the right to use should be safe fire, electricity, gas, with the relevant departments to carry out social governance, environmental health protection, fire safety inspections, pest control and other work.
