What are the main types of intellectual property rights?

The ones belonging to intellectual property rights are:

1. Patent rights, the main object of protection of which are inventions, that is to say, inventions, utility models and designs;

2. Copyrights, the main object of protection of which are works such as written works, oral works, and works of art;

3. Trademarks, the main object of protection of which is the right to the exclusive use of a certain range of goods or services;

Legal Basis

Article 3 of the Copyright Law, which came into effect on June 1, 2021

Works referred to in this law are intellectual achievements in the fields of literature, art and science that are original and can be expressed in a certain form, including:

(1) Written works;

(2) Oral works;

(3) Works of art;

(4) Other rights belonging to patents. (ii) oral works;

(iii) works of music, drama, opera, dance and acrobatic art;

(iv) works of fine art and architecture;

(v) photographic works;

(vi) cinematographic works and works created by methods similar to those of cinematography.

Article 2 of the Patent Law effective June 1, 2021

The inventions and creations referred to in this law are inventions, utility models and designs.

Article 8 of the Trademark Law of the People's Republic of China*** and the People's Republic of China

Any sign that can distinguish the goods of a natural person, a legal person, or another organization from the goods of another person, including words, graphics, letters, numerals, three-dimensional symbols, combinations of colors, and sounds, and combinations of the above elements, may be applied for registration as a trademark.
