Notice of Ministry of Human Resources and Social Security, the Ministry of Civil Affairs and the Ministry of Finance on the Measures for Issuing the One-time Death Pension for Staff and Retirees in Institutions

Personnel departments (bureaus), labor and social security departments (bureaus), civil affairs departments (bureaus) and finance departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government, Personnel Bureau of Xinjiang Production and Construction Corps, Labor and Social Security Bureau, Civil Affairs Bureau, Finance Bureau, personnel (cadre) departments of central and state organs and directly affiliated institutions:

Through research, the relevant issues concerning the payment of one-time pensions to staff and retirees in public institutions are hereby notified as follows.

First, a one-time pension (death grant) standard.

With reference to the standard and payment method of death lump-sum pension for staff and retirees of public institutions managed by the Civil Service Law, it shall be implemented in accordance with the provisions of the Notice of the Ministry of Civil Affairs, the Ministry of Personnel and the Ministry of Finance on the Payment Method of Death lump-sum pension for staff and retirees of state organs (No.64 [2007] of the People's Republic of China).

(II) According to the Notice of the Ministry of Labor and Social Security, the Ministry of Personnel, the Ministry of Civil Affairs and the Ministry of Finance on Issues Related to Work-related Injuries of Staff of Non-profit Organizations in Institutions (No.36 [2005] of the Ministry of Labor and Social Security), if the staff of institutions participating in work-related injury insurance in the overall planning area dies at work, the standard of one-time work-related death subsidy shall be implemented in accordance with the provisions of local work-related injury insurance.

(III) Workers and retirees who have participated in the basic old-age insurance for employees of enterprises, institutions and institutions have died of illness, and the one-time pension benefits are still implemented according to local regulations.

(4) In addition to the above circumstances, the standard of one-time pension for the death of staff and retirees in public institutions was adjusted from 5438+ 10/0 in June 2004 to: the basic salary or basic retirement fee for the 40 months before my death on business, and the basic salary or basic retirement fee for the 20 months before my death. The pension benefits of martyrs shall be implemented in accordance with the relevant provisions of the state.

The funds needed to pay a one-time pension for the death of staff and retirees of public institutions shall be solved according to the original channels.

Two, about the one-time pension plan method

From July 1 day, 2006, if the one-time pension for the death of staff and retirees in public institutions is implemented, the calculation base of the one-time pension is adjusted as follows:

(1) staff. The calculation base is the basic salary of the last month before my death, that is, the sum of post salary and salary scale salary.

(2) retirees. The calculation base is the basic retirement fee I enjoyed in the last month before my death, that is, the sum of the basic retirement fee calculated at retirement and the basic retirement fee increased according to state regulations after retirement.

(3) retirees. According to the Notice of the State Council on Printing and Distributing the Interim Measures for the Resettlement of Old, Weak, Sick and Disabled Cadres in the State Council and the Interim Measures for the Retirement and Resignation of Workers in the State Council (Guo Fa [1978] 104No.), the basic retirement living expenses are calculated according to the sum of the basic retirement living expenses calculated at the time of retirement and the basic retirement living expenses increased according to national regulations after retirement.

(four) the staff of embassies and consulates abroad, non-diplomatic personnel abroad and personnel dispatched from Hong Kong and Macao originally belong to the staff of public institutions, and the base of payment is the basic salary in China (Mainland).

After the issuance of this notice, the Notice of the Ministry of Personnel and the Ministry of Finance on the Calculation of the One-time Pension for the Death of the Staff of Public Institutions after the Reform of the Wage System (No.48 [1994]) shall be invalidated.
