Regulations on the Protection of Famous Historical and Cultural Cities in Nanchang

Chapter I General Provisions Article 1 In order to strengthen the protection of historical and cultural cities, inheritance of excellent historical and cultural heritage, and promote the coordinated development of economy and society, according to the "People's Republic of China *** and the State Urban and Rural Planning Law", the State Council, "Regulations on the Protection of Historical and Cultural Cities and Towns and Villages," and other laws and regulations, in conjunction with the actual situation of the city, the enactment of these regulations. Article 2 The planning, protection, utilization and management of famous historical and cultural cities within the administrative area of the city shall be governed by these regulations.

The protection objects of the historic and cultural cities referred to in these regulations include historic districts, historic and cultural districts, historic and cultural towns, historic and cultural villages, historic landscape areas, historic buildings, traditional villages, cultural relics protection units, immovable cultural relics, old and valuable trees, historic place names and intangible cultural heritage. Article 3 The protection of historical and cultural cities shall follow the principles of scientific planning, classification and management, strict protection and rational utilization, maintain the authenticity and integrity of the historical and cultural heritage, and keep the traditional pattern and historical features. Article 4 The people's governments of cities and counties (districts) shall be responsible for the protection and management of famous historical and cultural cities within their administrative regions, and shall incorporate the protection and management of famous historical and cultural cities into the national economic and social development plan. Article 5 The municipal people's government set up a committee for the protection of historical and cultural cities, is responsible for the study of major issues in the protection of historical and cultural cities, guidance and coordination of the protection of historical and cultural cities.

The Committee for the Protection of Famous Historical and Cultural Cities has set up an expert committee for the protection of famous historical and cultural cities (hereinafter referred to as the expert committee). The expert committee consists of experts in planning, culture (cultural relics), real estate, architecture, gardening, tourism, religion, history, toponymy, folklore, law and traditional crafts, etc., and is responsible for demonstrating and evaluating the list of historical and cultural cities for protection, protection planning, protection measures and other matters. Article 6 The competent department of urban and rural planning in conjunction with the competent department of culture (cultural relics) is responsible for the protection and management of the city's historical and cultural cities in the city's specific work; the city's historical and cultural cities protection and management organization (hereinafter referred to as the city's famous city management organization) is responsible for the day-to-day work.

The competent department of urban and rural planning of each county, together with the competent department of culture (cultural relics) at the same level, is responsible for the protection and management of the historical and cultural towns, villages, historical and cultural neighborhoods, historical style areas and historical buildings under its jurisdiction.

Property, development and reform, construction, urban management, land resources (real estate registration), finance, public security, tourism, landscaping, forestry, civil affairs, agriculture, water, environmental protection, transportation, education, religion, and other departments within their respective areas of responsibility *** with the relevant protection and management of historical and cultural cities. Article 7 The township (town) people's government and street offices shall do a good job in the protection of historical and cultural cities. Article VIII of the city, county (district) people's government shall be the protection of historical and cultural cities, included in the financial budget at this level, earmarked.

Protection funds for the census of historical and cultural cities, mapping, declaration, recognition, academic research, professional training, planning, protection of information system construction and maintenance, protection of facilities and environmental improvement, protection and repair subsidies, publicity and education, protection incentives.

Individuals and units are encouraged to donations, investment, the establishment of public welfare organizations, the provision of technical and voluntary services and other ways to participate in the protection of historic and cultural cities. Article IX municipal and county (district) people's governments, as well as urban and rural planning, culture (cultural relics), judicial administration and education and other relevant departments shall strengthen publicity and education on the protection of historic and cultural cities, popularize the knowledge of protection, and enhance the public's awareness of protection. Chapter II Protection List Article 10 The city implements the protection list of famous historical and cultural cities (hereinafter referred to as the protection list) system. The following protection objects shall be included in the protection list:

(1) historical and cultural districts;

(2) historical landscape areas;

(3) historical and cultural towns, historical and cultural villages, traditional villages;

(4) immovable cultural relics including cultural relics protection units of all levels;

(5) historical buildings;

(6) modern and contemporary industrial heritage;

(7) historical buildings; (8) historical and cultural relics; and (9) historical and cultural relics. (vi) modern industrial heritage;

(vii) buried underground cultural relics and ancient ruins;

(viii) elements of the historical environment such as ancient river and lake systems, ancient trees, ancient bridges, ancient roads and ancient stone carvings;

(ix) intangible cultural heritages such as traditional local literature, traditional performing arts, folklore and traditional folk crafts;

(x) old places of historic and cultural (j) old geographical names with historical and cultural value and commemorative significance;

(k) other protection objects determined and announced by the national, provincial and municipal people's governments. Article 11 The protection list shall be published by the municipal people's government.

The national, provincial and municipal people's governments have approved the announcement of the protection of the object, directly into the protection list; county people's government approved the protection of the object should be promptly reported to the municipal people's government, the municipal people's government will be included in the protection list.

Historic landscape areas, historic buildings and other protected objects by the competent department of urban and rural planning, in conjunction with culture (cultural relics), real estate and other departments to seek the views of stakeholders, the public and experts, reported to the people's government at this level for approval.

Any individual or unit may propose to the municipal administration of the famous city to include objects of conservation value in the conservation list. Article 12 Not determined to be published as a historical and cultural district, meets one of the following conditions, the area of one hectare or more, the municipal or county people's government may determine to be published as a historical landscape area:

(1) the area with a relatively intact traditional pattern and historical style;

(2) the area with typicality and distinctiveness, which can reflect the local characteristics of a certain historical period;
