Regulations of Shanghai Municipality on Pension Services

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly and other relevant laws and regulations, combined with the actual situation of this Municipality, in order to standardize the work of the aged care service, improve the aged care service system, meet the needs of the elderly and promote the development of the aged care service. Article 2 These Regulations shall apply to the old-age service and its related support, guarantee, supervision and management activities within the administrative area of this Municipality.

The term "aged care service" as mentioned in these Regulations refers to the life care, rehabilitation care, health management, spiritual comfort, emergency assistance and other services provided by the government and society for the elderly based on the maintenance and maintenance obligations of family members, mainly including home-based aged care services, community-based aged care services and institutional aged care services.

The term "pension service institutions" as mentioned in these Regulations includes pension institutions that provide full-time centralized accommodation and care services for the elderly, and home-based community pension service institutions that provide home and community pension services for the elderly. Article 3 The old-age care service in this Municipality adheres to the people-oriented development concept, follows the requirements of "building a city with people", follows the principles of government leadership, social participation, market operation, overall development, basic guarantee and diversified benefits, and is coordinated with the economic and social development of this Municipality to achieve high-quality development. Article 4 This Municipality shall actively respond to the aging population, improve the old-age care service system which is based on home, supported by community, fully developed by institutions, coordinated by home community institutions and combined with medical care, improve basic old-age care services, develop public welfare old-age care services, promote the marketization of old-age care services, cultivate new forms of old-age care, promote the coordinated development of old-age care undertakings and old-age care industries, and meet the needs of multi-level and diversified old-age care services. Article 5 People's governments at all levels shall incorporate pension services into the national economic and social development plan at the corresponding level, the pension service funds into the fiscal budget at the same level, and the pension service work into the annual work plan and performance appraisal scope.

The Municipal People's Government shall strengthen the leadership of the aged care service, co-ordinate the construction of the aged care service system, guarantee the basic aged care service, promote the healthy development of the aged care service, and establish and improve the municipal co-ordination mechanism for the construction, operation and related subsidy policies of the aged care service facilities.

The District People's Government shall bear the main responsibility of the old-age service in its administrative area, promote the construction of old-age service facilities, improve the support and safeguard measures, strengthen the work force and comprehensive supervision of old-age service, increase the supply of old-age service and improve the quality of old-age service according to the factors such as the number, structure and distribution of the elderly population in its administrative area.

The municipal and district people's governments shall establish and improve the coordination mechanism for the construction of the old-age service system, plan, coordinate and integrate all kinds of old-age service resources, and study and solve major problems in the old-age service.

Township people's governments and sub-district offices are responsible for organizing and implementing the old-age services within their respective jurisdictions, and strengthening the old-age services by providing corresponding community workers or the government to purchase services. Article 6 The municipal and district civil affairs departments are the administrative departments in charge of aged care services within their respective administrative areas, taking the lead in promoting the construction of aged care service system, improving corresponding policies and measures, formulating basic aged care service standards, and being responsible for the supervision and management of aged care services.

The health department is responsible for formulating policies and measures for the combination of medical care and nursing care, and supervising and managing the health work of the elderly such as disease prevention, medical care and health promotion.

The medical security department is responsible for organizing the implementation of the long-term care insurance system and improving the relevant medical insurance policies combining medical care with nursing care.

Development and reform, finance, human resources and social security, planning resources, housing and urban construction management, housing management, market supervision, emergency management, fire rescue, economic informationization, commerce, education, science and technology, public security, transportation, ecological environment, agriculture and rural areas, cultural tourism, financial management, sports, statistics, auditing and other departments and institutions. Should be in accordance with their respective responsibilities, do a good job in old-age services. Article 7 This Municipality shall improve the basic old-age service system. The Municipal People's Government shall formulate and publish the catalogue of basic old-age services in this Municipality, clarify the items and specific contents of basic old-age services, and make timely adjustments according to the level of economic and social development, financial situation and changes in the demand for old-age services.

The basic old-age service should give priority to ensuring the basic old-age service needs of eligible widowed, disabled and severely disabled elderly people, as well as special support personnel of family planning families and key entitled groups. Article 8 This Municipality encourages and supports social forces to provide aged care services, stimulates the vitality of market players, improves the open, competitive, fair and orderly aged care service market, and gives full play to the main role of social forces in aged care services. Ninth children of the elderly and other people who have the obligation to support them shall fulfill their obligations of economic support, life care and spiritual comfort for the elderly.

The city supports families to undertake the function of providing for the aged. Article 10 Trade unions, * * * Communist Youth League, women's federations, disabled persons' federations, Red Cross and social organizations such as pension service organizations, elderly organizations, charitable organizations and voluntary service organizations shall, according to their duties or articles of association, give full play to their respective advantages and work together to do a good job in pension services.

Residents' committees and villagers' committees should give full play to the functions and advantages of autonomy and assist in the work of providing old-age services.

Encourage natural persons, legal persons and other organizations to participate in or support pension services in various forms.
