Regulations of Taiyuan Municipality on Urban Greening (revised on 20 10)

Chapter I General Provisions Article 1 In order to develop urban greening, protect and improve the ecological environment and build a clean and beautiful modern city, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and in light of the actual situation of this Municipality. Article 2 The planning, construction, protection and management of planting and maintaining trees, flowers and other urban greening in the urban areas of this Municipality shall abide by these regulations. Article 3 The Municipal People's Government shall take urban greening construction as an integral part of urban infrastructure and ecological environment construction, incorporate it into the national economic and social development plan, strengthen leadership, increase investment, encourage social investment, strengthen scientific research, establish a target responsibility system, and provide guarantee for the implementation of urban green space system planning. Fourth city greening department is responsible for the organization, inspection, guidance, coordination and supervision of urban greening.

The competent department of urban greening in each district is responsible for the urban greening work within its jurisdiction, and the township (town) people's government and sub-district offices are responsible for the urban greening management work within their jurisdiction, guiding and coordinating the resident units to complete the greening tasks within their communities and units. Relevant government departments should do a good job in urban greening in accordance with their respective responsibilities. Article 5 Urban greening shall adhere to the principles of government leadership, mass participation, unified planning, supporting construction, adapting measures to local conditions, stressing practical results and paying equal attention to construction and management.

Urban greening is mainly based on planting trees, combining trees with flowers and plants, combining plane greening with three-dimensional greening, and gradually building an urban green space system with appropriate total amount, reasonable layout and diverse plants. Sixth units and individuals have the obligation to green and protect trees, flowers and plants and urban greening facilities, and have the right to stop and report the damage to trees, flowers and plants and other greening facilities.

The government should encourage units and individuals to invest and donate money to build memorial forests and trees, and to build and maintain urban public green spaces and other urban green spaces. Seventh people's governments at all levels shall commend and reward units and individuals that have made remarkable achievements in urban greening planning, construction, management and scientific research. Chapter II Planning and Construction Article 8 The municipal competent department of urban greening and the competent department of urban planning shall work out the urban green space system planning according to the overall urban planning, and implement it after being approved by the Municipal People's Government.

The competent department of urban greening in each district shall, according to the urban green space system planning, prepare the implementation plan of urban greening in this district, and report it to the competent department of urban greening for the record after being approved by the district people's government.

All units shall, according to the greening standards stipulated in these regulations, formulate greening plans and phased implementation plans that are in line with the actual conditions of their own units, and report them to the urban greening management department for the record.

The urban green space system planning approved to be incorporated into the overall urban planning shall be strictly implemented, and no unit or individual may change it without authorization. If it is really necessary to change, it shall be reported to the original approval authority for examination and approval. Ninth new urban projects should be arranged in accordance with the urban greening planning, and the green land standards should be implemented in accordance with the following provisions:

(a) the proportion of green space in residential areas to the total land area of residential areas is not less than 35%;

(two) the proportion of urban road green belt area to roads is not less than 25%, the area of secondary road green belt is not less than 20%, and the landscape road is not less than 40%.

(three) the green space of industrial enterprises, transportation hubs, warehouses and commercial centers shall not be less than 25% of the total area;

(four) the unit green space that produces toxic and harmful gases and pollutants is not less than 40% of its total area, and a shelter belt with a width of not less than 50 meters is set up;

(five) schools, hospitals, nursing homes, government organizations, public cultural places, military units and other units of the green space is not less than 35% of its total area;

The supporting green area of new projects in the old city reconstruction area can be reduced by 5% according to the index specified in the preceding paragraph. Tenth city planning departments should be in accordance with the provisions of this Ordinance supporting green land standards for the examination and approval of construction projects. Do not meet the requirements of green planning standards and green area, shall not be approved. Eleventh urban greening projects should implement the qualification examination system, bidding system and project quality supervision system to ensure the quality of urban greening projects.

The design and construction of urban greening projects shall be entrusted to units with corresponding qualification certificates, and the quality supervision procedures for greening projects shall be handled. Twelfth urban construction, expansion and reconstruction projects should include the total investment of supporting greening projects, and its proportion should not be less than 2% of the total investment of construction projects.

Supporting greening project construction funds should be earmarked. After the construction project is approved to start, the construction unit shall deposit the supporting greening project construction funds into the Construction Bank within seven days, and the municipal competent department of urban greening shall strengthen the supervision over the use of funds. Thirteenth supporting greening projects of construction projects should be planned, designed, constructed and accepted at the same time as the main project.

Greening supporting projects without acceptance or unqualified acceptance, the main project shall not be put into use.

If the greening supporting project cannot be completed at the same time as the main project due to special circumstances, it may be moderately postponed with the approval of the Municipal People's Government, but not later than the first greening season after the completion of the main project.
