Article 2 All vehicles, pedestrians and passengers passing through the roads within the administrative area of this Municipality, as well as units and individuals carrying out other traffic-related activities on the roads within the administrative area of this Municipality, shall abide by these provisions.

Article 3 The term "roads" as mentioned in these Provisions refers to roads, urban streets, bridges, tunnels, public squares, public parking lots and other places where vehicles and pedestrians can pass within the administrative area of this Municipality.

The vehicles mentioned in these Provisions refer to motor vehicles and non-motor vehicles that drive and park on the roads within the administrative area of this Municipality.

Article 4 The Municipal Public Security Bureau is the administrative department in charge of road traffic management in this Municipality.

The Traffic Police Detachment of the Municipal Public Security Bureau (Highway Patrol Detachment) is specifically responsible for the road traffic management of this Municipality.

Article 5 The organs, armed forces, organizations, schools, enterprises, institutions and other organizations within the administrative area of this Municipality, as well as the legal guardians of minors, shall carry out publicity on road traffic safety, and educate their subordinates and minors to consciously abide by the laws, regulations and rules on road traffic management, and obey and cooperate with the command and management of the traffic police.

Primary and secondary schools should set up traffic laws and traffic safety common sense education courses, and strengthen traffic safety self-protection education for students.

Article 6 The public security traffic police department and its staff shall strictly perform the statutory duties of road traffic management, adhere to the law enforcement principles of openness, fairness, justice, science, efficiency and combining education with punishment, manage according to law and enforce the law in a civilized manner.

The traffic police department of public security shall make police affairs public, and establish an open system for road traffic management law enforcement, an open system for handling traffic accidents and an investigation system for misjudged cases in road traffic management law enforcement.

Public security traffic police departments should strictly follow the relevant provisions of accident handling procedures and time limit requirements, seriously accept traffic accident alarms and deal with them quickly, and restore traffic in time.

The public security traffic police shall dress in accordance with the regulations and hold relevant certificates when exercising the functions and powers of road traffic management; Check and correct the illegal behavior of the management counterpart, and show the law enforcement certificate when required by the management counterpart; For those who do not show their law enforcement certificates, the management counterpart may refuse to check.

Chapter II Vehicle Driving

Article 7 Vehicles driving on urban roads shall comply with the following provisions:

(1) East of Jiefangmen, south of Binhe East Road, west of Tianshui Road, north of Zhu Min East Road, Zhu Min West Road and Baiyin Road (excluding the above sections), as well as Xijin East Road, Xijin West Road (Jiefangmen to Liu Jiaying Cross), Jianlan South Road, Xizhan Road and the southern section of Dunhuang Road (Shi Lan Technical School to Xizhan Road Cross), from 7: 00 to 2 1.

Vehicles used by the unit can pass on the road sections where vehicles are prohibited from passing in the preceding paragraph with the pass issued by the public security traffic police department.

Article 8 The municipal public security traffic police department shall, according to the road traffic conditions of this Municipality, set up and adjust the sections where motor vehicles are prohibited from turning left, turning around, stopping, overtaking, speed limit and one-way driving, and set up corresponding signs.

Fire engines, ambulances, engineering rescue vehicles, police cars and other special vehicles and military vehicles are not restricted by the provisions of the preceding paragraph when performing emergency and special tasks, but they should ensure traffic safety and explain the situation to the public security traffic police department after the task is over.

Article 9 Some motor vehicles shall run every other day, with limited traffic.

Every day from 7: 00 to 20: 00, all kinds of passenger taxis, minibuses and minibuses in this city pass by the license plate number on a single day, on double days and double days, within the scope of Baiyin Road, Zhu Min East Road, Zhu Min West Road and Railway Station East Road (including the above sections).

Article 10 Small passenger taxis shall stop at temporary taxi parking spots designated by the public security traffic police department, and get off passengers at Xijin East Road, Linxia Road, Zhongshan Road, Qingyang Road, Gaolan Road North Section (north of Railway Bureau Square), Jinchang Road and Donggang West Road. On the premise of not affecting traffic and blocking roads, other sections should stop at the roadside and get on and off according to passengers' requirements.

Eleventh city public security traffic police departments shall, according to the road traffic conditions in this city, timely open up and adjust bus lanes, and report to the municipal government for approval before promulgation and implementation.

Every day from 7: 00 to 19: 00, only buses and trams (including passenger cars and vans, the same below) are allowed to drive in the bus lanes of this city, and other motor vehicles are prohibited from driving or parking; With bus lanes, buses and trams are not allowed to drive or park in other lanes.

Buses and trams are not allowed to wait outside the stop, get on or off the bus and open the door on the way to attract passengers, and are not allowed to chase or rob passengers.

Twelfth Xiuchuan Bridge to the east, Qilihe Yellow River Bridge, Dashaping Sancha Road, Yanchang Road to the south, Donggang overpass to the west, Nanshan Station North Road to the north (including the above sections), agricultural vehicles and tractors are prohibited from passing; However, fresh agricultural and sideline products such as vegetables, fruits and flowers can be transported from 23: 00 to 5: 00 the next day, and newly manufactured agricultural vehicles and tractors in this city's real estate can be transported in one direction with factory certificates during this period.

Fourteenth motorcycles should be driven by the line in the motor vehicle lane and parked at the parking spot approved by the traffic police department of the public security.

Motorcycles are prohibited from driving in non-motor vehicle lanes and parking in non-parking lots and spots.

It is forbidden to refit or assemble motorcycles for driving on the road.

Fifteenth special vehicles for the disabled equipped with mechanical power devices shall apply for license plates and driving licenses according to regulations, otherwise they shall not be allowed to drive on the road.

It is forbidden to rent or sell special vehicles for the disabled with mechanical power devices to non-disabled.

Sixteenth prohibit unauthorized installation or modification of sunshade facilities in motor vehicles and vehicles for the disabled with mechanical power devices.

It is forbidden to install mechanical power devices on non-motor vehicles to drive on the road.

Article 17 Special vehicles, such as fire engines, ambulances, engineering rescue vehicles, police cars, military vehicles, Jiangxi O-brand vehicles and other local vehicles equipped with alarms, should drive and park in strict accordance with traffic signs and road traffic management regulations when there is no emergency or special task. Alarms and horns are not allowed, and they are not allowed to park at will.

The public security traffic police department shall strengthen the management of the vehicles mentioned in the preceding paragraph. In violation of regulations, special vehicles, vehicles with Jiangxi O license plate and other local vehicles equipped with alarms shall be punished according to law; Punish or record violations of military vehicles according to law, and inform the military and police departments of the recorded situation and corresponding punishment suggestions within 10 days from the date of recording.

Chapter III Vehicle Driving

Eighteenth motor vehicle drivers should drive and park in strict accordance with traffic signs and road traffic management regulations.

(seven) shall not be naked or wearing slippers to drive a vehicle;

(eight) when the door or carriage is not closed, it is not allowed to drive, and passengers are not allowed to get on and off when the vehicle is driving;

(9) Do not smoke, eat, chat, use mobile phones, consult paging information or engage in other behaviors that hinder safe driving while driving a vehicle, and do not throw objects outside the vehicle;

(ten) driving a motorcycle must wear a helmet;

(eleven) shall not be handed over to the vehicle without a driver's license;

(twelve) other road traffic management regulations formulated by the municipal government.

Nineteenth motor vehicle drivers should wait in turn in this lane when driving the vehicle in front of the road, and abide by the following provisions:

(a) are not allowed to enter the traffic control lane;

Chapter IV Pedestrians and Passengers

Pedestrians are not allowed to climb or cross traffic isolation facilities such as road guardrails.

It is forbidden to distribute printed advertisements or slide, chase and fight on the road or other activities that hinder the normal passage of vehicles and pedestrians.

Twenty-fourth the implementation of motorcycle or non motor vehicle traffic, shall comply with the following provisions:

(a) close to the right edge of the non-motor vehicle lane or driving on the sidewalk;

(2) When crossing the roadway, drive according to the pedestrian traffic rules;

(six) when riding a minibus, the front passengers must wear seat belts;

(seven) shall not carry inflammable, explosive, toxic and other dangerous goods in motor vehicles, and shall not carry controlled knives and animals in buses, trams and taxis;

(eight) knowing that the driver of a motor vehicle is not allowed to ride without a driver's license or drinking alcohol;

(nine) when riding a two-wheeled motorcycle, you can only ride with the driver in the forward direction behind the driver's seat and wear a helmet.

Chapter V Noise Control of Motor Vehicles

Article 26 To the east of Xiuchuan Bridge, to the south of Dashaping Bridge, to the west of Donggang Overpass, to the north of Nanshan Station North Road, Yangjiaqiao (including the above sections) and Xigu Welfare Road, motor vehicles are prohibited from honking their horns, and passenger vehicles are prohibited from using loudspeakers to call out or attract passengers.

Motor vehicles are prohibited from using steam horns in all sections of the city.

It is forbidden for motor vehicles to call people by horn.

Article 27 When a motor vehicle uses a horn in a non-honking area, the volume shall be controlled within 105 decibel, and each honking shall not exceed half a second, and the honking shall not exceed three consecutive times.

Twenty-eighth fire engines, ambulances, engineering rescue vehicles, police cars and other special vehicles and military vehicles, the installation and use of warning lights and alarms should comply with the relevant provisions.

It is forbidden to use the alarm when not performing emergency or special tasks.

Chapter VI Others

Twenty-ninth without the consent of the public security traffic police department, no unit or individual may set up facilities that hinder traffic safety or conduct activities that hinder traffic on roads and their ancillary facilities.

It is forbidden to damage, block or set, move or dismantle road traffic signs, markings, signal lights, electronic monitoring facilities and other road traffic facilities without authorization.

It is forbidden to dry grain and dig ditches to divert water on the road.

Thirtieth municipal and highway management departments need to occupy or dig roads for new construction, widening and reconstruction, and other units need to occupy or dig roads for construction, they shall go through the formalities in accordance with the provisions of relevant laws, regulations and rules.

The construction unit shall obey the supervision and management of the public security traffic police department, set up obvious warning signs and necessary safety protection facilities at the construction site, and set up lighting equipment at night.

The construction unit shall carry out the construction according to the specified time, place and requirements. After the completion of the construction, the site shall be cleaned in time, the pavement and road facilities shall be repaired, and the traffic shall be resumed in time after the acceptance by the relevant administrative departments.

Thirty-first without the approval of the municipal public security traffic police department and reported to the municipal government for approval, no unit or individual may set up motor vehicle parking lots and non-motor vehicle parking spots on the road.

When building, expanding or rebuilding large-scale buildings, bazaars and public places, it is necessary to plan and set up motor vehicle parking lots and non-motor vehicle parking spots of corresponding scale; The planning administrative department and the construction administrative department shall, when examining and approving the planning and construction, obtain the consent of the public security traffic police department in advance on the planning and setting of motor vehicle parking lots and non-motor vehicle parking spots.

Thirty-fourth junior high school, primary school and kindergarten students and children need to cross the road after school, they should organize traffic, and primary school students and children should also be led by teachers or picked up by parents.

When students and children queue up to cross the road, all kinds of vehicles should stop and make way.

Article 35 When a motor vehicle carries articles that are too long, too high and too wide, and inflammable, explosive, toxic and harmful dangerous goods, it shall be reported to the public security traffic police department and the relevant administrative departments for approval in accordance with relevant regulations, and it shall be driven on the road according to the approved time limit, speed and route.

Thirty-sixth freight cars, passenger cars, agricultural vehicles, tractors and motorcycles are prohibited from carrying passengers.

Motor vehicles that meet the scrapping standards and terminate their use shall be disintegrated under the supervision of the traffic police department of the public security.

Article 37 When a driver drives a motor vehicle to the scene of a traffic accident, he should take the initiative to rescue the injured or transport articles.

The traffic police may ask the driver of a motor vehicle who walks to the scene of a traffic accident to assist in rescuing the injured or transporting articles; For those who refuse to assist, their vehicles may be forcibly requisitioned, but after the rescue mission is completed, the vehicles shall be returned in time and the situation shall be explained in writing to the owners.

Thirty-eighth passenger car gambling, fraud, theft, robbery and other illegal and criminal cases, passenger car sales staff should be in the premise of ensuring passenger traffic safety, according to the situation to stop or report to the public security department in a timely manner.

Chapter VII Legal Liability

Thirty-ninth pedestrians and passengers in violation of the provisions, one of the following acts, the traffic police department of public security shall be ordered to correct the illegal behavior, and impose a fine of 10 yuan:

(eight) do not stop at the prescribed parking spot or stay in the motor vehicle lane to hinder traffic;

(nine) when the motor vehicle is running, it sticks out of the car or interferes with the driver's driving or throws objects outside the car;

(ten) carrying inflammable, explosive, toxic and other dangerous goods or carrying controlled knives and animals by bus, tram or taxi.

Fortieth non-motor vehicle drivers in violation of the provisions, one of the following acts, by the public security traffic police department shall be ordered to correct the illegal behavior, and impose a fine of more than 20 yuan and less than 50 yuan:

(1) Cycling on sidewalks, footbridges and motor vehicle lanes;

(two) support, parallel driving or other acts that hinder traffic;

(3) Riding a bicycle with people (1 preschool children excepted);

(4) Parking vehicles;

(five) running a red light or crossing the line, stop on the left and wait for the signal;

(six) driving a vehicle without safety braking device or braking device failure;

(seven) the load is super high, super wide and super long;

(eight) driving a non-motor vehicle with its own mechanical power device on the road;

(nine) driving a non-motor vehicle in the no-go time and no-go area;

(ten) drunk driving or driving a car.

Article 41 If the number plate of the disabled car equipped with mechanical power device is not fully on the road, the public security traffic police department shall impose a fine of more than 20 yuan and less than 50 yuan.

Renting, selling or driving a special vehicle for the disabled equipped with a mechanical power device to a non-disabled person, the public security traffic police department shall order it to make corrections within a time limit and impose a fine of more than 50 yuan and less than 200 yuan.

Forty-second motor vehicle drivers in violation of the provisions, one of the following acts, the public security traffic police department shall order them to correct the illegal behavior, and impose a fine of more than 20 yuan and less than 50 yuan:

(a) driving a two-wheeled motorcycle without wearing a helmet;

(two) honking in the area where honking is prohibited or not using the horn according to the regulations;

(three) driving a motor vehicle speeding, overloading, overcrowding or ultra-high, ultra-wide and ultra-long loading;

(4) Changing lanes or stopping or starting without using turn signals;

(five) driving a tractor or agricultural vehicle in a no-go area.

Forty-third motor vehicle drivers in violation of the provisions, one of the following acts, by the public security traffic police department shall be ordered to correct the illegal behavior, and impose a fine of more than 50 yuan 100 yuan:

(1) Smoking, eating, chatting, using a mobile phone or consulting pager information while driving a vehicle naked and wearing slippers;

(2) Driving in a non-motor vehicle lane without following the prescribed lane or driving in the opposite direction;

(three) after entering the guide lane, not driving in the prescribed direction or changing lanes at will;

(four) driving a motor vehicle whose safety device does not meet the requirements, the parts are invalid, the loading regulations are not met, or the number plate is illegible;

(five) vehicles are not allowed to pull over or get on or off passengers;

(6) Parking vehicles in places where parking is prohibited.

Forty-fourth motor vehicle drivers in violation of the provisions, one of the following acts, the public security traffic police department shall order them to correct the illegal behavior, and impose a fine of more than 50 yuan and less than 200 yuan:

(a) driving in a no-go area, no-go time or on a one-way street in the opposite direction and forcibly turning left;

(2) Failing to overtake, overtaking or overtaking or turning around at will;

(three) driving a vehicle that has not been inspected or failed to pass the inspection;

(4) Buses and trams do not stop at the station, wait for passengers at the bus station, get on or off passengers on the way outside the station, do not open the door to attract passengers, chase and snatch passengers from each other during driving, or do not drive in the bus lane within the prescribed time limit;

(five) other motor vehicles driving or parking in bus lanes in violation of the prescribed time;

(seven) in case of students and children queuing to cross the road without stopping;

(eight) special vehicles, military vehicles, vehicles with Jiangxi O license plate and other vehicles equipped with alarms use alarms, horns or park at will when there is no emergency or special task;

(nine) driving freight cars, passenger cars, agricultural vehicles, tractors and motorcycles to carry passengers.

Forty-fifth motor vehicle drivers in violation of the provisions, one of the following acts, by the public security traffic police department shall be ordered to correct the illegal behavior, impose a warning, and impose a fine of more than 65438 yuan in 300 yuan:

(a) running a red light or not listening to the traffic police;

(two) after the traffic jam, not waiting for the forced passage in turn;

(4) Giving a motor vehicle to a person without a driver's license to drive;

(5) Driving a motor vehicle after drinking alcohol;

(6) using lent, fraudulent, forged or invalid motor vehicle driver's license, driving license, pass or driving on the road without a license, and forging or lending traffic management-related documents to others;

(seven) highway long-distance passenger vehicles grab passengers, stop and put them in disorder, causing traffic jams;

(8) Failing to report to the police in time after a traffic accident, causing serious traffic jams;

(nine) driving through, overtaking or not avoiding the motorcade performing official duties.

Article 46 Whoever commits gambling, fraud, theft, looting of property or other acts that disturb the order of the bus ride, if the circumstances are minor and do not constitute a crime, shall be fined between 65,438 yuan and 0,000 yuan in 200 yuan by the highway patrol department of the public security department, and shall be ordered to make a statement of repentance.

Forty-seventh in violation of the provisions, one of the following acts, by the public security traffic police department to impose a fine of more than 500 yuan and 200 yuan on the responsible unit, for individuals to impose a fine of more than 65438 yuan 200 yuan; If losses are caused, it shall also be ordered to bear the liability for compensation:

(a) damage, shelter or unauthorized installation, removal, demolition of road traffic signs, markings, signal lights, electronic monitoring facilities and other road traffic facilities;

(two) without the consent of the public security traffic police department, set up facilities that hinder traffic safety or conduct activities that hinder traffic on roads and their ancillary facilities;

(three) drying grain on the road, digging ditches to divert water.

Forty-eighth without the consent of the public security traffic police department, unauthorized excavation of road construction operations, the responsible unit shall be fined 1000 yuan, and the individual shall be fined 1000 yuan, and shall be ordered to make corrections within a time limit.

Article 49 If a motor vehicle driver is punished in accordance with these Provisions, the public security traffic police department shall also score points in accordance with the Measures for Scoring Traffic Violations of Motor Vehicle Drivers, and may temporarily suspend or revoke the motor vehicle driver's license according to law; If the circumstances are serious, it may be punished in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If the case constitutes a crime, it shall be submitted to judicial organs for criminal responsibility according to law.

Fiftieth traffic police departments in correcting and punishing traffic violations, can take the following administrative compulsory measures according to law:

(1) Summoning;

(two) temporarily detained motor vehicles, non motor vehicles, illegal occupation of stalls;

(3) towing a vehicle or locking the wheels of a motor vehicle;

(four) to detain the motor vehicle driver's license certificate or certificate, motor vehicle driving license;

(5) Confiscating illegal devices or licenses.

When the public security traffic police department takes administrative compulsory measures, it shall issue the Certificate of Administrative Compulsory Measures for Public Security Traffic Management and deliver it to the parties on the spot.

After the party concerned pays the fine or accepts the punishment, the traffic police department of the public security shall promptly return the temporarily detained vehicles, articles, detention vouchers and photos.

Article 51 If a motor vehicle driver fails to implement the administrative penalty decision of the public security traffic police department for more than 3 months without justifiable reasons, and commits one of the following acts, the public security traffic police department may revoke his motor vehicle driver's license according to law:

(1) Failing to pay the fine;

(2) Not handled by the public security traffic police department;

(three) do not participate in the traffic violation scoring test;

(4) Failing to receive the detained motor vehicle driver's license after being notified.

If the party concerned fails to accept the treatment after being notified for more than 6 months or fails to receive the detained vehicles, articles and stranded motor vehicle driver's license from the public security traffic police department, the public security traffic police department may revoke its motor vehicle license plate and driving license according to law, and the vehicles and articles shall be turned over to the financial department.

Fifty-second provisions shall obtain the consent of the public security traffic police department, laws, regulations and rules have corresponding procedures and time limits, from its provisions; If there is no corresponding provision, the public security traffic police department shall make a written reply of approval or disapproval within five days from the date of receiving the consultation notice or the application of the parties, and explain the reasons for disapproval.

Article 53 If a party refuses to accept or accept the traffic violation punishment and administrative compulsory measures made by the traffic police department of public security in accordance with these Provisions, it may bring an administrative reconsideration or administrative lawsuit according to law.

Article 54 Public security traffic policemen who neglect their duties, abuse their powers or engage in malpractices for selfish ends in road traffic management shall be given administrative sanctions by their units or higher authorities; If the circumstances are serious enough to constitute a crime, they shall be submitted to judicial organs for criminal responsibility according to law.

Fifty-fifth except the traffic police department of public security, no unit or individual has the right to decide and impose penalties for traffic violations, and no unit, organization or individual may detain the motor vehicle driver's license and driving license.

The traffic police department of public security shall not detain all kinds of certificates and photos that do not belong to the management of the public security department when imposing punishment.

Chapter VIII Supplementary Provisions

Article 56 The Municipal Public Security Bureau may, according to the actual needs of major festivals and road traffic management, issue notices, implement traffic control and adjust the direction of road traffic.

The traffic police department of public security can take temporary traffic control measures according to the actual needs of emergency and road traffic management.

According to the actual needs of traffic management, the traffic police on duty can take necessary emergency measures at the scene, but they should make a special report to their units afterwards.

Fifty-seventh specific application problems in the implementation of these Provisions shall be interpreted by the Municipal Public Security Bureau.

Article 58 These Provisions shall come into force as of 20011.

If the relevant provisions issued by the municipal government, the Municipal Public Security Bureau and the Municipal Public Security Traffic Police Department before the promulgation of these Provisions are inconsistent with these Provisions, these Provisions shall prevail.
