The requirements of the new socialist countryside for the planning and protection of traditional villages

Guiding Opinions on Strengthening the Protection of Traditional Villages in China

Traditional villages inherit the historical memory of the Chinese nation, the wisdom of production and life, the crystallization of culture and art and the regional characteristics of all ethnic groups, maintain the roots of Chinese civilization and entrust the homesickness of children of all ethnic groups throughout the country. However, in recent years, the destruction of traditional villages has become increasingly severe, and it is urgent to strengthen the protection of traditional villages. In order to implement the spirit of the CPC Central Committee and the State Council on protecting and promoting excellent traditional culture and strengthen the protection of traditional villages, we hereby put forward the following opinions:

I. Guiding ideology, basic principles and main objectives

(1) guiding ideology. Guided by the spirit of the 18th National Congress of the Communist Party of China and the Third Plenary Session of the 18th Central Committee, we will thoroughly implement the spirit of the Central Conference on Urbanization, the Central Conference on Rural Work and the National Conference on Improving Rural Living Environment, and follow the principles of scientific planning, overall protection, inheritance and development, concern for people's livelihood, steady progress and key management to strengthen the protection of traditional villages, improve the living environment and realize the sustainable development of traditional villages.

(2) Basic principles. Adhere to local conditions and prevent similarities; Adhere to planning first and prohibit disorderly construction; Adhere to the priority of protection and prohibit over-exploitation; Adhere to people's livelihood and oppose formalism; Insist on meticulous work and prevent cutting corners; Adhere to democratic decision-making and avoid all-around arrangements.

(3) Main objectives. Through the joint efforts of the central government, local governments, villagers and society, in three years, the cultural heritage of villages listed in the list of Chinese traditional villages (hereinafter referred to as China traditional villages) has been basically protected, with basic production and living conditions, basic disaster prevention and safety guarantees and basic protection and management mechanisms, and the comprehensive ability of protection and development of traditional villages has been gradually enhanced.

Second, the main task

(1) Protect cultural heritage. Protect the village's traditional site selection, pattern, style, natural pastoral landscape and other overall spatial forms and environment. Comprehensive protection of cultural relics, historical buildings, traditional houses and other traditional buildings, focusing on restoring concentrated areas of traditional buildings. Protect historical and environmental elements such as ancient bridges and culverts, ancient wells, ponds and vines. Protect intangible cultural heritage and related items and places.

(2) Improve infrastructure and public environment. Improve the infrastructure such as roads, water supply, garbage and sewage treatment in the village. Improve the necessary safety facilities such as fire fighting, disaster prevention and disaster avoidance. Transformation of public environment around cultural heritage, public places, ponds and ditches.

(3) Rational utilization of cultural heritage. Explore social and emotional values, and continue and expand the use of functions. Excavate the scientific and artistic value of history and carry out research and educational practice activities. Excavate economic value and develop traditional industries and tourism.

(four) the establishment of protection management mechanism. Establish and improve laws and regulations, implement responsibilities and obligations, formulate protection and development plans, introduce support policies, encourage villagers and the public to participate, establish archives and information management systems, and implement early warning and withdrawal mechanisms.

Third, the basic requirements

(1) Maintain the integrity of traditional villages. Pay attention to the integrity of village space, maintain the overall spatial form and internal relationship between buildings, villages and surrounding environment, and avoid the confusion of "flower arrangement" and the disharmony between new and old villages. Pay attention to the integrity of village history, protect the historical memory of each period, and prevent blindly shaping the style of a specific period. Pay attention to the integrity of village values, excavate and protect the historical, cultural, artistic, scientific, economic and social values of traditional villages, and prevent one-sided pursuit of economic values.

(2) Maintain the authenticity of traditional villages. Pay attention to the authenticity of cultural heritage, put an end to making things out of nothing and copy them. Pay attention to the authenticity of cultural heritage forms, avoid actions such as filling ponds and straightening roads to change the historical pattern and style, and prohibit unfounded reconstruction and imitation. Pay attention to the authenticity of the connotation of cultural heritage and prevent blind entertainment. Pay attention to the authenticity of villagers' production and life, reasonably control the proportion of commercial development area, and prohibit all villagers from moving out on the grounds of protection and utilization.

(3) Maintain the continuity of traditional villages. Pay attention to the continuity of economic development, improve villagers' income, let villagers enjoy the fruits of modern civilization and realize living and working in peace and contentment. Pay attention to the continuity of traditional culture and inherit excellent traditional values, customs and skills. Pay attention to the continuity of ecological environment, respect the production and life style of harmonious coexistence between man and nature, and prohibit over-exploitation at the expense of ecological environment.

Fourth, protective measures.

(1) Improve the directory. Continue to carry out supplementary investigations, find out the base of traditional villages, and pay close attention to the inclusion of villages with important value in the list of traditional Chinese villages. Do a detailed investigation on the cultural heritage of villages, and establish the archives of traditional villages in China according to the requirements of "one village, one file". Unified set of China traditional village protection signs, the implementation of listing protection.

(2) formulate protection and development plans. All localities should, in accordance with the Urban and Rural Planning Law and the Basic Requirements for Planning the Protection and Development of Traditional Villages (J.Z. [20 13] 130), pay close attention to the planning and approval of the protection and development of traditional villages. Before the planning approval, it shall pass the technical review organized by the Ministry of Housing and Urban-Rural Development, the Ministry of Culture, National Cultural Heritage Administration and the Ministry of Finance (hereinafter referred to as the Fourth Bureau). Involving cultural relics protection units, it is necessary to prepare a cultural relics protection plan and perform relevant procedures before it can be included in the protection and development plan. Where a representative project of intangible cultural heritage is involved, the protection unit shall formulate protection measures, which shall be incorporated into the protection and development plan after being approved by the cultural authorities responsible for evaluating the project.

(3) Strengthen construction management. New construction, renovation, transformation and other construction activities in the planning area must be approved by the township people's government after preliminary examination, reported to the county-level housing and urban-rural construction department for approval, and obtained rural construction planning permission. Where an applicant involves a cultural relics protection unit, it shall obtain the consent of the administrative department of cultural relics. China prohibits the demolition and merger of traditional villages. Before the protection and development plan is approved, the construction activities that affect the overall style and traditional buildings will be suspended. Where related construction and cultural relics migration are involved in the division of cultural relics protection units, the examination and approval procedures shall be performed according to law. Traditional building craftsmen should be certified, and those who restore cultural relics should also obtain the qualification certificate of construction professionals of cultural relics protection projects.

(4) Increase capital investment. Considering the urgency of protecting traditional villages, the differences in existing conditions and scale, the central finance, on the basis of clarifying the powers and expenditure responsibilities of governments at all levels, co-ordinates rural environmental protection, "one thing, one discussion" financial awards and special funds for beautiful countryside construction, national key cultural relics protection, central subsidies for local cultural, sports and media development, and intangible cultural heritage protection, and supports the protection and development of traditional villages in China every year. The scope of support includes the demonstration of the protection and utilization of traditional buildings, the construction of disaster prevention and mitigation facilities, the restoration of historical and environmental elements, the improvement of health and other infrastructure, the improvement of public environment, the protection of cultural relics and the protection of representative projects of national intangible cultural heritage. Mobilize the enthusiasm of the central and local governments and encourage local governments at all levels to increase investment on the basis of central subsidies. Guide social forces to participate in protection through donations, investments, shares, leasing and other means. Explore the establishment of traditional building claim protection system.

(5) Do a good job in technical guidance. The four ministries and commissions formulate national plans for the protection and development of traditional villages, organize research and demonstration of protection technology development and preparation of technical guidelines, and organize training and publicity and education. The provincial departments of housing and urban construction, culture, cultural relics and finance (hereinafter referred to as the four provincial departments) should do a good job of technical guidance in the local area, set up a provincial expert group and report it to the four ministries and commissions for the record. Each traditional village in China should appoint a provincial expert group member to participate in the decision-making of village construction projects and guide the protection and repair of traditional buildings on the spot.

V. Organization, leadership, supervision and management

(a) clear responsibilities and obligations. According to the division of responsibilities, the four ministries and commissions jointly carry out the protection of traditional villages, publish the list of Chinese traditional villages, formulate policies and support measures for protection and development, organize, guide and supervise the preparation and implementation of protection and development plans, protect and inherit intangible cultural heritage, and protect and utilize cultural relics, and examine and issue central financial subsidies jointly with relevant departments.

The four provincial departments are responsible for the protection and development of traditional villages in the region, compiling the protection and development plan of traditional villages in the region and formulating supporting measures. The Municipal People's Government is responsible for the preparation of the overall implementation plan for the protection of traditional villages in this area, the formulation of supporting measures, and the establishment and improvement of the project library. The people's government at the county level is the main responsible person for the protection and development of traditional villages in this area, and is responsible for the specific implementation of traditional village protection projects. Township people's governments shall be equipped with special staff to cooperate with supervision and management.

The village collective shall, according to the protection and development plan, incorporate the protection requirements into the village rules and regulations, and give play to the main role of villagers' democratic participation, democratic decision-making, democratic management and democratic supervision. The main leaders of the two village committees should undertake the specific work of village protection and management, and should become the main members of the protection and development planning group. Owners and users of traditional buildings should carry out maintenance and repair in accordance with the planning requirements.

(two) the establishment of protection management information system. The four ministries and bureaus set up an information system for the protection and management of traditional villages in China, registering the quantity, distribution and present situation of various cultural heritages in villages, and recording the implementation of projects such as the protection and utilization of cultural heritages and the renovation of village infrastructure. Promote the establishment of a sound project library, laying a foundation for the selection, organization, implementation, evaluation and acceptance, supervision and management of traditional village protection projects.

(3) Strengthen supervision and inspection. The four ministries and bureaus shall organize annual inspections and spot checks on the protection work, inform the inspection results and send a copy to the provincial people's government. Four departments at the provincial level shall organize inspections in their own regions, and submit the annual inspection report to the Fourth Bureau before the end of February each year. The four ministries and commissions will make use of China traditional village protection management information system and China traditional village website to disclose important information and encourage social supervision. Project implementers should disclose the project contents, contracts and investment amount, and guarantee villagers' right to participate in planning, construction, management and supervision.

(4) Establish an exit mechanism. When the cultural heritage of the village is seriously damaged, the four provincial departments shall put forward an endangered warning notice to the people's government at the county level where the village is located. Seriously damaged, identified by the Fourth Bureau as no longer meeting the selection conditions of traditional villages in China, the Fourth Bureau will remove the village from the list of traditional villages in China and notify it.

Six, the application, approval and disbursement of central subsidy funds

In principle, the application for central subsidy funds is based on prefecture-level cities. After the preliminary examination by the four provincial departments, the following application materials shall be provided to the four departments and bureaus: application documents, overall implementation plan of each prefecture-level city (see annex 1 for compilation requirements), summary table of local project requirements (see annex 2 for format), and protection and development planning of traditional villages. Relevant special funds management measures have clear requirements, and shall be reported separately as required. 20 14 in areas applying for central subsidies, four provincial departments should complete the submission before may 20.

According to the application materials from all over the country, the four ministries and bureaus study and determine the scope of villages to be included in the support, combine the annual budget arrangement of special funds and the project library, verify the amount of local subsidy funds, and issue funds in accordance with the original measures for the management of special funds. All localities should use funds in accordance with the original direction of financial support and make good use of the central subsidy funds to achieve practical results.
