What is the concept of fraud

Today we will learn about the crime of fraud. The crime of fraud refers to the act of obtaining public or private property in a large amount by means of fictitious facts or concealment of the truth for the purpose of illegal possession. And network fraud is a kind of fraud crime.

Because of the use of the Internet, text messages, phone calls and so on as the main modus operandi, known as network fraud. Network fraud cases are different from traditional crimes, with virtual, hidden and other characteristics, and therefore can not be fully referred to the relevant legal provisions of the crime of fraud to be punished.

Legal basis

Article 266 of the Criminal Law, fraudulent public or private property, the amount of larger, shall be sentenced to fixed-term imprisonment of less than three years, detention or control, and or a single fine; the amount of a huge amount or other serious circumstances, shall be sentenced to fixed-term imprisonment of more than three years or less than ten years, and a fine;

the amount of a particularly large amount or other particularly serious circumstances, shall be sentenced to more than ten years of fixed-term imprisonment or life imprisonment, and a fine or confiscation of property. Where this Law provides otherwise, it shall be in accordance with the provisions.
