Is brain death considered a real death in Chinese law?

The general concept of death in Chinese society is that a person is considered dead if his heart stops beating completely and his spontaneous breathing disappears, i.e. "cardiac death". This concept has guided the country's traditional medicine and law.

Internationally, brain death legislation is a trend. In contrast, China, with the exception of Taiwan and Hong Kong, does not yet have an official text on brain death legislation. The reality of health reform and social development urgently calls for brain death legislation.
