Regulations of Yunnan Province on Road Transportation

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Regulations of the People's Republic of China on Road Transport and other relevant laws and regulations, combined with the actual situation of this province, in order to maintain the order of the road transport market, ensure the safety of road transport, protect the legitimate rights and interests of the parties involved in road transport and promote the healthy development of road transport. Article 2 Those who engage in road transport business and road transport-related business within the administrative region of this province shall abide by these regulations.

The road transport business mentioned in the preceding paragraph includes road passenger transport business and cargo transport business; Road transport related businesses include motor vehicle driver training, road transport station (field) operation, motor vehicle maintenance operation, comprehensive performance testing of motor vehicles, car rental, handling, freight forwarding, freight stowage, warehousing and tally, etc. Article 3 The people's governments at or above the county level shall strengthen their leadership over road transport management, ensure the investment of road transport management funds, strengthen the management of road transport market and safety production, and implement comprehensive management.

The people's governments at or above the county level shall encourage the scientific and technological progress of road transport, promote energy conservation and emission reduction, promote the informationization of road transport, and guide road transport operators to implement large-scale, intensive and corporate operations.

The people's governments at or above the county level shall formulate preferential policies to encourage the development of rural road transport, and take necessary measures to improve the bus rate in towns and administrative villages. Article 4 The transportation departments of the people's governments at or above the county level shall be responsible for organizing and leading the road transportation management within their respective administrative areas, and the road transportation management institutions at or above the county level shall be responsible for the specific implementation of the road transportation management.

Public security, production safety supervision, development and reform, housing and urban construction, industry and commerce, quality supervision, tourism and other relevant administrative departments shall, in accordance with their respective responsibilities, do a good job in road transport management. Chapter II General Provisions of Road Transport Article 5 The competent transportation department of the people's government at or above the county level shall draw up a road transport development plan and submit it to the people's government at the same level for approval before implementation. Road transport development planning should include the overall planning and road transport station (field) construction layout and other special planning. Article 6 Anyone who engages in road passenger transport business, cargo transport business, motor vehicle driver training, road transport station (field) business, motor vehicle maintenance business and comprehensive performance testing of motor vehicles shall meet the conditions prescribed by laws and regulations and obtain a business license according to law.

Road transport management institutions at or above the county level shall follow the procedures and conditions stipulated in laws, administrative regulations and these Regulations, and follow the principles of giving priority to public interests, effective allocation of resources, safety, convenience, orderly competition and fairness, impartiality and openness. Article 7 Operators engaged in road transport-related businesses such as freight forwarding, freight stowage, warehousing and tally, car rental, handling and loading shall go to the local county-level road transport management institution for filing within 15 days after obtaining the business license of the administrative department for industry and commerce. Article 8 Drivers engaged in commercial road passenger and freight transport shall pass the examination of the local state (city) road transport management institution and obtain the qualification certificate.

Drivers, loading and unloading managers and escorts engaged in the transport of dangerous goods shall pass the examination by the transportation department of the local state (city) people's government and obtain the qualification certificate.

Drivers engaged in commercial road passenger and freight transport and drivers, loading and unloading management personnel and escorts engaged in dangerous goods transport shall receive regular continuing education. Article 9 Road transport business license, road transport license, bus license, long-distance bus license, class line passenger transport business license, bus passenger signs and tourist passenger signs shall be uniformly printed by the provincial road transport management institution.

Drivers and coaches engaged in commercial road passenger and freight transport shall carry relevant road transport documents and other relevant number plates with the vehicle.

It is forbidden to transfer, lease, forge or alter road transport documents or signs and signs. Tenth road transport management institutions at or above the county level shall strengthen the management and service of vehicles in other provinces. If vehicles from other provinces enter the province to engage in freight transportation for more than 1 month, the vehicle driver shall go to the local county-level road transport management institution for the record. Eleventh operators engaged in road transport and related businesses shall abide by the relevant provisions of the state on safety in production and formulate emergency plans for traffic accidents, natural disasters and other emergencies. The emergency plan formulated by the dangerous goods transport operators and the maintenance operators of dangerous goods transport vehicles shall be reported to the state (city) road transport management institution for the record.

In the event of traffic accidents, natural disasters and other emergencies, road transport operators and their employees shall obey the unified dispatch and command of the people's governments at or above the county level.

The economic expenses incurred in carrying out the emergency transportation task shall be compensated by the people's government that arranged the emergency transportation task. Twelfth passenger and freight vehicles, coaches and taxis should be regularly maintained and tested.

Operating passenger and freight vehicles, coaches and taxis are evaluated by the comprehensive performance testing institution of motor vehicles every year 1 vehicle technical grade. Among them, bus passenger vehicles and tourist passenger vehicles with a mileage of more than 200 kilometers are evaluated twice a year.

The road transport management institution shall, according to the vehicle technical grade evaluation results or test reports issued by the comprehensive performance testing institutions of motor vehicles, determine whether the technical conditions of passenger and freight vehicles meet the operating license conditions and whether the technical conditions of coaches and rental vehicles can engage in corresponding teaching and rental activities in accordance with relevant regulations.

State (city) county road transport management agencies are responsible for the annual inspection of operating vehicles and coaches.

Passenger and freight transport operators shall establish technical files for operating vehicles.
