Rules of Procedure of the Standing Committee of Shanxi Provincial People's Congress (2000)

Chapter I General Provisions Article 1 In order to standardize the procedures of the Standing Committee of the Provincial People's Congress and improve the efficiency of the proceedings, these Rules are formulated in accordance with the relevant provisions of the Constitution of People's Republic of China (PRC), the Organic Law of People's Republic of China (PRC) Local People's Congresses and Local People's Governments at Various Levels, and in combination with the actual work. Article 2 The Standing Committee of the Provincial People's Congress (hereinafter referred to as the Standing Committee) shall carry out its work in accordance with the statutory authority and procedures and exercise its functions and powers collectively. Article 3 When deliberating bills and decisions, the Standing Committee shall fully promote democracy and implement the principle of democratic centralism. Fourth important meetings and major activities held by the Standing Committee, except those involving state secrets, should be publicly reported by major news organizations in the province. Chapter II Convening of Meetings Article 5 Meetings of the Standing Committee shall be held at least once every two months.

The meeting of the Standing Committee shall be convened and presided over by the director. The director may entrust the deputy director to preside over the meeting. Article 6 A meeting of the Standing Committee may be held only when more than half of all its members are present. Article 7 The draft agenda of the meeting of the Standing Committee shall be drawn up by the meeting of directors and submitted to the plenary meeting of the Standing Committee for adoption.

The date and agenda of the meeting of the Standing Committee shall be decided by the meeting of directors. Article 8 When the Standing Committee holds a meeting, it shall notify the members of the Standing Committee of the date of the meeting and the draft agenda seven days before the meeting is held. Temporary notice can be issued for temporary meetings. Article 9 When the Standing Committee holds a meeting, the responsible persons of the provincial people's government, the provincial higher people's court and the provincial people's procuratorate attend the meeting as nonvoting delegates.

Upon the decision of the board of directors, the following persons may attend the meeting as nonvoting delegates:

(1) Deputy Secretary-General of the Standing Committee, member of the Special Committee of the Provincial People's Congress (hereinafter referred to as the Special Committee), and person in charge of the working body of the Standing Committee;

(two) the person in charge of the Standing Committee of the Municipal People's Congress with districts;

(three) some counties, cities not divided into districts, municipal districts of the people's Congress Standing Committee responsible person;

(four) the person in charge of the main news units in the province.

According to the draft agenda of the meeting, upon the decision of the meeting of directors, some deputies to the National People's Congress, deputies to the provincial people's congress, other personnel and heads of relevant departments of the provincial people's government may be invited to attend the meeting as nonvoting delegates. Article 12 When the Standing Committee is in session, it may, if necessary, arrange members of the Standing Committee to speak on their own topics at plenary meetings or joint group meetings. Thirteenth members of the Standing Committee must attend the meeting of the Standing Committee. If you can't attend the meeting due to illness or other special reasons, you should ask for leave in writing to the director of the Standing Committee through the general office of the Standing Committee before the meeting. If you can't attend the plenary meeting or joint meeting during the meeting, you should ask for leave from the Secretary General of the Standing Committee through the general office of the Standing Committee; If you cannot attend the group meeting, you should ask for leave from the convener of the group meeting.

The attendance and absence of members of the Standing Committee at the meeting of the Standing Committee was published in the Bulletin of the Standing Committee of Shanxi Provincial People's Congress. Chapter III Proposals and Deliberations Article 14 The meeting of directors may submit proposals within the scope of functions and powers of the Standing Committee for deliberation by the Standing Committee.

The provincial people's government, the provincial higher people's court, the provincial people's procuratorate and the special committees of the provincial people's congress may submit bills to the Standing Committee within the scope of functions and powers of the Standing Committee, and the meeting of directors shall decide to submit them to the meeting of the Standing Committee for deliberation. They may also submit them to the relevant special committees for deliberation first, or submit them to the working organs of the Standing Committee for study and report, and then decide to submit them to the meeting of the Standing Committee for deliberation.

Five or more members of the Standing Committee may jointly submit to the Standing Committee a bill that falls within the scope of functions and powers of the Standing Committee, and the meeting of directors shall decide whether to submit it to the meeting of the Standing Committee for deliberation, or it may first submit it to the relevant special committee for deliberation or the working body of the Standing Committee for study, submit a report, and then decide whether to submit it to the meeting of the Standing Committee for deliberation; If it is not submitted to the meeting of the Standing Committee for deliberation, it shall report to the meeting of the Standing Committee or explain it to the sponsor. Fifteenth when the provincial people's Congress is not in session, more than one fifth of the members of the meeting of directors or the Standing Committee may jointly propose to the Standing Committee the deputies to the National People's Congress elected by individual provinces. The reasons for the recall shall be clearly stated in the recall case. The sixteenth provincial people's Congress presidium decided to authorize the Standing Committee to consider the motion, in accordance with the relevant provisions of the "measures" of Shanxi Provincial People's Congress. Seventeenth local regulations submitted to the meeting of the Standing Committee for preliminary examination shall be submitted to the Standing Committee fifteen days before the meeting is held, and the explanation of the draft regulations and related drafts shall be attached for reference. Article 18 A case of appointment or dismissal of personnel submitted to a meeting of the Standing Committee for deliberation shall be submitted to the Standing Committee ten days before the meeting is held, and relevant written materials shall be attached. Nineteenth plenary session of the Standing Committee to listen to the explanation of the sponsor, held a group meeting to consider the proposal; According to the needs, a joint meeting or plenary meeting can also be held to consider the proposal.

When the meeting of the Standing Committee deliberates a bill, the sponsor and the person in charge of other relevant organs shall attend the meeting, listen to the deliberation opinions and answer questions.
