Measures for the Administration of Road Transport Stations in Fujian Province

Article 1 In order to strengthen the management of road transport stations, improve the service function of road transport stations and safeguard the legitimate rights and interests of transport operators, passengers and shippers, these Measures are formulated in accordance with relevant national laws and regulations and combined with the actual situation of this province. Article 2 The term "road transport station" as mentioned in these Measures refers to the places that provide road transport services for operators engaged in road passenger transport and road cargo transport (hereinafter referred to as transport operators), passengers and shippers, including road passenger stations and ticket outlets, road freight stations and business outlets, and operating vehicle parking lots. However, urban bus stops and parking lots that do not provide road transport services are excluded.

Transport stations are divided into public and private according to the service objects. Providing road transport services for vehicles operating outside the unit and collecting transport service fees, it is a public transport station; Only providing road transport services for vehicles operated by the unit is a self-use transport station. Article 3 Units and individuals that establish and operate transport stations and engage in activities related to transport stations and yards within the territory of this province shall abide by these Measures. Article 4 Transport stations and yards shall follow the principles of unified planning, rational layout, diversified business and coordinated development, support the society to set up public transport stations and yards, and encourage self-use transport stations and yards to open to the society.

The establishment of transport stations should adhere to the principle of being conducive to the distribution and transit of passengers (goods), to the entry and exit of vehicles and not to the smooth flow of road traffic.

The operation of transport stations and yards shall follow the principles of voluntariness, equality, honesty and credit, and shall not hinder the fair competition of other operators, nor infringe upon the legitimate rights and interests of passengers, shippers and transport operators. Article 5 The transportation departments of the people's governments at or above the county level (including the county level, the same below) shall be responsible for the management and supervision of transportation stations and yards within their respective administrative areas, which shall be specifically implemented by the road transportation management departments under the transportation departments.

Public security organs at all levels shall supervise and manage the road traffic order and public security order of transportation stations and yards according to law. Article 6 People's governments at all levels shall incorporate the construction of transportation stations into urban construction planning. The urban construction planning department shall, jointly with the transportation department and the public security organ, examine and approve the traffic station construction planning scheme. Seventh units or individuals to set up a transport station shall apply to the local public security organs at or above the county level, and submit the following materials:

(a) the station location, vehicle entrances and exits and their safety facilities.

(two) the traffic plan for operating vehicles entering and leaving the station and the driving route plan for entering and leaving the city.

The public security organ shall, within 30 days from the date of receiving the application for the establishment of a transport station, examine whether the operation of vehicles entering and leaving the station hinders road traffic and decide whether to agree or disagree; If no decision is made within the time limit, it shall be deemed as consent.

Road passenger stations along the way are planned and set up by the road transport management department at or above the county level in conjunction with the public security organs at the same level. Eighth units or individuals operating public transport stations shall apply to the road transport management departments at or above the county level, and submit the following materials:

(a) an application for operating a public transport station;

(two) business scale and project feasibility study report;

(three) business institutions, responsible persons and staff;

(four) the site land use certificate;

(5) The public security organ at or above the county level agrees.

The road transport management department shall decide whether to approve or not within 30 days from the date of receiving the application for the operation of public transport stations; If no decision is made within the time limit, it shall be deemed as approval. If an enterprise's application is approved, it must be in industrial and commercial registration before it can start its business. Article 9 A self-use transport station shall meet the following conditions, and can only be used after passing the acceptance by the road transport management department at or above the county level:

(a) the entrance is convenient for vehicles to enter and exit, and does not hinder the smooth flow of road traffic, with the consent of the public security organs at or above the county level;

(2) Having parking and departure places and places and facilities for providing passenger and freight services for passengers and shippers;

(3) Having basic inspection, repair and maintenance facilities to ensure the safe operation of vehicles and the safety of fire fighting equipment;

(four) equipped with management personnel and service personnel to adapt to the business project, and established a management system to adapt to the business project. Tenth without the consent of the road transport management department at or above the county level and the approval of the public security organs at the same level, the city streets shall not be used as temporary parking lots for road passenger transport and road freight transport. Eleventh public transport stations to suspend business, should apply to the road transport management department three months in advance, approved and announced to the public in a certain way, can be closed. Twelfth due to changes in road traffic conditions, the local public security organs at or above the county level in conjunction with the road transport management departments at the same level decided to adjust or relocate the transport stations that hinder the smooth traffic, the public security organs shall notify the transport station operators three months in advance; Transport station operators shall adjust or relocate within the prescribed time limit. Thirteenth transport stations shall abide by the provisions of the state on road transport, implement the freight rates and charging standards approved by the transportation and price departments, and use the unified bills stipulated by the provincial transportation and tax departments. Article 14 A transport station shall provide the following basic services for transport operators, passengers and shippers:

(a) to provide a clean, hygienic and well-ventilated transportation production and service environment;

(2) Promulgating the scope of passenger and cargo transportation, operating routes, shift times and mileage prices with eye-catching signs, equipped with clocks, and posting publicity maps of embargoed and restricted goods;

(three) to provide service organizations for transportation stations, maintain safety production and traffic order in the stations, and prohibit overloaded vehicles from leaving the station;

(4) Organizing inspection and preventing prohibited articles and dangerous goods from entering the station, boarding and transporting, and maintaining public order in the station.
