Provisions of Hebei Province on the Administration of Surveying and Mapping Aerial Photography

Article 1 In order to strengthen the administration of surveying and mapping aerial photography, safeguard national security and social interests, and promote economic and social development, these Provisions are formulated in accordance with the Measures for the Implementation of the Surveying and Mapping Law of People's Republic of China (PRC) in Hebei Province and other relevant laws and regulations, combined with the actual situation of this province. Second in the administrative area of this province engaged in surveying and mapping aerial photography activities, shall abide by these provisions. Article 3 The term "aerial photography of surveying and mapping" as mentioned in these Provisions refers to the activities of taking pictures and scanning the earth's surface with photographic equipment on airplanes, airships and other aircraft for the purpose of obtaining geographic information data by civil surveying and mapping. Article 4 The administrative departments of surveying and mapping of the people's governments at or above the county level shall be responsible for the unified supervision and administration of surveying and mapping aerial photography within their respective administrative areas.

Other relevant departments of the people's governments at or above the county level shall be responsible for the related work of surveying and mapping aerial photography in accordance with the prescribed duties. Fifth people's governments at or above the county level shall strengthen the leadership of surveying and mapping aerial photography, organize relevant departments to establish a sharing mechanism of surveying and mapping aerial photography results, and avoid repeated implementation of related surveying and mapping projects. Article 6 Surveying and mapping aerial photography includes basic aerial photography and non-basic aerial photography. Basic aerial photography projects shall be organized and implemented by the administrative department of Surveying and Mapping of the provincial people's government, and non-basic aerial photography projects shall be organized and implemented by the project investors or their entrusted units. Seventh basic aerial photography should be included in the province's basic surveying and mapping planning, the relevant budget should try to meet the urgent needs of basic surveying and mapping work, and the funds needed for basic aerial photography should be solved from the special funds for basic surveying and mapping arranged in the budget. Article 8 The administrative department of surveying and mapping of the municipal people's government with districts and the relevant departments of the provincial people's government shall, according to the needs of the local area and the work of this department, put forward suggestions on basic aerial photography projects to the administrative department of surveying and mapping of the provincial people's government in accordance with regulations. The administrative department of Surveying and mapping of the provincial people's government shall, after comprehensively balancing the submitted project proposal, prepare the annual plan of basic aerial photography in the whole province. Article 9 The implementation of surveying and mapping aerial photography projects shall comply with the relevant provisions of the General Aviation Flight Control Regulations. Tenth before the implementation of surveying and mapping aerial photography projects, surveying and mapping units shall register with the administrative department of Surveying and mapping of the provincial people's government or its entrusted administrative department of Surveying and mapping of the municipal people's government with districts.

If the registered project has achievements suitable for surveying and mapping aerial photography, the administrative department of surveying and mapping shall advise the relevant departments and units to make use of the existing achievements. Eleventh surveying and mapping units shall establish a quality management system for surveying and mapping aerial photography results, strictly implement the technical specifications and standards for surveying and mapping aerial photography stipulated by the state, and ensure the quality of the results. Twelfth surveying and mapping aerial photography project is completed, the results should be sent to the relevant military departments for military security review according to the relevant provisions of the state. Thirteenth the use of financial funds to implement the surveying and mapping aerial photography project is completed, the administrative department of Surveying and mapping shall entrust the legally authorized surveying and mapping results quality supervision and inspection institutions to conduct quality inspection of surveying and mapping results; After the completion of the surveying and mapping aerial photography project implemented with other funds, the project investor shall entrust the quality supervision and inspection institution of surveying and mapping results to conduct the quality inspection of surveying and mapping results as needed.

Surveying and mapping aerial photography results without quality inspection or unqualified inspection, shall not be provided to others. Fourteenth the use of financial funds to implement the surveying and mapping aerial photography project, by the surveying and mapping units to the provincial people's government administrative departments of Surveying and mapping data; Surveying and mapping aerial photography projects implemented with other funds shall be declared by the project investors to the administrative department of Surveying and mapping of the provincial people's government. Article 15 The administrative department of surveying and mapping of the provincial people's government shall, within 10 working days from the date of receiving the submitted aerial photographic data of surveying and mapping, hand over the results of surveying and mapping to the storage unit for safekeeping, and regularly publish the catalogue of results to the society to promote the socialized application of aerial photographic data of surveying and mapping. Sixteenth surveying and mapping results storage units shall establish the filing, storage and confidentiality system of surveying and mapping aerial photography results according to law, equipped with necessary facilities and equipment, and take effective protective measures to ensure the integrity and safety of the results. Seventeenth basic aerial photography results should be updated regularly. The updating period of basic aerial photography results in urban planning areas is generally not more than 3 years, and it is not more than 5 years in other areas.

The results of basic aerial photography, which is used for emergency prevention and emergency disposal and is urgently needed for the economic and social development of this province, shall be updated in time. Article 18 Where the products developed and produced by using the aerial photography results of surveying and mapping involving state secrets have not been handled by the administrative department of surveying and mapping of the State Council or the administrative department of surveying and mapping of the people's government at the provincial level, the classification shall not be lower than that of the aerial photography results of surveying and mapping. Article 19 If a legal person, other organization or individual needs to use aerial photography data of surveying and mapping to contain basic surveying and mapping achievements that belong to state secrets, it shall put forward a clear purpose and scope of utilization before using it, and report it to the administrative department of surveying and mapping of the provincial people's government for examination and approval. Without approval, no unit or individual may provide it with information on the results of surveying and mapping aerial photography that contains basic surveying and mapping results that belong to state secrets. Twentieth to provide overseas within the administrative area of this province belongs to the state secrets of Surveying and mapping aerial photography results, should be in accordance with the examination and approval procedures prescribed by the state, reported to the administrative department of Surveying and mapping in the State Council or the provincial people's government administrative department of Surveying and mapping for examination and approval. The administrative department of Surveying and mapping of the provincial people's government shall solicit the opinions of the relevant military departments before examination and approval.
