(Decree of the Ministry of Radio, Film and Television 1 1No. 1994 was issued on February 3rd) \x0d\x0d\ Chapter I General Provisions \ x0d \ Article 1 These Provisions are formulated in accordance with Article 13 of the Regulations on the Administration of Ground Receiving Facilities for Satellite TV Broadcasting (hereinafter referred to as the Regulations) promulgated by the State Council. \x0d\ Article 2 The Ministry of Radio, Film and Television is the centralized management department of satellite television broadcasting ground receiving facilities (hereinafter referred to as satellite ground receiving facilities), and is responsible for the management of satellite ground receiving facilities nationwide together with the Ministry of Public Security and the Ministry of National Security. \ x0d \ x0d \ Local radio and television administrative departments at all levels are the centralized management departments of local satellite ground receiving facilities, and are responsible for the management of satellite ground receiving facilities within their respective jurisdictions together with local public security departments and national security departments. The responsibility of the administrative department of radio and television is to implement centralized management of satellite ground receiving facilities, examine and approve the establishment of satellite ground receiving facilities, and organize inspections on the production, sale and use of satellite ground receiving facilities; The responsibility of the public security department is to investigate and deal with illegal acts that resist or hinder the management department from performing official duties according to law, and to assist the management department in conducting technical inspections of satellite ground receiving facilities; The responsibility of the national security department is to review and verify the technical performance of satellite ground receiving facilities, conduct technical safety inspections, and take necessary technical preventive measures as needed. \x0d\x0d\ Chapter II Installation of Satellite Ground Receiving Facilities \ x0d \ Article 3 An entity applying for installation of satellite ground receiving facilities to receive TV programs transmitted by satellite shall meet the following conditions: \ x0d \ (1) It has a definite receiving direction, receiving contents and audience range; (2) Having receiving equipment that meets the national standards; (3) Having qualified full-time management personnel; \x0d\ (4) Having a sound management system. \x0d\ Article 4 Any unit may apply for setting up satellite ground receiving facilities to receive domestic TV programs transmitted by satellite. The following units and places may apply for setting up satellite ground receiving facilities to receive overseas TV programs transmitted by satellite: \x0d\ (1) Higher-level and larger-scale units such as education, scientific research, journalism, finance, economy and trade. What is really needed for business work; \x0d\ (2) Foreign-related hotels with a three-star or national standard of Grade II or above; \x0d\ (3) apartments where foreigners and people from Hong Kong, Macao and Taiwan work or live. \x0d\ Article 5 Any unit that needs to set up satellite ground receiving facilities to receive domestic TV programs must apply to the local radio and television administrative department at or above the county level, and report to the local municipal radio and television administrative department for examination and approval. Units directly under provinces, autonomous regions and municipalities directly under the Central Government may directly report to the radio and television administrative departments of provinces, autonomous regions and municipalities directly under the Central Government for examination and approval. \x0d\ The approved unit shall purchase satellite ground receiving facilities with the certificate of the examination and approval authority. After the installation of satellite ground receiving facilities is completed, the examination and approval authority will issue a license for receiving domestic TV programs transmitted by satellite (hereinafter referred to as the license) and report it to the radio and television administrative departments of provinces, autonomous regions and municipalities directly under the Central Government and the national security department for the record. The format of this certificate is uniformly formulated by the Ministry of Radio, Film and Television, and printed by all provinces, autonomous regions and municipalities directly under the Central Government. \x0d\ All kinds of schools and educational and teaching units that set up satellite ground receiving facilities to receive domestic educational and television programs transmitted by satellite should also go through the examination and approval procedures according to the above procedures. After examination and approval, the local education administrative department shall be responsible for the management, and accept the inspection and management of the radio and television administrative department and the public security and national security departments. Any unit that needs to set up satellite ground receiving facilities to receive overseas TV programs must apply to the local radio and television administrative department at or above the county level (including the county level), and report to the local radio and television administrative department of the province, autonomous region or municipality directly under the Central Government for examination and approval after being signed by the local radio and television administrative department and the national security department. Units that have been examined and approved shall purchase satellite ground receiving facilities with the certificate issued by the examination and approval authority. After the installation of satellite ground receiving facilities is completed and accepted by the radio and television administrative departments of provinces, autonomous regions and municipalities directly under the Central Government and the national security department, the radio and television administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall issue licenses for receiving overseas TV programs by satellite (hereinafter referred to as licenses) and report them to the Ministry of Radio, Film and Television and the Ministry of National Security for the record. This license is uniformly printed by the Ministry of Radio, Film and Television. \x0d\ Article 6 No individual may install or use satellite ground receiving facilities. \x0d\ However, in areas where local TV stations, TV relay stations, TV turntables and cable TV stations cannot receive TV programs, individuals can apply for installing satellite ground receiving facilities to receive domestic TV programs. Individuals who need to set up satellite ground receiving facilities must apply to the local radio and television administrative department at or above the county level (including the county level) with the consent of their units and the certificate issued by them, and report to the radio and television administrative department of the province, autonomous region or municipality directly under the Central Government for examination and approval after the local radio and television administrative department and the national security department sign their opinions. Individuals who have been examined and approved shall purchase satellite ground receiving facilities with the certificate issued by the examination and approval authority. After the installation of satellite ground receiving facilities is completed and accepted by the radio and television administrative departments of provinces, autonomous regions and municipalities directly under the Central Government and the national security department, the radio and television administrative departments of provinces, autonomous regions and municipalities directly under the Central Government will issue the License for Receiving Domestic TV Programs Transmitted by Satellite. Personal satellite receiving antennas shall not occupy public places and affect the beautiful environment and daily life of the surrounding residents. \x0d\ Article 7 When necessary, the Ministry of Radio, Film and Television may directly approve the establishment of satellite ground receiving facilities and issue corresponding licenses. \x0d\ Article 8 Before the promulgation of the management regulations, the satellite ground receiving facilities that the unit has set up without approval do not meet the application conditions for setting up satellite ground receiving facilities in the preceding paragraph, and shall be dismantled. Those who meet the application conditions for setting up satellite ground receiving facilities mentioned in the preceding paragraph must go through the examination and approval procedures in accordance with the provisions of the management regulations and implementation rules within six months from the date of promulgation of the management regulations. \x0d\ Article 9 It is forbidden for unlicensed units and individuals to set up satellite ground receiving facilities to receive TV programs transmitted by satellites. \x0d\ Article 10 The construction unit that installs satellite ground receiving facilities must hold the installation license of satellite ground receiving facilities. The conditions and measures for applying for installation licenses shall be formulated by the administrative departments of radio and television of all provinces, autonomous regions and municipalities directly under the Central Government. Units and individuals that set up satellite ground receiving facilities must provide installation and maintenance services by units that hold installation licenses for satellite ground receiving facilities. \x0d\x0d\ Chapter III Reception and Use of Satellite TV Programs \ x0d \ Article 11 Units and individuals holding licenses must receive and use satellite TV programs in accordance with the requirements of receiving purpose, receiving content, receiving mode and audience range specified in the licenses. Foreign-related hotels with the license to receive overseas TV programs transmitted by satellite can send the received overseas transmission of television programmes to the guest room through the hotel's cable (closed-circuit) TV system. Other units that hold the license to receive overseas TV programs transmitted by satellite shall limit the viewing range according to the needs of their work, and shall not place receiving facilities and terminals outside the prescribed receiving range. It is forbidden to transmit and receive overseas TV programs in the cable (closed-circuit) TV system of this unit. It is forbidden to broadcast or otherwise spread overseas TV programs transmitted by satellite in public places such as stations, docks, airports, shops, film and television halls and dance halls. It is forbidden to use satellite ground receiving facilities to receive and disseminate reactionary and obscene satellite TV programs. \x0d\ Article 12 TV stations, TV relay stations, TV difference turntables, cable TV stations and cable TV stations are prohibited from relaying overseas TV programs transmitted by satellites through antenna systems. \x0d\ Article 13 The license shall not be altered or transferred. Units that need to change the contents stipulated in the license or no longer receive TV programs transmitted by satellite shall, in accordance with the application procedures for setting up satellite ground receiving facilities to receive TV programs, promptly report to the examination and approval authority for renewal or cancellation of the license. \x0d\ Article 14 The publicity and advertisement of satellite ground receiving facilities shall not violate the relevant provisions of administrative regulations and these Detailed Rules. \x0d\x0d\ Chapter IV Production, sale and import of satellite ground receiving equipment \ x0d \ Article 15 Satellite ground receiving equipment shall be produced by enterprises designated by the Ministry of Electronic Industry. Measures for the examination and approval and management of designated production enterprises shall be formulated separately by the Ministry of Electronic Industry in consultation with relevant departments. \x0d\ Article 16 Satellite ground receiving facilities shall be sold at designated places. Measures for the examination, approval and management of designated sales units shall be formulated separately by the administrative departments for industry and commerce of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government in conjunction with the administrative departments of domestic trade, radio and television, electronics industry, etc. Designated sales units can only sell satellite ground receiving facilities that have passed quality certification to units and individuals holding certificates issued by radio and television administrative departments at or above the prefecture level (including prefecture level). \x0d\ Article 17 The quality certification certificate and certification mark of satellite ground receiving facilities shall be issued by the certification institution recognized by the State Bureau of Technical Supervision or its authorized department after passing the certification in accordance with the provisions of relevant quality certification laws and regulations; Without quality certification, it shall not be sold or used. \x0d\ Article 18 The imported satellite ground receiving facilities must hold the certificates issued by the Ministry of Radio, Film and Television, and the special parts of the imported satellite ground receiving facilities must hold the certificates issued by the Ministry of Electronic Industry, and go through the examination and approval procedures at the National Mechanical and Electrical Products Import and Export Office, and the customs will release them with the examination and approval documents. Individuals are prohibited from bringing or mailing satellite ground receiving facilities into the country. \x0d\x0d\ Chapter V Legal Liability \ x0d \ Article 19 The administrative departments of radio and television at or above the county level (including the county level) shall impose administrative penalties on units and individuals that violate the provisions of Articles 9 to 14 of these Rules. The specific punishment measures are as follows: \x0d\ (1) Units that violate the provisions of Articles 9, 11, 12 and 13 of these Rules may be punished with a warning, a fine of 1000 to 50,000 yuan, confiscation of the satellite ground receiving facilities they use and revocation of their licenses; \x0d\ (2) An individual who violates the provisions of Articles 9, 11 and 13 of these Rules may be given a warning, fined from 500 yuan to 5,000 yuan, the satellite ground receiving facilities used by him shall be confiscated, and the license shall be revoked; \x0d\ (3) Units that violate the provisions of Article 10 of these Rules and undertake the construction task of installing satellite ground receiving facilities without a license for installation of satellite ground receiving facilities may be given a warning and fined 1000 to 30,000 yuan; \x0d\ (4) Violating the provisions of Article 14 of these Rules, a warning and a fine of 1000 to 30,000 yuan may be imposed. \x0d\ above administrative punishment can be single or combined. \x0d\ The administrative penalties imposed on the same unit or individual who violates these Detailed Rules twice or more shall be decided separately and implemented jointly. The administrative punishment for the same illegal act can only be punished once, and the punishment cannot be repeated. \x0d\ Article 20 Whoever, in violation of the provisions of Article 15 of these Rules, produces satellite ground receiving facilities without approval shall be punished in accordance with the relevant provisions of the Ministry of Electronic Industry. \x0d\ Article 21 Whoever, in violation of the provisions of Article 16 of these Rules, sells satellite ground receiving facilities without approval, or sells satellite ground receiving facilities to units and individuals without certificates issued by the administrative department of radio and television, shall be ordered by the administrative department for industry and commerce to stop selling, confiscate its satellite ground receiving facilities, and may also be fined less than twice the sales amount. Whoever, in violation of the provisions of Article 17 of the detailed rules for implementation, sells satellite ground receiving facilities without quality certification or unqualified certification, shall be ordered by the standardization administrative department to stop selling, and shall be fined less than 3 times the illegal income, and the person in charge of the illegal unit may be fined less than 5,000 yuan. \x0d\ Article 22 Whoever, in violation of the provisions of Article 18 of these Rules, imports or brings satellite ground receiving facilities into the country without authorization shall be dealt with by the Customs in accordance with the relevant provisions of the Customs Law. \x0d\ Article 23 Anyone who resists or obstructs the management department from managing the production, sale, installation and use of satellite ground receiving facilities according to law shall be punished by the public security department in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If the circumstances are serious enough to constitute a crime, the judicial organs shall investigate the criminal responsibility of the parties concerned according to law. \x0d\ Article 24 Anyone who uses satellite ground receiving facilities to engage in activities endangering national security shall be dealt with by the national security and public security departments in accordance with the provisions of the National Security Law. \x0d\ Article 25 If a party refuses to accept the punishment decision made in accordance with administrative regulations and these Detailed Rules, it may apply for administrative reconsideration or bring an administrative lawsuit in accordance with the Regulations on Administrative Reconsideration and the Administrative Procedure Law. For those who do not apply for reconsideration, prosecute or perform the punishment decision, the administrative departments such as radio and television that have made the punishment decision may enforce it according to law (except as otherwise provided by law). \x0d\ Article 26 The fine shall be turned over to the state treasury. \x0d\x0d\ Chapter VI Supplementary Provisions \ x0d \ Article 27 The relevant departments of the People's Liberation Army, the Ministry of Public Security and the Ministry of National Security of China respectively formulate regulations on the establishment and management of satellite ground receiving facilities for military, public security and national security services, and report them to the Ministry of Radio, Film and Television for the record. However, the installation, installation and use of satellite ground receiving facilities in dormitory areas, hotels and other non-military, public security and national security service places shall be managed in accordance with the management regulations and implementation rules. Foreign embassies (consulates) in China and other institutions enjoying diplomatic privileges and immunities shall set up satellite ground receiving facilities and handle them through diplomatic channels. \x0d\ Article 28 When receiving and using TV programs transmitted by satellite, licensed units shall respect the rights of TV program copyright owners. \x0d\ Article 29 Measures for the collection and use of management fees for satellite ground receiving facilities shall be formulated by the Ministry of Radio, Film and Television in consultation with relevant departments, or by the radio and television administrative departments of provinces, autonomous regions and municipalities directly under the Central Government in consultation with relevant departments. \x0d\ Article 30 The radio and television administrative departments of all provinces, autonomous regions and municipalities directly under the Central Government may, in accordance with administrative regulations and these Detailed Rules for Implementation, formulate specific measures for the administration of satellite ground receiving facilities in conjunction with relevant departments. \ x0d \ x0d \ Article 31 These Detailed Rules shall come into force as of the date of promulgation. Where the previously issued regulations are inconsistent with the administrative regulations and detailed rules for implementation, the administrative regulations and detailed rules for implementation shall prevail.
