Road Transportation Management Regulations of Guizhou Province (amended in 2004)

Chapter I General Provisions Article 1 In order to strengthen the management of road transport, maintain the order of road transport, the establishment of unity, development, competition, orderly road transport market, to protect the legitimate rights and interests of operators and their service recipients, according to the relevant state laws and regulations, combined with the actual situation in our province, the formulation of these regulations. Article 2 The road transport referred to in these regulations, refers to the highway, city streets, alleys, rural roads and public **** square, public **** parking lot engaged in passenger transport, cargo transport and transport related auxiliary industry. Article 3 All units and individuals engaged in commercial road transportation within the administrative area of this province, as well as their service recipients and supervisory managers, shall comply with these regulations. Article 4 road transport adhere to a variety of economic components * * * with the development, unified management, active support, guarantee safety, improve efficiency, quality service principle, to protect legitimate business, against unfair competition. Article 5 The people's governments at or above the county level shall, in accordance with the needs of the national economy and social development, formulate road transport development plan, into the national economy and social development plan and organize the implementation of this level.

Encourage and support investment in the road transportation industry. Chapter II Supervision and Management Article 6 The traffic administration department of the people's governments at or above the county level is the competent authority of the road transport industry in the administrative region, and the road transport management authorities established by it specifically exercise the supervision and management functions of road transport, with the following main responsibilities:

(1) to examine and approve the business qualifications, business projects and scope of road transport operators in accordance with the provisions of the regulations;

(2) to Road transport capacity placement, model adjustment and transport service facilities configuration, construction and overall planning;

(3) according to the authority to produce, issue and validate road transport operating documents, documents and signs;

(4) according to the provisions of the road transport operator's business practices, vehicle technical condition and maintenance quality supervision and inspection;

(5) according to the provisions of the levied transportation fees;

(6) implementing industry management of automobile driving training work;

(7) accepting complaints from road transport operators and their service recipients, and mediating disputes in business activities;

(8) other duties stipulated by laws and regulations. Article 7 The road transportation management personnel may, according to the needs of the work to the business unit, the operation site or in the provincial people's government approved the establishment of the inspection station to carry out inspection tasks.

Road transport management personnel to carry out inspection tasks, must be uniformly dressed, wearing a sign, with the provincial people's government administrative departments of transportation issued by the administrative law enforcement documents, impartiality, civilized law enforcement. Article VIII of the road transport management organs should be open procedures and results, the establishment of a reporting system, accept social supervision.

Road transport authorities should be the party's complaints within 30 days from the date of receipt of complaints to deal with. Chapter IV Passenger and Cargo Transportation Article 13 The road passenger transportation (hereinafter referred to as passenger transportation), including shuttle bus passenger transportation, tourist passenger transportation, chartered bus passenger transportation, cab passenger transportation, scheduled passenger transportation.

Road cargo transportation (hereinafter referred to as freight), including general cargo transportation, less-than-truckload freight transportation, dangerous goods transportation, containerized cargo transportation, transport of bulky goods and fresh cargo transportation. Article XIV engaged in commercial passenger transportation, freight transport operators must strictly enforce the relevant state regulations to protect the safety of passengers and goods, in accordance with the provisions of the insurance, to provide quality service. Article XV passenger and freight transport operators, should be in accordance with state regulations and technical specifications for the use of vehicles, regular maintenance, testing vehicles, keep the vehicle in good condition, clean, complete facilities, in line with the technical conditions of the vehicle.

Prohibit the use of end-of-life vehicles and unqualified technical performance of vehicles operating passenger and freight transportation. Article XVI engaged in commercial passenger and freight transportation, the driver must have the appropriate business knowledge and skills, and hold the provincial people's government public security, transportation department issued a valid certificate.

Drivers engaged in commercial passenger transportation must also comply with the "Guizhou Provincial Regulations on Administration of Motor Vehicle Traffic Safety," the provisions of Article 24. Article XVII passenger and freight transport operators must carry with the road transport management authorities issued by the "road transport certificate", the use of "travel road list" and special passenger and cargo tickets, the implementation of the provincial people's government prices, the traffic administration department approved the transport prices, pay traffic fees.
