Regulations of Shanxi Province on the Protection of Pingyao Ancient City

Chapter I General Provisions Article 1 In order to comprehensively preserve, protect, restore and display Pingyao ancient city listed in the World Heritage List, these Regulations are formulated in accordance with the provisions of relevant state laws and regulations and in light of the actual situation of this province. Article 2 The term "Pingyao Ancient City" as mentioned in these Regulations refers to the ancient city wall of Pingyao and its cultural relics, traditional buildings, street scenes, ancient and famous trees, as well as the protection scope and construction control zone determined according to the planning outside the ancient city wall, including Zhenguo Temple and Shuanglin Temple.

The traditional buildings mentioned in the preceding paragraph refer to houses, businesses, temples, ancestral halls and other buildings and structures with historical and cultural value that are not listed as cultural relics protection units.

Traditional buildings are identified and confirmed by Pingyao County People's Government in conjunction with relevant provincial departments in accordance with relevant national and provincial regulations, and obvious protection signs are set up. Article 3 Any organization or individual in Pingyao ancient city and any organization or individual entering this area shall abide by these regulations. Article 4 The provincial people's government shall strengthen the leadership over the protection of Pingyao ancient city and incorporate it into the national economic and social development plan. Fifth Pingyao County People's Government is fully responsible for the protection and management of Pingyao ancient city.

Provincial construction and cultural relics administrative departments shall be responsible for the protection and supervision of Pingyao ancient city in accordance with their respective responsibilities. Sixth Pingyao ancient city protection should follow the principle of "permanent preservation and sustainable utilization", and implement overall planning and hierarchical management.

The protection of Pingyao ancient city should pay attention to the protection, excavation and development of traditional culture with local characteristics. Seventh Pingyao ancient city protection, maintenance and management funds were included in the financial budget of Shanxi Province, Jinzhong District Administrative Office, Pingyao County, to absorb funds and subsidies in line with state regulations. Article 8 All organizations and individuals have the obligation to protect the ancient city of Pingyao, and have the right to report and accuse acts that damage the ancient city of Pingyao. Ninth Provincial People's Government and Pingyao County People's Government shall commend and reward organizations and individuals who have made outstanding contributions in the protection, maintenance, research, development and utilization of Pingyao ancient city. Chapter II Protection Article 10 Pingyao County People's Government shall be responsible for organizing the preparation of the protection plan for Pingyao Ancient City (hereinafter referred to as the protection plan), which shall be promulgated and implemented after being approved by the provincial people's government. Eleventh Pingyao ancient city protection in accordance with the principle of comprehensive protection, highlighting the key points, the implementation of zoning and grading protection, the scope of protection is divided into absolute protection areas, first, second and third level protection areas, first and second level construction control areas and first, second and third level protection streets. Twelfth zoning and grading protection should follow the following standards:

(1) Absolute protected areas shall maintain the original state of traditional buildings in strict accordance with the provisions of the Law on the Protection of Cultural Relics.

(two) the group layout, shape, spatial characteristics, materials and colors of traditional buildings in the first-class protected areas shall not be changed.

(three) to protect the layout and style of existing traditional buildings in the two protected areas, and the new buildings should be coordinated with the style of the ancient city.

(four) to protect the layout and style of traditional buildings in the three-level protected areas, and to dismantle or transform uncoordinated buildings and structures.

(five) the first level construction control area to retain the existing farmland and Beicheng residents' new village, and gradually dismantle other buildings and structures in the control area.

(6) In the secondary construction control area, the building density is controlled below 20%, the green coverage rate reaches 40%, and the building height changes in gradient, that is, the building height does not exceed 0.06 times of the distance from the horse surface outside the ancient city wall.

(seven) to maintain the appearance of buildings along the street in the first-class protected streets and lanes, without changing their facade form, color and building materials, and gradually restore their traditional features.

(8) Demolition and reconstruction of uncoordinated buildings and structures in secondary protected streets and lanes will be carried out step by step to restore traditional architectural forms.

(nine) the three-level protection of traditional buildings in streets and lanes, and the new and rebuilt buildings should be coordinated with the style of the ancient city and the surrounding traditional buildings. Article 13 The traditional houses in Pingyao Ancient City should be classified and protected, and the typical houses should be filed and listed, and a protection and restoration plan should be made to keep their original appearance. Hospitals shall not be dismantled, rebuilt or newly built without authorization.

Encourage the protection, maintenance, development and utilization of traditional buildings. Fourteenth Pingyao city existing open spaces and empty spaces vacated after demolition should be gradually afforested, and no organization or individual is allowed to build new buildings and structures without authorization.

Ancient and famous trees in Pingyao ancient city are strictly forbidden to be cut down. Fifteenth relevant departments of Pingyao County People's Government shall, according to their respective responsibilities, take effective measures for fire prevention, theft prevention, earthquake prevention and flood control of Pingyao ancient city to ensure the safety of Pingyao ancient city. Chapter III Management Article 16 World Heritage Protection Signs shall be set at the entrances of Pingyao Ancient City, Zhenguo Temple and Shuanglin Temple, and key cultural relics protection units at the national, provincial and county levels shall set up key cultural relics protection signs. No unit or individual may damage the protection signs. Seventeenth key cultural relics protection units at or above the county level in Pingyao ancient city shall implement hierarchical management in accordance with the provisions of the Law on the Protection of Cultural Relics and relevant laws and regulations. Eighteenth Pingyao city existing buildings and structures renovation, demolition and all new projects to implement the grading examination and approval system. Without approval, it shall not be rebuilt, demolished or newly built. Nineteenth approved construction projects, should first carry out cultural relics investigation or exploration. Exploration costs are included in the project budget of the construction unit.
