Regulations of Fujian Province on Road Transportation

Chapter I General Provisions Article 1 In order to maintain the market order of road transport, ensure the safety of road transport, protect the legitimate rights and interests of all parties involved in road transport, and promote the healthy development of road transport, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this province. ? Article 2 These Regulations shall apply to road transport operations, road transport-related businesses and road transport management activities within the administrative region of this province. ?

The term "road transport operation" as mentioned in these Regulations refers to the activities of providing paid services for automobile transport for the public, including road passenger transport operation (hereinafter referred to as passenger transport operation) and road cargo transport operation (hereinafter referred to as freight transport operation). Road transport related businesses include road transport stations (yards), motor vehicle maintenance, motor vehicle driver training, car rental and other businesses. ? Article 3 The development of road transport shall follow the principles of overall planning, reasonable guidance, safety, convenience, energy conservation and environmental protection, and encourage road transport and related operators to implement large-scale, intensive and corporatized operations. Article 4 Local people's governments at or above the county level shall, according to the needs of local economic and social development, formulate and organize the implementation of road transport development plans in their respective administrative areas, build a modern road transport service system, and realize the reasonable connection between road transport and other modes of transport such as railways, waterways and aviation. ?

Local people's governments at or above the county level shall take measures to support rural road transport and promote the integration of urban and rural road transport. ? Article 5 The transportation departments of local people's governments at or above the county level shall be responsible for organizing and leading the management of road transportation within their respective administrative areas; Its subordinate road transport management institution is responsible for the specific implementation of road transport management. ?

Other relevant departments of the local people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in road transport management. ? Article 6 Road transport industry-related associations shall, in accordance with the articles of association of the industry association, establish and improve the industry self-discipline system, standardize and guide members' business behaviors, safeguard their legitimate rights and interests, participate in the research, formulation, publicity and implementation of road transport-related policies and industry standards, and promote the healthy development of the road transport industry. Chapter II Road Transport Operation? Article 7 Anyone who engages in road transport business shall obtain a road transport business license according to law. ?

Vehicles engaged in road transport operations shall obtain vehicle operation licenses according to law. ? Article 8 Road transport operators shall maintain and test road transport vehicles according to the prescribed mileage or time interval, ensure that road transport vehicles meet the technical standards, emission standards and fuel consumption limits stipulated by the state and this province, and establish technical files of road transport vehicles. ? Article 9 Road transport operators shall carry out emergency transport tasks such as emergency rescue, disaster relief and traffic readiness issued by local people's governments at or above the county level and their transportation departments. ?

Where a road transport operator performs an emergency transport task, the actual user of the vehicle or the local people's government at or above the county level shall bear the corresponding transport expenses in accordance with the standards prescribed by the state, and give appropriate compensation for the insufficient part. Section 1 Operation of Line Passenger Transport, Chartered Passenger Transport and Tourist Passenger Transport? Tenth road transport management institutions at or above the county level according to the local passenger transport market supply and demand situation, the main passenger flow direction and flow direction changes, can timely adjust the passenger transport structure, improve the passenger transport layout, to meet the public travel requirements. ? Eleventh in any of the following circumstances, the road transport management institution at or above the county level may allocate the right to operate passenger trains through bidding:

(a) there are more than three applicants for the same passenger line; ?

(2) The road transport management institution decides to open passenger transport lines or put new capacity on the original passenger transport lines according to factors such as the supply and demand situation of the passenger transport market, universal service and convenience for the masses; ?

(three) the existing passenger line operation period expires, the original operator does not have the qualifications to continue to operate, and it needs to be re-licensed. ? Twelfth class line passenger vehicles shall operate and stop at the permitted routes, shifts and passenger stations, get on and off at the designated passenger stations, and shall not attract passengers along the way. ? Article 13 A chartered passenger transport operator shall operate according to the agreed time, destination and route with a chartered ticket or a chartered contract, and with the chartered passenger transport sign issued by the road transport management institution at or above the county level where the vehicle registration is located, and shall not solicit passengers outside the chartered contract. ? Article 14 If the passenger transport vehicle cannot continue to run or the passengers miss or take the bus by mistake due to the fault of the line passenger transport, chartered passenger transport, tourist passenger transport operator and driver, the operator shall arrange to change the ticket or refund the ticket, and shall not charge additional fees. ?

Passenger transport operators shall ensure that the vehicle facilities are complete and effective, and keep the vehicle clean and hygienic. ? Article 15 Operators and drivers of passenger trains, chartered passenger trains and tourist passenger trains shall not commit the following acts:

(a) refusing to carry passengers without justifiable reasons; ?

(two) more than the number of passengers approved by the motor vehicle; ?

(3) handing over passengers to others for transportation or dumping; ?

(four) boarding and disembarking passengers and loading and unloading luggage in expressway; ?

(five) do not implement the government guidance price and government pricing; ?

(six) other acts that infringe upon the legitimate rights and interests of passengers.
