Regulations of China (Liaoning) Pilot Free Trade Zone

Chapter I General Provisions Article 1 In order to promote and guarantee the construction of China (Liaoning) Pilot Free Trade Zone and accelerate the revitalization and development of old industrial bases, these Regulations are formulated in accordance with relevant laws and regulations and the overall plan of China (Liaoning) Pilot Free Trade Zone approved by the State Council, combined with the actual situation of this province. Article 2 These Regulations shall apply to the China (Liaoning) Pilot Free Trade Zone (hereinafter referred to as the Pilot Free Trade Zone) approved by the State Council, including Shenyang, Dalian and Yingkou (hereinafter referred to as the Pilot Zone).

According to the needs of the construction and development of the Pilot Free Trade Zone, these Regulations shall apply to the expanded scope of the Pilot Free Trade Zone approved by the State Council. Article 3 The Pilot Free Trade Zone takes market-oriented institutional innovation as the core, and explores and summarizes replicable and popularized reform and innovation experiences as the basic requirements, so as to promote structural adjustment and industrial upgrading and enhance the overall competitiveness and opening-up level of old industrial bases. Article 4 The Pilot Free Trade Zone shall establish a new open economic system that is compatible with international investment and trade rules, create a business environment that is ruled by law, international and convenient, and gradually build a free trade park with high-end industrial agglomeration, open investment, convenient trade, perfect service, efficient and convenient supervision and standardized legal environment. Article 5 According to the strategic positioning and development goals, each district in the Pilot Free Trade Zone shall establish a linkage and cooperation mechanism of mutual promotion and staggered development. Article 6 The Pilot Free Trade Zone shall stimulate the vitality of market players, encourage citizens, legal persons and other organizations to innovate and start businesses, improve the evaluation system oriented to supporting reform and innovation, establish and improve the fault-tolerant and error-correcting mechanism for reform and innovation, and standardize the fault-tolerant implementation procedures. Chapter II Management System and Operation Mechanism Article 7 The Pilot Free Trade Zone shall, in accordance with the principles of overall coordination, graded responsibility, simplification and high efficiency, establish a management system with clear rights and responsibilities, coordinated operation, efficient management and administration according to law, promote the coordinated reform of administrative management methods and institutional mechanisms, gradually establish a unified comprehensive service supervision platform, and link up with the existing management service platforms of relevant departments to improve the efficiency of administrative management services. Article 8 The provincial people's government shall set up a deliberation and coordination body in the Pilot Free Trade Zone, study and formulate strategies to promote the construction of the Pilot Free Trade Zone, grasp the direction of innovative experiments, push relevant departments to implement various experimental tasks, and coordinate and solve major problems encountered in the development process.

There is an office under the deliberation and coordination body of the Pilot Free Trade Zone to undertake the daily work of the deliberation and coordination body of the Pilot Free Trade Zone and perform the following duties:

(1) To be responsible for implementing and guiding the implementation of the national principles and policies on the construction of the Pilot Free Trade Zone;

(2) Formulating measures to promote the work, and coordinating and promoting the implementation of various reform pilot tasks such as comprehensive reform, investment, trade, finance and talents in the Pilot Free Trade Zone;

(3) Summarize and evaluate the experience of reform and innovation formed in the Pilot Free Trade Zone, and put forward suggestions on replicating and popularizing the innovation achievements;

(4) Coordinating research and solving the difficulties and problems in the reform and innovation of the Pilot Free Trade Zone;

(five) scheduling, supervision, inspection and assessment of the progress of the local test work. Article 9 The municipal people's government where the district is located shall set up a management organization in the district, which shall be responsible for the specific implementation of the district development plan, decide on major issues of the district development, make overall plans to promote the pilot reform of the district, undertake specific affairs such as the planning, construction, operation and management of the district, and carry out the reform and innovation of the Pilot Free Trade Zone according to the actual situation. Article 10 The provincial people's government and the municipal people's government where the area is located and its relevant departments shall follow the principles of decentralization, combination of decentralization and management, and optimization of services, and authorize or entrust the relevant economic management authority to the area management organization according to the functional needs of the Pilot Free Trade Zone; Study and formulate policies and measures to promote the reform and innovation of the Pilot Free Trade Zone and the Pilot Zone, and strengthen coordination and support for major issues in the construction and development of the Pilot Free Trade Zone and the Pilot Zone. Article 11 The working offices of customs, maritime affairs, finance, taxation, public security and other departments in the Pilot Free Trade Zone shall perform relevant management duties according to law, implement relevant policies and measures in the Pilot Free Trade Zone, and support the reform and innovation in the Pilot Free Trade Zone. Article 12 The Pilot Free Trade Zone may establish a comprehensive evaluation mechanism entrusted by a third-party institution, summarize and evaluate the experience of reform and innovation in the Pilot Free Trade Zone, and replicate and promote the experience of reform and innovation in other parts of the province according to the classification evaluation procedure. Article 13 The Pilot Free Trade Zone shall establish a risk prevention, control and early warning system, improve the emergency plan and disposal mechanism for emergencies, and ensure that the risks of the reform test are reasonable and controllable. Chapter III Reform and Opening-up in the Investment Field Article 14 The Pilot Free Trade Zone shall implement the national treatment plus negative list management system for foreign investment market access. In addition to the provisions of the State Council to retain the approval of domestic projects, the establishment and change of foreign-invested projects and foreign-invested enterprises outside the negative list shall be put on record, and the district management agencies shall be responsible for handling them. Article 15 The Pilot Free Trade Zone shall improve the management and service measures of overseas investment cooperation business, and support overseas investment enterprises to obtain loans with overseas assets, shares, mining rights and other rights and interests as collateral. Article 16 The Pilot Free Trade Zone shall optimize the institutional environment for innovation and entrepreneurship, and stimulate the vitality of innovation and entrepreneurship; Establish and improve the protection mechanism for investors' rights and interests. If laws and regulations do not prohibit it, investors can innovate and carry out various investment activities in the Pilot Free Trade Zone.
