Air pollution prevention and control law stipulates what shall not exceed the standard emission of air pollutants

Chapter I General Provisions

Article 1 For the protection and improvement of the environment, prevention and control of air pollution, safeguard public health, promote the construction of ecological civilization, and promote sustainable economic and social development, the enactment of this law.

The second prevention and control of air pollution, should be to improve the quality of the atmospheric environment as the goal, adhere to the source of governance, planning first, change the mode of economic development, optimize the industrial structure and layout, adjust the energy structure.

Prevention and control of air pollution, shall strengthen the comprehensive prevention and control of coal, industry, motor vehicles and ships, dust, agriculture and other air pollution, the implementation of joint regional air pollution prevention and control, particulate matter, sulfur dioxide, nitrogen oxides, volatile organic compounds, ammonia and other atmospheric pollutants and greenhouse gases to implement synergistic control.

Article 3 The people's governments at or above the county level shall incorporate the prevention and control of air pollution into the national economic and social development planning, and increase financial investment in the prevention and control of air pollution.

Local people's governments at all levels shall be responsible for the quality of the atmospheric environment in their administrative regions, formulate plans, take measures to control or gradually reduce the emission of air pollutants, so that the quality of the atmospheric environment to meet the prescribed standards and gradually improve.

Article 4 The ecological environment department under the State Council, in conjunction with the relevant departments of the State Council, in accordance with the provisions of the State Council, the provinces, autonomous regions and municipalities directly under the Central Government of the improvement of the quality of the atmospheric environment goals, the completion of the key tasks for the prevention and control of atmospheric pollution to carry out an assessment. The results of the assessment shall be made public.

Article 5 of the people's governments at or above the county level, the ecological environment department of the people's government to implement unified supervision and management of air pollution prevention and control.

Article 6 The State encourages and supports scientific and technological research on the prevention and control of air pollution, carries out analysis of the sources of air pollution and its trends, promotes advanced and applicable air pollution prevention and control technology and equipment, promotes the transformation of scientific and technological achievements, and gives full play to the role of science and technology as a support for the prevention and control of air pollution.

Article 7 Enterprises, institutions and other producers and operators shall take effective measures to prevent and reduce air pollution, and shall be held liable for the damage caused according to law.

Citizens shall enhance awareness of atmospheric environmental protection, adopt a low-carbon, thrifty lifestyle, and consciously fulfill the obligations of atmospheric environmental protection.

Chapter II Prevention and Control of Atmospheric Pollution Standards and Deadline Planning

Article 8 The ecological and environmental authorities under the State Council or the people's governments of provinces, autonomous regions and municipalities directly under the Central Government to formulate atmospheric environmental quality standards shall be designed to safeguard public health and protection of the ecological environment for the purpose of the economic and social development in line with the scientific and reasonable.

Article 9 The department in charge of ecological environment under the state council or the people's governments of provinces, autonomous regions and municipalities directly under the central government to formulate emission standards for air pollutants shall be based on the atmospheric environment quality standards and national economic and technical conditions.

Article 10 The formulation of atmospheric environmental quality standards, air pollutant emission standards, shall organize experts to review and validate, and to seek the views of the relevant departments, industry associations, enterprises and institutions and the public and other parties.

Article 11 The competent department of ecology and environment of the people's governments at or above the provincial level shall publicize the atmospheric environmental quality standards and air pollutant emission standards on its website for free public inspection and download.

Article XII of the atmospheric environmental quality standards, the implementation of air pollutant emission standards shall be regularly assessed, based on the results of the assessment of the standards revised in due course.

Article XIII of the formulation of coal-fired, petroleum coke, biomass fuels, paints and other products containing volatile organic compounds, fireworks and boilers and other products, quality standards, shall specify the requirements of atmospheric environmental protection.

The development of fuel quality standards, should be consistent with the national air pollutant control requirements, and with the national motor vehicle and ship, non-road mobile machinery air pollutant emission standards are interlinked and synchronized implementation.

The non-road mobile machinery referred to in the preceding paragraph refers to mobile machinery fitted with engines and transportable industrial equipment.

Article 14 The people's government of a city that fails to meet the national air quality standards shall promptly prepare a plan for meeting the air quality standards, and take measures to meet the air quality standards in accordance with the State Council or the provincial people's government to provide a deadline.

The preparation of urban atmospheric environment quality standardization plan, shall seek the views of the relevant industry associations, enterprises and institutions, experts and the public.

Article XV of the urban atmospheric environment quality standardization plan shall be open to the public. Municipalities directly under the Central Government and cities with districts in the atmospheric environment quality of the plan shall be reported to the State Council department in charge of ecological environment for the record.

Article 16 The people's government of a city shall report annually to the people's congress at this level or its standing committee on the state of the environment and the completion of environmental protection objectives, it shall report on the implementation of atmospheric ambient quality deadline plan, and make it public.

Article XVII of the urban atmospheric environment quality deadline plan shall be assessed and revised in accordance with the requirements of air pollution prevention and control, and economic and technical conditions in due course.
