New regulations on rural farming land in 2022

With the approval of the local land management department, farmers have the right to manage their own production when using land, but they should be careful not to destroy the cultivated layer of the land used and the planting conditions of cultivated land permanently. The documents issued by the Ministry of Land and Resources are "National Land Classification" and "Request for Instructions on How to Deal with Farming Area". At the same time, China's land and resources department clearly requires that when land consolidation and animal husbandry production are carried out, the breeding types, reserved space and whether they meet the land use conditions should be fully considered. On October 27th, 2002111,the Ministry of Natural Resources, the Ministry of Agriculture and Rural Affairs and the State Forestry and Grassland Bureau issued the Notice on Issues Related to Strictly Controlling the Use of Cultivated Land, which adjusted the policy of planting and breeding facilities occupying permanent basic farmland, and clearly stipulated that it was strictly forbidden to newly occupy permanent basic farmland to build livestock and poultry breeding facilities, aquaculture facilities and destroy cultivated land. The Notice of the Ministry of Natural Resources and the Ministry of Agriculture and Rural Affairs on Relevant Issues Concerning the Management of Protected Agricultural Land stipulates that general cultivated land can be used for protected agriculture, and there is no need to implement a balance between occupation and compensation. The new policy stipulates that the construction of agricultural facilities such as new livestock and poultry breeding facilities, aquaculture facilities and planting facilities that destroy the arable layer should be strictly controlled, and general cultivated land should be used. If it is really necessary to use it, it shall be approved and meet the relevant standards.

According to the notice of "three ministries and one bureau", the status quo of growing food crops in permanent basic farmland remains unchanged. Non-food crops such as cotton, oilseeds, sugar and vegetables can remain unchanged. Generally, cultivated land is mainly used to produce agricultural products and forage such as grain, cotton, oil, sugar and vegetables.
