Notice of the people's Government of Anhui Province on printing and distributing the measures for the supervision and administration of wood and bamboo transportation inspection in Anhui Province

Article 1 In order to protect forest resources and maintain the normal transportation order of wood and bamboo, these Measures are formulated in accordance with the Forest Law of People's Republic of China (PRC) and its implementing rules and the Measures for the Implementation of Forest Law in Anhui Province. Article 2 Zhu Mu as mentioned in these Measures refers to:

(1) Wood (including logs and logs), bamboo (including Phyllostachys pubescens, Phyllostachys pubescens, Phyllostachys pubescens and Phyllostachys pubescens), semi-finished products and bulk products;

(2) Wood-based panels (including plywood, fiberboard, particleboard, wood wool board and bamboo veneer) and papermaking raw materials;

(three) commercial fuelwood, Chinese fir and pine branches, lining materials, mineral baskets. Article 3 Whoever transports timber and bamboo within the territory of our province must abide by these measures. If other provinces transport wood and bamboo in our province, they shall handle the relevant documents according to the provisions of the province of departure; Illegal transportation shall be handled according to the Measures for Inspection and Supervision of Timber Transportation promulgated by the Ministry of Forestry and these Measures. Article 4 The transportation management of timber and bamboo shall be the responsibility of the competent forestry authorities at all levels. Wood and bamboo inspection stations approved for establishment shall be responsible for the transportation inspection of wood and bamboo in accordance with the provisions of laws, regulations and rules. Without the approval of the provincial people's government, all localities shall not set up their own wooden and bamboo checkpoints.

Public security, transportation, railways and other departments should cooperate with the competent forestry authorities and the wooden and bamboo checkpoints to do a good job in the management of wooden and bamboo transportation. Fifth transportation of wood and bamboo must hold the "Anhui Wood and Bamboo and its Products Transportation Certificate" or "Provincial Wood Transportation Certificate" uniformly printed by the Provincial Forestry Department. The transportation certificate of timber and bamboo products in Anhui Province is issued by the competent forestry authorities at or above the county level, and the transportation certificate of timber out of Anhui Province is issued by the provincial forestry department and the municipal forestry authorities.

The transportation of precious and rare terrestrial wild animals and plants and their products and rosin products shall be managed by authorized wooden and bamboo inspection stations. The specific measures shall be formulated separately by the provincial forestry authorities. Article 6 The following documents, receipts or certificates shall be submitted when applying for the transportation certificate of wood and bamboo:

(1) State-owned forestry enterprises and institutions hold commercial timber cutting licenses and inspection and measurement lists; Cutting license issued by the special legal organs of railways, military units, factories, mines, farms and other departments.

(two) the purchase of wood and bamboo from state-owned forestry enterprises and institutions shall be inspected by the purchase invoice and the measurement list; Special timber purchased directly into the mountains upon approval must be inspected with the approval documents, purchase invoices and measurement lists of the competent forestry authorities at or above the prefecture level.

(three) the scattered wood produced by the rural residents in the forest area, in front of the house and behind the house, with the certificate of the local township people's government.

(four) the taxes and fees, afforestation funds and change funds that should be paid according to law shall hold relevant bills. The transportation of wood and bamboo that should be quarantined shall also hold a quarantine certificate issued by the forest plant quarantine department at or above the county level. Seventh meet one of the following conditions, exempt from timber transport documents:

(a) transport timber by the national unified allocation notice;

(2) Transportation of plywood, fiberboard and particleboard imported from abroad;

(3) carry less than 3 small wooden and bamboo products (such as wooden cases, wooden chairs, pots, barrels or bamboo chairs, bamboo beds, clothes hangers, etc.). );

(four) scattered trees produced by rural residents in non-forest areas in private plots, in front of houses and behind houses (except those out of the province). Eighth the issuance of wood and bamboo transport documents, the implementation of a car (ship) a permit system. If the formalities are complete, they should be divided immediately. When issuing transport documents, the commercial timber cutting license and related documents shall be cancelled at the same time. For the same place of departure, the same time of departure, the same head of household and the same means of transport, a transport certificate may be issued. Ninth wood and bamboo transport documents shall not be extended. If it cannot be shipped out on schedule due to special circumstances, it shall be reissued by the original issuing unit after verification by the relevant units. Tenth transportation of wood and bamboo must be accompanied by the goods, and there are documents. If the cargo certificate is consistent, the wooden and bamboo inspection station shall immediately put bamboo and affix the seal of inspection. If the mode of transportation is changed or transported again, it shall be reported to the competent forestry department at or above the county level where the change is located, and the transportation certificate shall be replaced. If timber is transported without a timber and bamboo transport certificate, the carrier shall not carry it. Eleventh one of the following acts, shall be punished by the Zhu Mu checkpoint in accordance with the following provisions:

(1) If timber and bamboo are transported without a transport license, all the timber transported shall be confiscated; Impose a fine of 0/to 2 times the freight of wood and bamboo on the carrier.

(2) If the variety, quantity and specifications of the transported wood and bamboo are totally or partially inconsistent with those recorded in the transport documents, the transported wood and bamboo shall be confiscated or partially confiscated.

(three) the use of expired wooden and bamboo transport documents to transport timber shall be punished according to the provisions of Article 8 of the Measures for the Inspection and Supervision of Timber Transport issued by the Ministry of Forestry.

(4) Whoever uses forged, altered or resold transport documents of wood and bamboo to transport wood and bamboo shall have their transport documents confiscated, and all the transported timber shall be confiscated, and the owner shall be fined 0/0% to 50% of the price of wood and bamboo. Twelfth in violation of the provisions of the transport of wood and bamboo and can not provide proof of legal origin, the competent forestry authorities or wood and bamboo checkpoints can be detained in advance. To detain illegally transported bamboo and bamboo, a detention certificate shall be issued, and the consignor or carrier shall be notified in writing to accept the treatment within the prescribed time limit (three days in counties and cities, five days across counties and cities in the province and ten days outside the province). If it is not accepted within the time limit, the illegally transported bamboo and bamboo will be confiscated.

During the detention period, the storage fee and loading and unloading fee of the wood and bamboo shall be borne by the owner. The losses caused by the fault of the staff at Zhu Mu checkpoint shall be borne by Zhu Mu checkpoint.
