Regulations of Guizhou Province on the Administration of Road Transportation

Chapter I General Provisions Article 1 In order to strengthen the management of road transport, maintain the order of road transport, establish a unified, developed, competitive and orderly road transport market, and safeguard the legitimate rights and interests of operators and their clients, these Regulations are formulated in accordance with the relevant laws and regulations of the state and the actual situation of our province. Article 2 The term "road transport" as mentioned in these Regulations refers to passenger transport, cargo transport and related transport auxiliary industries engaged in highways, urban streets, rural roads, public squares and public parking lots. Article 3 All units and individuals engaged in commercial road transport and their clients, supervisors and operators within the administrative area of this province shall abide by these regulations. Article 4 Road transport shall adhere to the principles of developing various economic sectors, unified management, active support, ensuring safety, improving efficiency and quality service, protecting legitimate business operations and opposing unfair competition. Fifth people's governments at or above the county level shall, according to the needs of national economic and social development, formulate road transport development plans, incorporate them into the national economic and social development plans at the corresponding level and organize their implementation.

Encourage and support investment in road transport. Chapter II Supervision and Management Article 6 The traffic administrative department of the people's government at or above the county level is the competent department of road transport within its administrative area, and the road transport management institution established by it specifically exercises the functions of road transport supervision and management, and its main responsibilities are:

(a) according to the provisions of the examination and approval of road transport operators business qualifications, business projects and scope;

(two) the overall planning of road transport capacity, vehicle adjustment and the configuration and construction of transport service facilities;

(three) according to the authority to produce, distribute and verify road transport business certificates, documents and signs;

(four) to supervise and inspect the business behavior, technical status and maintenance quality of road transport operators in accordance with the provisions;

(5) Failing to collect transportation fees as required;

(six) the implementation of automobile driving training industry management;

(seven) to accept complaints from road transport operators and their clients, and to mediate disputes in business activities;

(eight) other duties as prescribed by laws and regulations. Seventh road transport management personnel can according to the needs of the work to business units, job sites or checkpoints approved by the provincial people's government to perform inspection tasks.

When performing inspection tasks, road transport management personnel must dress neatly, wear signs, hold administrative law enforcement certificates issued by the traffic administrative department of the provincial people's government, act impartially and enforce the law in a civilized manner. Eighth road transport management institutions shall announce the procedures and results, establish a reporting system, and accept social supervision.

The road transport management institution shall handle the complaints of the parties within 30 days from the date of receiving the complaints. Ninth passenger and freight station (field) construction should be included in the urban construction planning, centralized management by the local traffic administrative department. Without the consent of the traffic administrative department, the nature of its use shall not be changed. Tenth public security, industry and commerce, taxation, price, construction, agricultural machinery, labor, technical supervision and other departments in accordance with their respective responsibilities, in accordance with the provisions of this Ordinance, with the traffic administrative departments, * * * to do a good job in road transport supervision and management. Chapter III Opening, Closure and Closure Article 11 All units and individuals who have the opening technology, economic conditions and the ability to bear civil liability independently as stipulated by the state may apply for engaging in the commercial passenger and freight transport industry and transportation auxiliary industry. Twelfth units and individuals that apply for engaging in commercial road transport shall submit a written application and relevant technical and economic conditions to the local road transport management institution at or above the county level.

The road transport management institution shall, in accordance with the management authority, make an audit decision within 30 days from the date of acceptance. Those who meet the business conditions shall be issued a business license, and the industrial and commercial and tax procedures shall be handled with the applicant's certificate; If it does not meet the business conditions, it shall notify the applicant in writing.

Those who temporarily participate in commercial transportation shall go through the temporary operation procedures at the local road transport management institution. Thirteenth road transport operators to suspend business, merger, division, relocation and change the name, business items and scope, should go through the relevant formalities at the original approved road transport management authority and the industrial and commercial and tax departments. Chapter IV Passenger and Freight Transport Article 14 Road passenger transport (hereinafter referred to as passenger transport) includes bus passenger transport, tourist passenger transport, chartered passenger transport, taxi passenger transport and bus passenger transport.

Road freight transport (hereinafter referred to as freight transport) includes general freight transport, LTL freight transport, dangerous cargo transport, container cargo transport, large cargo transport and fresh cargo transport. Fifteenth operators engaged in commercial passenger transport and cargo transport must strictly implement the relevant provisions of the state, ensure the safety of passengers and goods, handle insurance according to regulations, and provide quality services. Article 16 Passenger and freight operators shall use vehicles in accordance with state regulations and technical specifications, and carry out regular maintenance and inspection of vehicles to keep them in good condition, neat and complete facilities and meet the technical requirements of vehicles.

It is forbidden to use scrapped vehicles and vehicles with unqualified technical performance to operate passenger and freight transportation. Seventeenth drivers engaged in commercial passenger transport and cargo transport must have the corresponding business knowledge and skills, and hold valid certificates issued by the competent department of public security and transportation of the provincial people's government.

Drivers engaged in commercial passenger transport must also comply with the provisions of Article 24 of the Regulations on the Administration of Motor Vehicle Traffic Safety in Guizhou Province.
