Regulations of the Ministry of Public Security on crossbow management

Crossbows belong to the control instruments stipulated by the state. Carrying crossbows at will may result in administrative penalties such as warning, fine and detention within five days. Those who illegally carry crossbows and other state-regulated instruments into public places or public transport will be severely punished, detained for more than five days and less than ten days, and may also be fined up to 500 yuan.

A mechanical bow and arrow equipment belongs to the scope of control.

According to the official information on the websites of People's Republic of China (PRC) and the Ministry of Public Security, as early as 1999, the Ministry of Public Security and the State Administration for Industry and Commerce jointly issued the Notice on Strengthening the Management of Crossbows (No.Gongzhi [1999] 1646), explicitly requiring public security organs at all levels to include crossbows in the scope of public security management and earnestly strengthen relevant management.

According to relevant laws and regulations, mechanical bow and arrow equipment, such as crossbows (also known as mechanical crossbows and crossbows), is a kind of equipment with strong lethality, which has some functions and characteristics of guns and controlled knives. If it is not strictly controlled and managed, it will be easily used by criminals and endanger public safety, which belongs to the goods strictly controlled by the state. The manufacture, sale, import, transportation and use of crossbows or commercial shooting ranges to set up crossbow shooting projects must be approved by the public security departments and bureaus of provinces, autonomous regions and municipalities directly under the Central Government, and the administrative department for industry and commerce shall register with the approval documents of the public security departments and bureaus.

2. What are the constitutive elements of illegal possession of controlled knives?

To commit this crime, two conditions must be met:

(1) The perpetrator must illegally carry the above items;

(2) The actor must carry the above items into public places or public transport;

Only if the circumstances are serious can this crime be constituted. If the circumstances are obviously minor, the amount carried is small, and there are no harmful consequences, it should not be considered as constituting this crime. This crime belongs to behavioral crime. As long as the perpetrator illegally carries guns, ammunition, controlled knives and dangerous goods into public places or public transport, if the circumstances are serious, this crime can be constituted without causing actual harmful consequences. If explosion, fire and other consequences occur, other crimes, such as explosion, negligent explosion, arson, fire loss, destruction of vehicles, etc., should be punished according to their subjective contents, and illegal carrying will no longer constitute their own crimes.

This crime harms unspecified people and things, and the objects of infringement are public safety and measures for the management of guns, ammunition, controlled knives and dangerous goods.

Legal basis: Article 130 of the Criminal Law illegally carries guns, ammunition, controlled knives or explosive, flammable, radioactive, toxic or corrosive articles into public places or public transport, endangering public safety. If the circumstances are serious, they shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance.
