Measures of Dongguan Municipality on the Administration of Motor Vehicle Parking Facilities

Chapter I General Provisions Article 1 In order to strengthen the planning, construction, use and management of motor vehicle parking facilities, standardize the parking order of motor vehicles and promote the sustainable development of urban traffic, in accordance with the Road Traffic Safety Law of the People's Republic of China, the Urban and Rural Planning Law of People's Republic of China (PRC), the Land Administration Law of the People's Republic of China, the Implementation Regulations of the Road Traffic Safety Law of the People's Republic of China and other relevant laws and regulations. Article 2 These Measures shall apply to the planning, construction, use and management of parking facilities and the management of motor vehicle parking within the administrative area of this Municipality.

The term "parking facilities" as mentioned in these Measures refers to places where motor vehicles are parked, including public parking lots, special parking lots, temporary parking lots and road parking spaces. Except for special parking lots for buses and trams, road passenger vehicles, road freight vehicles and motorcycles. Article 3 The management of motor vehicle parking facilities in this Municipality shall follow the basic principles of scientific planning, government guidance, market regulation, social governance and construction management, make overall planning of parking facilities, effectively solve the basic parking demand, rationally allocate parking resources for trips, standardize parking order, improve the quality of traffic trips, improve the utilization efficiency of parking resources, guide the public to travel green, and strictly enforce parking laws. Article 4 The Municipal People's Government shall establish a joint meeting system to co-ordinate the management of motor vehicle parking facilities in the whole city and study and solve major problems in the management of motor vehicle parking facilities.

The municipal transportation management department is responsible for formulating policies, standards and norms related to the management of motor vehicle parking facilities, organizing the preparation of special planning for parking facilities in this Municipality, coordinating and guiding the standardization and information management of parking facilities in this Municipality, establishing a unified parking information management system in this Municipality, and doing a good job in the supervision and management of road parking spaces in this Municipality.

The municipal development and reform management department is responsible for formulating the policies and standards for charging motor vehicle parking services in this Municipality, fulfilling the filing and approval of parking facilities investment projects in accordance with the law, exploring the use of special bonds, government and social capital cooperation models and other financing methods to encourage and support the construction of parking facilities.

The municipal public security organ is responsible for the city's road parking order and traffic safety management, as well as the safety technical prevention and supervision of parking facilities, cooperate with the transportation management department to guide the setting of road parking spaces in this city, and cooperate with the transportation management department and the Town People's Government (street offices) to do a good job in the overall planning and guidance of standardized parking management in villages (communities).

The municipal natural resources management department is responsible for the planning and management of parking facilities construction land in this city, and improves and implements the incentive policies in the aspects of parking facilities configuration standards, parking facilities planning approval and land use.

The municipal housing and urban-rural construction management department is responsible for the supervision and management of the construction activities of the city's matching parking facilities and building three-dimensional parking facilities, and is responsible for the fire protection design review, acceptance, filing and spot check of construction projects such as building parking facilities and equipment three-dimensional parking facilities, and urges property service enterprises to do a good job in parking management within the property management area in accordance with the requirements of relevant administrative departments.

The municipal market supervision and management department is responsible for the supervision and inspection of parking service enterprise registration and parking service charging behavior, accepting the application for construction notification and use registration of mechanical parking equipment and other special equipment according to law, and supervising the use safety of special equipment.

The comprehensive law enforcement department of urban management is responsible for the supervision and management of all kinds of parking facilities involved in illegal construction, the establishment of a negative list management system for parking order in the red line area of building concession, and the supervision and management of parking behaviors that affect the city appearance and environment outside the illegal occupation of roads.

City civil air defense, finance, agriculture and rural areas, emergency management, state-owned assets supervision and management, government service data management, rail transit, taxation and other relevant departments and fire rescue agencies, in accordance with their respective responsibilities, do a good job in the management of motor vehicle parking facilities in this city. Article 5 The Town People's Government (street office) shall establish a comprehensive coordination mechanism for the management of parking facilities, undertake the specific work assigned by the joint meeting of the city, coordinate the implementation of the planning, construction and management of motor vehicle parking facilities within its jurisdiction, and guide the village collective economic organizations and owners' committees within its jurisdiction to carry out independent parking management and services. Article 6 The charges for motor vehicle parking services in this Municipality shall be subject to market adjustment price, government guidance price and government pricing respectively.

The municipal development and reform management department shall, jointly with the municipal transportation management department, formulate differentiated charging standards for parking facilities that are subject to government-guided pricing and government pricing management according to the city's traffic operation and traffic management policies, and evaluate the differentiated charging standards at least once every three years 1 time. The evaluation results should be used as the basis for the municipal development and reform management department to adjust the charging standards.

The municipal development and reform administration department shall fully solicit public opinions through newspapers, radio, television, government websites or new government media when formulating charging standards, and the time for public comments shall not be less than 30 days. Before the implementation of the policy, the collected information will be announced to the public on the government website or new government media.

The income of public parking facilities fully invested by the government shall be managed in accordance with the relevant management regulations of the financial department. Seventh city transportation management department shall establish a unified parking information management system in the city, formulate parking facilities information networking management regulations and related standards, and build a parking facilities networking management system.

The municipal transportation management department shall regularly organize the general survey of public parking resources in the city, establish the basic database of parking facilities, and update the data in real time, and the relevant units and individuals shall cooperate; Implement dynamic management of collected parking information, build a parking information sharing mechanism, and improve the utilization rate of parking facilities.

The Town People's Government (street offices) shall organize and urge the managers of parking facilities within their jurisdiction to upload relevant data of parking facilities in accordance with relevant regulations and standards.
