The difference between electronic labor contract and paper labor contract

Legal analysis: Although there are differences between electronic labor contract and traditional labor contract, they are both legally effective contracts in essence. Because the electronic labor contract is still a new thing, the offer acceptance between the parties to the electronic labor contract and the validity of the contract have become a difficult point in legislation. However, whether it is a traditional labor contract or an electronic labor contract, as long as both parties reach an agreement and sign it, it means that both parties recognize and are willing to abide by the contract. Therefore, as long as the contents of the contract do not violate the national laws, the contract will take effect immediately at the moment of signing and have the same legal effect.

Legal basis: Article 26 of the Labor Contract Law of People's Republic of China (PRC), the following labor contracts are invalid or partially invalid: (1) Causing the other party to conclude or change a labor contract against its true meaning by means of fraud or coercion or taking advantage of the danger of others; (2) The employer exempts itself from legal liability and excludes the rights of workers; (3) Violating the mandatory provisions of laws and administrative regulations. Any dispute over the invalidity or partial invalidity of a labor contract shall be confirmed by the labor dispute arbitration institution or the people's court.
