Regulations on the Protection and Utilization of Traditional Villages in Taizhou

Article 1 In order to strengthen the protection and utilization of traditional villages, inheritance of excellent historical and cultural heritage, according to the "Chinese people's *** and the State Urban and Rural Planning Law" "Chinese people's *** and the State Cultural Relics Protection Law" and relevant laws and regulations, combined with the actuality of the city, the formulation of these regulations. Article 2 These regulations shall apply to the protection and utilization of traditional villages within the administrative area of the city. Traditional villages are recognized as historical and cultural villages according to law, the provisions of the relevant laws and regulations of historical and cultural villages shall apply.

The traditional villages referred to in these regulations, refers to the formation of earlier, with tangible and intangible forms of cultural heritage, has a high historical, cultural, scientific, artistic, social and economic value, can reflect the traditional style and regional cultural characteristics of the more complete, included in the list of traditional villages at the national, provincial and municipal levels.

The specific measures for the declaration and recognition of municipal traditional villages shall be formulated by the Municipal People's Government. Article 3 The protection and utilization of traditional villages should follow the protection of priority, rational use, living heritage, pay attention to people's livelihood, according to local conditions, classified to promote, government-led, villagers independent principle. Article 4 the city, county (city, district) people's government shall strengthen the protection and utilization of traditional villages in the administrative region of the leadership, the protection and utilization of traditional villages into the national economic and social development planning, improve the protection and utilization of traditional villages coordination mechanism, to solve the protection and utilization of traditional villages in the major problems. Article 5 the city, county (city, district) housing and urban-rural construction department is responsible for the protection and utilization of traditional villages in the administrative region of the guidance, supervision and management.

The competent department of culture (cultural relics) of the city, county (city and district) is responsible for the guidance, supervision and management of the protection of cultural relics and intangible cultural heritage in the traditional villages in the administrative area.

Other relevant departments in accordance with their respective responsibilities to do a good job in the protection and utilization of traditional villages. Article 6 The people's government of the township (town) where the traditional village is located, the street office shall strengthen the daily management of traditional villages, and perform the following duties:

(1) organize the preparation of traditional village protection and development planning;

(2) formulate the implementation of the protection and utilization of traditional villages and organize the implementation of the program;

(3) guide and supervise the villagers' committees to do a good job in the traditional village protection and utilization;

(4) other duties prescribed by laws and regulations. Article 7 The villagers' committees where traditional villages are located shall perform the following duties:

(1) to participate in the preparation and implementation of development plans for the protection of traditional villages;

(2) to publicize the relevant laws and regulations on the protection of traditional villages, and to guide and supervise the villagers in complying with the requirements for the protection of traditional villages;

(3) to collect and protect the components of traditional buildings that have collapsed or scattered, and to make recommendations for the protection of traditional buildings at risk of destruction. Register traditional buildings in danger of destruction, and promptly report to the township (town) people's government and street offices;

(4) Discourage and stop behaviors that violate the regulations on the protection and utilization of traditional villages, and promptly report to the township (town) people's government and street offices;

(5) Guide villagers to carry out folklore culture and business activities in traditional villages;

(6) Do a good job in protecting traditional villages; and >(F) to do a good job in the protection and utilization of traditional villages and other work.

Traditional buildings referred to in these regulations, refers to the use of traditional materials, traditional forms, the use of traditional crafts, built a long time ago and has a certain historical, artistic, scientific, social and cultural value, basically reflecting the history of urban and rural development and local characteristics, has not been declared a cultural relics protection units, cultural relics protection sites or historical buildings, listed in the list of traditional building protection of buildings (structures). Article 8 The people's governments of cities and counties (cities and districts) shall, according to the protection and development planning of traditional villages, arrange funds in the financial budget at this level to be used specifically for the preparation and implementation of the protection and development planning of traditional villages, the day-to-day management of traditional villages, the training of traditional architectural craftsmen, and work incentives for the protection and utilization of such work. Article 9 The protection and utilization of traditional villages should mobilize villagers to participate in the enthusiasm, to protect the legitimate rights and interests of villagers. Article X traditional villages located in the township (town) people's government, street offices should be published in the traditional village list within one year after the organization to complete the preparation of the traditional village protection and development planning, and with the land spatial planning and village planning.

Traditional village protection and development planning shall include:

(1) assessment of the traditional resource status of the village;

(2) principles of protection, protection content and scope of protection;

(3) delineation of the core protection area, the construction control zone and its protection requirements;

(4) protection of the village's traditional pattern, immovable cultural relics, historical and environmental elements and traditional features. environment elements and traditional landscape protection requirements and measures;

(vi) infrastructure upgrading and reconstruction, enhancement of human habitat and fire safety measures;

(ix) protection and development planning phased implementation program and recent protection projects.

Traditional villages shall prepare village design, village design can be incorporated into the traditional village protection and development planning. Article XI of traditional village protection and development planning for approval by the city, county (city) people's government. Protection and development planning for approval shall be discussed and agreed by the villagers' meeting or meeting of villagers' representatives, and by the township (town) people's government, the street office of the protection and development of the draft plan to be announced, the announcement period of not less than thirty days. After the approval of the protection and development plan, the township (town) people's government, the street office shall announce to the society within twenty days from the date of approval.
