Regulations of Fuzhou Municipality on the Protection of Historical and Cultural Cities

Article 1 In order to strengthen the protection and management of Fuzhou's famous historical and cultural city, carry forward the excellent local history and culture, and promote the construction of socialist material civilization and spiritual civilization, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics, the Law of People's Republic of China (PRC) on Urban Planning and other relevant laws and regulations. Article 2 The following historical physical remains, traditional landscape features and local culture and art of Fuzhou's historical and cultural city are protected by these regulations:

(1) Cultural relics, historic sites, celebrities' former residences, celebrities' tombs, typical ancient buildings, memorial buildings and religious buildings with historical, artistic and scientific values;

(2) Landscape characteristics and spatial pattern of the ancient city composed of "three mountains and two towers" (Yushan, Wushan, Pingshan, Baita and Wuta);

(3) Traditional lane patterns such as "three lanes and seven lanes" (Yijinfang, Wenrufang, Guanglufang and Yangqiao Lane, Langguan Lane, Taxiang, Huang Xiang, Anmin Lane, Gongxiang and Jipi Lane) and Zhuzifang and typical Ming and Qing dwellings;

(four) ancient rivers and lakes, hot springs, ancient banyan trees and other ancient and famous trees;

(5) historical and cultural protection zones;

(6) bodiless lacquerware, Shoushan stone carving, cork painting, horn comb and other local traditional handicrafts, local traditional dramas and folk arts such as Fujian opera, storytelling, letters singing and Fan Shi music, local traditional food culture such as Fujian cuisine, and local characteristic culture such as healthy folk customs. Article 3 The protection and management of Fuzhou's famous historical and cultural city shall follow the principle of combining maintenance with construction and development, and combining professional management with public participation.

The protection of Fuzhou historical and cultural city should be carried out according to the overall planning of Fuzhou city and the protection planning of Fuzhou historical and cultural city.

People's governments at all levels should attach importance to the protection of Fuzhou's famous historical and cultural city, strengthen publicity and enhance the awareness of national protection. Article 4 Fuzhou Cultural Relics Bureau and Fuzhou Planning Bureau are responsible for the daily management of the protection of Fuzhou's famous historical and cultural city.

Construction, culture, city appearance, land, health, environmental protection, real estate, gardens, religion, radio and television, public security, industry and commerce, finance and other administrative departments at all levels shall, according to their respective functions and duties, protect Fuzhou's historical and cultural city.

All units and individuals must abide by these regulations and have the right to dissuade and accuse those who violate these regulations. Article 5 The historical physical remains announced as cultural relics protection units shall be managed in accordance with the laws and regulations on cultural relics protection.

It has not been announced as a cultural relics protection unit or other historical relics with protection value, such as historical sites, typical ancient buildings and memorial buildings. The municipal and district administrative departments of cultural relics and planning shall delimit the necessary scope of protection, report to the people's government at the same level for approval, make signs, establish records and files, and set up protection institutions or special personnel to be responsible for management. Article 6 Where the historical physical remains listed in the second paragraph of Article 5 are built within the scope of necessary protection, the site selection of the project shall be approved by the Municipal Bureau of Cultural Relics; If relocation or demolition is really necessary, it shall be approved by the Municipal Cultural Relics Administration and the Municipal Urban Planning Bureau and reported to the Municipal People's Government for approval. Article 7 Before carrying out engineering construction in places where there may be underground cultural relics, cultural relics investigation, exploration or archaeological excavation shall be carried out first, and the required expenses shall be included in the project budget by the construction unit according to law. If cultural relics are found during construction, the construction unit shall take measures to protect the site and report to the local cultural relics administration department immediately. Article 8 When citizens and non-cultural relics units use clearly protected cultural relics protection units, typical Ming and Qing dwellings and memorial buildings, the users shall sign a protection and use responsibility letter with the Municipal Bureau of Cultural Relics or the local cultural relics administrative department, be responsible for the maintenance, maintenance and safety of the building, and accept the inspection, supervision and guidance of the cultural relics administrative department. Article 9 The construction in the ancient city of Fuzhou must meet the requirements of protecting the features of the ancient city, and no new facilities that pollute the environment may be built. Facilities that seriously pollute the environment must be treated, converted into production or relocated within a time limit. Article 10 The protective construction of "three lanes and seven lanes" should maintain its traditional spatial pattern and lane structure. Important historical sites such as cultural relics protection units and typical Ming and Qing dwellings, celebrities' former residences and ancient gardens explicitly protected shall be repaired and restored in accordance with the protective construction plan, and the repair and restoration work shall be carried out simultaneously with the construction. Eleventh Zhuzifang and typical Ming and Qing dwellings, celebrities' former residences, ancient gardens, ancient bridges and other cultural relics protection units and other important historical sites should be effectively protected.

Except for maintenance and expansion due to fire safety and traffic reasons, Zhuzifang's block roads should maintain the traditional structure. In addition to the protection of inland river facilities, no new buildings, structures and other facilities shall be built in the antai river River and adjacent to the existing river bank coastline. The renovation of scenic spots and revetments along the river should maintain the traditional landscape style. Article 12 is to delimit the landscape intervisibility corridor between mountain peaks, Wushan and Pingshan. The width of the landscape corridor and the height of new buildings in the landscape corridor and the enclosed area shall be controlled in accordance with the overall urban planning of Fuzhou approved by the State Council and the protection planning of Fuzhou's historical and cultural city. Thirteenth important historical sites, such as cultural relics, celebrities' former residences, etc. in the node area of the central axis of the historical development of Fuzhou ancient city with Bayi Road and Gu Ping Road as the main axis, should be effectively protected. Fourteenth ancient rivers and lakes should be treated in accordance with the comprehensive improvement plan to restore the landscape characteristics.

In addition to the implementation of inland river regulation planning projects, no unit or individual may fill up, occupy or change the direction of the ancient river.

Coastal engineering construction of ancient rivers, including the construction of inland river regulation projects, shall protect river bridges, trees, historical sites and stone revetments with preservation value, maintain traditional landscape features, and shall not be damaged without authorization.
