Interim Measures of Qingdao Municipality on the Administration of Special Overrun Goods in Highway Transportation

Article 1 These Measures are formulated in order to strengthen the management of road transport of special out-of-gauge goods and ensure transportation safety. Article 2 These Measures shall apply to the owners of special out-of-gauge goods transported by road within the administrative area of this Municipality. Article 3 The Municipal Economic Commission is in charge of the transportation of special out-of-gauge goods in the whole city, and is responsible for the arbitration of transportation disputes. Article 4 Goods meeting one of the following conditions are special out-of-gauge goods:

(a) after the goods are loaded, the height of the top from the ground reaches more than 5.5 meters;

(two) the length of the goods reached more than twenty-five meters;

(three) the width of the goods reaches more than two-thirds of the narrowest part of the motor vehicle;

(four) after loading, the total weight of the goods exceeds the design standard of the bridge (20 tons of cars, suspension 100 tons);

(5) Other goods that need to be escorted. Article 5 A unit entrusted to transport special out-of-gauge goods (hereinafter referred to as the consignment unit) shall submit a written application to the Municipal Economic Commission through its competent department. The application shall include detailed transportation plan, technical data and other relevant information that needs to be explained.

The unit undertaking transportation (hereinafter referred to as the carrier) shall assist the consigning unit in preparing the transportation plan. Article 6 According to the consignor's application, the Municipal Economic Commission shall make the following preparations before transportation:

(1) Organizing the departments of transportation, public security, posts and telecommunications, electric power, railways, municipal administration, public utilities and highway transportation (hereinafter referred to as relevant departments) to survey and select transportation routes;

(2) Organizing relevant departments to remove traffic obstacles and transform traffic facilities;

(3) Organizing relevant departments to examine the technical strength and vehicles of the carrier;

(four) to establish a temporary transportation headquarters and organize the formulation of transportation plans;

(5) Organize simulated transportation when necessary. Seventh transportation plans must be approved by the Municipal Economic Commission before implementation. The temporary transportation headquarters shall determine the specific responsibilities of the carrier and relevant departments according to the approved transportation plan. Eighth temporary traffic command is mainly responsible for ensuring traffic safety and timely handling of accidents. Article 9 After the transportation plan is approved, the carrier shall be responsible for handling the formalities of quasi-transportation with the relevant departments. Tenth removal of obstacles, reconstruction of facilities, working hours, materials and other necessary transportation costs, borne by the entrusting unit. The above expenses shall be budgeted by all relevant units, and shall be settled by both parties after the shipper agrees, and used by all relevant units.

The necessary expenses for organizing and coordinating the work before and during transportation shall be provided by the shipper. Eleventh according to the transportation requirements, it is really necessary to remove obstacles or transform facilities, the relevant units must be completed on time. If it is not completed on time, it shall bear the corresponding expenses and other losses caused thereby. Article 12 If it is necessary to cut off traffic after the date of transportation is determined, the shipper shall report to the public security department for approval and make an announcement in advance. Thirteenth fixed transportation routes or facilities are funded by the shipper, and the relevant units shall not lower the standard without authorization when maintaining or updating. Temporary transformation of transport routes and facilities, approved by the Municipal Economic Commission can restore the original standard. If the standard is lowered without authorization, it shall be repaired according to the original standard and bear the expenses arising therefrom. Fourteenth units that transport special out-of-gauge goods without authorization in violation of these measures shall, in addition to being punished according to relevant regulations, impose a fine of less than 10% on the consignment unit and the carrier unit respectively. In case of power failure, communication interruption, damage to municipal facilities and other accidents, the carrier shall not only compensate all economic losses, but also hold the relevant personnel responsible according to the circumstances.
