Measures of Jiangsu Province for the Administration of Handling Industry

Chapter I General Provisions Article 1 In order to strengthen the management of the handling industry and protect the legitimate rights and interests of the consignors, these measures are formulated in accordance with the relevant laws and regulations of the state and in combination with the actual situation of our province. Article 2 All units and individuals engaged in handling, drifting, lifting, warehousing, tally and non-motor vehicle cargo transportation within the territory of our province must abide by these measures. Article 3 The term "handling activities" as mentioned in these Measures refers to business handling activities that provide services to the society and have various cost settlement methods (including handling fees included in the settlement of products, commodities, engineering fees or freight). Article 4 The transportation departments at all levels are the administrative organs of the handling industry and are responsible for supervising the implementation of these Measures. Chapter II Management of Business Opening Article 5 Units engaged in commercial handling and loading must meet the following conditions:

(a) there is a relatively stable supply of goods, which is needed by the society;

(two) there are tools, equipment and places suitable for the operation, and the lifting machinery should have a technical inspection certificate;

(3) Having an organization, place, business articles of association for operation and management, and management systems for safety, quality and distribution;

(4) Having its own liquidity suitable for its business activities, and having the ability to compensate for business accidents;

(five) there are relatively fixed employees, and the employees should have the certificates approved by the people's governments of townships and towns (street offices).

Individuals engaged in the handling industry should meet the above three conditions (1), (2) and (4) and pay a certain deposit. Article 6 Units and individuals applying for commercial handling and loading shall apply to the administrative department for industry and commerce for a business license after being examined and approved by the transportation department at or above the county (city, district).

Motor-driven, human-powered and animal-drawn transport vehicles and lifting equipment (vehicles) engaged in handling and loading must report to the transportation departments at or above the county (city, district) level in accordance with the provisions of relevant state laws and regulations, and go through the relevant business license procedures. Seventh units and individuals engaged in handling business, need to change the business items and scope of work, should report to the original examination and approval authority, and go through the formalities for change; Need to stop (stop) business, should report to the original examination and approval authority 30 days in advance, go through the cancellation procedures, and pay all kinds of licenses issued by the resumption, before stopping (stopping) business. Chapter III Operation and Management Article 8 Units and individuals engaged in commercial handling and loading must carry out their operations within the scope of the operation area approved by the local transportation authorities. The transportation of national mandatory planning materials and key ports and stations determined by the people's governments at or above the county (city, district) level shall be arranged by the local transportation department. Article 9 Both parties to the loading and unloading contract shall sign the loading and unloading contract according to the Economic Contract Law of the People's Republic of China, the Detailed Rules for the Implementation of the Contract for the Carriage of Goods by Water and the Detailed Rules for the Implementation of the Contract for the Carriage of Goods by Road, and report to the local transportation authorities for the record. Article 10 Units and individuals engaged in the handling industry independently determine the employment plan, report it to the competent labor administrative department for the record, and go through the relevant procedures such as labor contract verification, pension and unemployment insurance at the competent labor administrative department. If it is really necessary to recruit rural contract workers for handling, it shall be reported to the local labor administrative department for approval. Article 11 Enterprises and institutions such as factories, mines (including owned and dedicated wharves owned by affiliated enterprises, wharves operated by the military and warehouses for important materials) and shops. Employees engaged in handling operations must go through the relevant formalities with the local transportation authorities. Twelfth units and individuals engaged in handling industry, must comply with the following provisions:

(a) establish and improve the rules and regulations, strictly abide by the operating rules, improve the service attitude, and ensure the quality of loading and unloading;

(two) where the loading and unloading of overweight, toxic and dangerous goods, according to the "Regulations" and the relevant provisions of the state;

(three) handling personnel should hold a work permit issued by the Provincial Communications Department;

(four) the use of unified bills for settlement, the state has a fixed price, the implementation of price regulations, and pay various fees in accordance with the provisions;

(five) to fill in the relevant statistical data to the local transportation authorities. Chapter IV Supervision and Inspection Article 13 The transportation departments at all levels and other relevant government departments shall, according to their respective functions and duties, supervise and inspect the units and individuals engaged in the handling industry in accordance with the law, protect legitimate business operations and ban illegal business operations. Fourteenth units and individuals engaged in handling industry, should consciously accept the inspection, truthfully provide business activities, and shall not resort to deceit. Fifteenth inspectors in performing official duties, should show valid certificates to the units or individuals under inspection. Chapter V Legal Liability Article 16 Units and individuals that violate the provisions of these Measures shall be dealt with by the transportation departments at all levels and other relevant government departments according to their respective responsibilities. Seventeenth unauthorized handling activities or change the scope of business, shall be ordered to suspend business, confiscate all its illegal income, and impose a fine of 10% to 30% of the operating income of the month. Article 18. Those who operate by unfair means, dominate the market, and forcibly load and unload goods shall be banned, their illegal income shall be confiscated, and a fine of more than 500 yuan 1000 yuan shall be imposed. Article 19. Violation of operating rules and rough loading and unloading, resulting in damage to the goods, shall be ordered to compensate for the losses, and impose a fine of 10% to 30% of the amount of damage to the goods; If the circumstances are serious, it shall be ordered to suspend business for rectification; If the rectification is unqualified, the business license and business license shall be revoked.
