Measures of Yunnan Province for the Administration of Road Transportation Industry

Chapter I General Provisions Article 1 In order to strengthen the management of the road transport industry, safeguard the legitimate rights and interests of road transport operators and their clients, and promote the development of the road transport industry, these measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of our province. Article 2 These Measures shall apply to units and individuals engaged in road passenger transport, cargo transport, handling, automobile maintenance and transportation auxiliary industries (collectively referred to as road transport industry) within the administrative area of our province.

The road transport industry as mentioned in these Measures does not include urban public passenger transport. Measures for the administration of urban public passenger transport shall be formulated separately. Article 3 The traffic administrative department at or above the county level is the competent department of road transport within its administrative area, and the road transport management institution to which it belongs shall perform specific management duties. Article 4 People's governments at all levels shall, according to the needs of national economic and social development, take the establishment of a unified, open and competitive transportation market as the goal, follow the principle of total regulation and control, and adhere to the principle of coordinated development of diversified economy and various economic sectors, formulate the development plan of road transportation industry in their respective administrative areas, and organize its implementation. Chapter II Opening and Closure Article 5 All units and individuals applying for engaging in commercial road transport within the administrative area of our province must have economic and technical conditions such as equipment, facilities, funds and professionals that are suitable for their business types, projects and scope. The applicant holds valid certificates and relevant qualification certificates to apply to the local road transport management institution at or above the county level, and after examination and approval, he will be issued a road transport business license, and go through the industrial and commercial registration with the administrative department for industry and commerce to obtain a business license. Article 6 Units and individuals that are approved to engage in commercial passenger and freight transport shall register their vehicles with the local road transport management authorities and issue the People's Republic of China (PRC) Road Transport Certificate according to the number of registered vehicles before operating.

Non-commercial road transport vehicles need to participate in temporary commercial transport, which shall be examined and approved by the road transport management institution at or above the county level, issue a temporary road transport operation certificate, and go through the relevant formalities at the administrative department for industry and commerce before they can operate. The temporary operation time shall not exceed 3 months. Seventh transportation and foreign-invested road transport vehicles entering and leaving the country are under the unified management of the traffic administrative department. Involving the management responsibilities of other departments, it shall be handled in accordance with the provisions of relevant laws, regulations and rules. Eighth units and individuals engaged in the commercial road transport industry need to suspend business, should be reported to the original examination and approval authority for the record; If it is really necessary to merge, split up, relocate or change business projects, it shall be reported to the original examination and approval authority for approval, and the corresponding procedures shall be handled. Ninth road transport management institutions shall, in accordance with the provisions, regularly check the business qualifications and business practices of units and individuals engaged in commercial road transport. Chapter III Passenger Transport Article 10 Road passenger transport (hereinafter referred to as passenger transport) includes bus passenger transport, tourist passenger transport, regular passenger transport and chartered passenger transport. Eleventh units and individuals engaged in passenger transport in our province, must have the qualification of passenger transport.

Passenger lines, stations, shifts and business areas shall be examined and approved by the road transport management organs at or above the county level in accordance with the hierarchical management authority.

Opening or adjusting passenger lines and stations shall be handled in accordance with the procedures prescribed by relevant administrative regulations. Twelfth approved passenger vehicles and passenger lines must be marked. Passenger line signs are uniformly produced by the provincial road transport management institution. Thirteenth passenger vehicles (except chartered cars) should be operated in accordance with the approved routes, stations, shifts and departure times to ensure safety and punctuality. Passenger transport operators need to withdraw lines and stop classes, and must apply to the original approval authority. Only after approval can they withdraw from the line and suspend classes. Fourteenth passenger transport operators must indicate the fare table of their business scope at the station or in the car, charge according to the approved fare, and give a sufficient number of passengers valid tickets. Fifteenth passenger transport operators must transport passengers according to the time and place indicated in the ticket. Unless the vehicle really can't continue driving, it is not allowed to change the vehicle or hand over the passengers to others for transportation.

Due to the reasons of passenger transport operators, when passengers buy high-end car tickets and transfer to low-end cars, they should refund the difference in ticket prices; Passengers who buy low-grade bus tickets and transfer to high-grade cars will no longer pay the fare difference. Article 16 If passengers miss or take the bus by mistake due to the reasons of the passenger transport operators, they shall refund tickets or change buses according to the passengers' requirements; Casualties of passengers or loss or damage of luggage shall be handled in accordance with relevant state regulations. Seventeenth passengers must hold valid tickets and abide by these regulations. If the passenger's fault causes personal injury, property loss or vehicle damage to others, he shall be liable for compensation; If a person without capacity for civil conduct or a person with limited capacity for civil conduct causes damage, his guardian shall be responsible for compensation. Eighteenth non-operating passenger cars need to participate in commercial passenger transport, approved by the road transport management authorities at or above the county level, and their operating vehicles are included in the scope of passenger transport management. Chapter IV Freight Transportation Article 19 Road freight transportation (hereinafter referred to as freight transportation) shall, under the macro-control of the state, strengthen the management of freight market, activate circulation channels and promote the circulation of goods. Twentieth people's governments at or above the county level to determine the emergency rescue, disaster relief, strategic materials and key materials designated by the provincial people's government and other transportation tasks according to the mandatory plan issued by the road transport management institution at the same level is responsible for organizing the implementation. All transportation units and individuals must obey the unified dispatch, be responsible for transportation, and ensure that the tasks are completed on schedule.

Bulk goods distributed at stations and ports and bulk materials that shippers cannot transport by themselves shall be organized and coordinated by local road transport management institutions and transported by contract.
