Provisions on the Administration of Passenger Transport and Passenger Stations (II)

When there is an illegal act of public security that infringes on the personal and property safety of passengers in the process of transportation, the passenger transport operator shall report to the public security organ in time, and cooperate with the public security organ to terminate the illegal act of public security in time when its own capacity allows.
Passenger transport operators are not allowed to engage in unhealthy activities such as playing obscene videos on passenger vehicles.
Forty-fourth passenger transport operators are encouraged to use passenger cars equipped with luggage compartments to engage in road passenger transport. If there is no lower luggage compartment or the capacity of the luggage compartment cannot meet the needs, a special luggage storage area can be set up in the passenger compartment, but the luggage storage area and the passenger area must be isolated and corresponding safety measures should be taken. Forty-fifth passenger transport operators shall insure passengers with carrier liability insurance.

Drivers of passenger vehicles shall abide by the laws and regulations of road transport and the operating rules of road transport drivers, drive safely and provide civilized service.
Forty-seventh passenger transport operators shall formulate emergency plans for road transport of public emergencies. The emergency plan shall include reporting procedures, emergency command, emergency vehicles and equipment reserves and disposal measures.
When public emergencies occur, passenger transport operators shall obey the unified dispatch and command of the people's governments at or above the county level or relevant departments.
Forty-eighth passenger transport operators shall establish and improve all kinds of ledgers and files, and submit relevant materials and information in a timely manner as required.
Forty-ninth passengers should hold valid tickets, observe the order of boarding, and be polite to guests. Do not carry dangerous goods and other prohibited items stipulated by the state.
For passenger lines and passenger stations under real-name system management, passengers shall show their valid tickets and their original valid identity documents, and cooperate with the staff for inspection. Before passengers take the bus, the operator of the passenger station shall check the identity information recorded in the ticket and the original valid identity documents of the passengers (hereinafter referred to as the ticket, person and certificate) and record the relevant information. Article 52 Passenger train operators or their entrusted ticketing units, starting and ending points and stopovers shall formulate effective emergency plans in combination with the characteristics of real-name management under special circumstances such as peak passenger flow, bad weather, equipment system failure and major security activities.
Fifty-third passenger vehicle drivers should carry the "Road Transport Certificate", qualification certificate and other related documents with the vehicle, and put passenger signs at designated locations. Passenger bus drivers should also carry the "Road Passenger Line Business License".
Fifty-fourth in any of the following circumstances, passenger vehicles can hang temporary passenger signs:
(a) the original bus has been fully loaded and it is necessary to operate overtime trains;
(two) due to vehicle failure, maintenance and other reasons, it is necessary to connect or cover the shift;
(three) the official bus passenger signs that are being made or accidentally lost are waiting to be collected.
Fifty-fifth operating passenger cars with temporary passenger signs should be operated according to the lines and stations of conventional passenger cars. If it belongs to overtime or shift, it should also hold a duty waybill signed by the departure station and indicating the reasons; If the bus passenger sign is being made or lost, it shall also hold a copy of the "Road Passenger Transport Line Business License" or the "Road Passenger Transport Line Business Administrative License Decision" of the class line.
Article 56 A chartered passenger shall travel according to the agreed time, starting point, destination and route with a chartered passenger sign issued by the road transport management institution where the vehicle is registered, and hold a chartered ticket or a chartered contract. Non-scheduled tourist buses can hold tourist tickets or travel contracts indicating passenger transport matters, instead of package tickets or charter contracts.
Article 57 Inter-provincial temporary passenger signs (see Annex 9) and inter-provincial chartered passenger signs (see Annex 10) are printed by provincial road transport management institutions in accordance with the unified style of the Ministry of Transport, and handed over to local road transport management institutions at or above the county level for distribution to passenger transport operators. The inter-provincial chartered passenger signs and inter-provincial temporary passenger signs used by overtime cars, post cars and shuttle buses are valid within the time required for a trip, and the inter-provincial temporary passenger signs are valid for no more than 30 days due to the production or loss of passenger signs.
Enterprises engaged in inter-provincial chartered passenger transport shall, in accordance with the unified requirements of the Ministry of Transport, file with the road transport management institution of the vehicle registration place through the transportation information system before using the chartered sign.
The style and management requirements of temporary passenger signs and chartered passenger signs in the province shall be formulated by the provincial transportation department.

Passenger station operators shall maintain various facilities and equipment and maintain their normal use.

The passenger station operator shall settle the freight with the passenger station operator on a monthly basis.

Passenger station operators should adhere to the principle of fairness and justice, arrange departure time reasonably and sell tickets fairly.
Passenger transport operators in the departure time arrangement dispute, passenger station operators coordination is invalid, by the local road transport management institutions at or above the county level.
Sixty-third passenger station operators shall publish information such as vehicle type, vehicle type and grade, transportation route, station, frequency, departure time and fare. For inbound buses, dispatch vehicles to arrive at the station to guide passengers and maintain order.
Sixty-fourth inbound passenger transport operators shall prepare the relevant documents to wait for the departure 30 minutes before the departure, and shall not miss, leave or stop the shift. Sixty-fifth passenger station operators should set up service facilities such as ticket purchase, waiting, boarding instructions, luggage storage and consignment, public health, etc., to provide passengers with safe, convenient and high-quality services, strengthen publicity, and keep the station clean and tidy.
Engaged in other business activities other than the operation of passenger stations shall abide by the provisions of relevant laws and administrative regulations.
Sixty-sixth passenger station operators should strictly implement the price management regulations, publicize the charging items and standards in the business premises, and prohibit arbitrary charges.
Article 67 The operator of a passenger station shall load, unload, store and keep the luggage in accordance with the prescribed business operation procedures.
Sixty-eighth passenger station operators shall formulate emergency plans for public emergencies. The emergency plan shall include reporting procedures, emergency command, emergency equipment reserve and disposal measures.
Sixty-ninth passenger station operators should establish and improve all kinds of ledgers and files, and submit relevant information as required.
Chapter V Supervision and Inspection
Seventieth road transport management institutions shall strengthen the supervision and inspection of road passenger transport and passenger station business activities.
The staff of the road transport management institution shall conduct supervision and inspection in strict accordance with the statutory duties, authority and procedures.
Seventy-first road transport management institutions at or above the county level shall conduct a regular inspection of passenger vehicles every year. The verification contents include:
(1) Vehicle violation record;
(2) Vehicle technical grade evaluation;
(3) the rating of bus type;
(four) according to the provisions of the installation and use of standard satellite positioning device with driving record function;
(five) passenger transport operators to insure passenger vehicles with carrier liability insurance.
If the inspection meets the requirements, the road transport management institution shall indicate it on the inspection record column or IC card of the road transport certificate; Do not meet the requirements, it shall be ordered to make corrections within a time limit or go through the formalities for change.
Seventy-second road transport management institutions and their staff should focus on passenger stations and passenger distribution centers, and supervise and inspect the business activities of road passenger transport and passenger stations. In addition, according to management needs, supervision and inspection can be carried out at highway intersections, but normal road transport vehicles should not be intercepted at will, and vehicles should not be intercepted in both directions for inspection.
Article 73 When carrying out supervision and inspection, the staff of the road transport management institution shall have two or more participants and show the traffic administrative law enforcement certificate of the Ministry of Transport to the parties concerned.
Article 74 The staff of a road transport management institution may know the situation from the units and individuals under inspection, consult and copy relevant materials. However, the business secrets of the units and individuals under investigation shall be kept confidential.
Units and individuals under supervision and inspection shall accept the supervision and inspection carried out by the road transport management institution and its staff according to law, and truthfully provide relevant information or explain the situation.
Article 75 In the process of road transport supervision and inspection, the staff of the road transport management institution shall immediately stop the overloading of passenger vehicles and take corresponding measures to arrange passengers to change their tickets.
Article 76 Where a passenger transport operator illegally engages in business activities outside the jurisdiction of the licensed road transport management institution, the road transport management institution in the place where the illegal act occurred shall record the illegal facts and punishment results of the parties to the road transport certificate according to law, and send a copy to the road transport management institution that made the road passenger transport business license.
Seventy-seventh passenger transport operators in violation of these provisions, the road transport management institutions at or above the county level in the process of making administrative punishment decisions, in accordance with the provisions of the administrative punishment law, you can register and save the illegal evidence in advance. After making the decision on administrative punishment, if the passenger transport operator refuses to perform, the road transport management institution that made the decision on administrative punishment can inform the road transport management institution of the place where the illegal vehicle is registered of the fact of refusing to perform the decision on administrative punishment, as an important basis for whether it can pass the annual inspection of the vehicle and determine the quality and credibility assessment results.
Article 78 In the process of road transport supervision and inspection, the staff of the road transport management institution may temporarily detain passenger vehicles without road transport license and unable to provide other valid certificates on the spot, and issue a Certificate of Detention of Road Transport Vehicles (see Annex 12). The temporarily detained vehicles shall be properly kept, and shall not be used, and shall not charge or charge storage fees in disguise.
The illegal parties shall go to the designated place for treatment within the time specified in the withholding certificate. If it fails to accept the treatment within the time limit, the road transport management institution may make a punishment decision according to law and serve the punishment decision on the parties concerned. If a party fails to perform the punishment decision within the time limit without justifiable reasons, the road transport management institution may apply to the people's court for compulsory execution.
Chapter VI Legal Liability
Seventy-ninth in violation of the provisions of these measures, one of the following acts, the road transport management institution at or above the county level shall be ordered to stop business; Illegal income, confiscate the illegal income, and impose a fine of more than 2 times the illegal income 10 times; If there is no illegal income or the illegal income is less than 20,000 yuan, a fine ranging from 30,000 yuan to 6,543,800 yuan shall be imposed; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(a) engaging in road passenger transport business without obtaining a road passenger transport business license;
(two) engaged in bus passenger transport business without obtaining the business license of road passenger transport line;
(three) the use of invalid, forged, altered, cancelled and other invalid road passenger transport permits to engage in road passenger transport business;
(four) beyond the licensing matters, engaged in road passenger transport business.
Article eightieth in violation of these regulations, any of the following acts shall be ordered by the road transport management institution at or above the county level to stop operation; Illegal income, confiscate the illegal income, and impose a fine of more than 2 times the illegal income 10 times; If there is no illegal income or the illegal income is less than 6,543,800 yuan, a fine of 20,000 yuan to 50,000 yuan shall be imposed; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(a) engaged in the operation of the passenger station without obtaining the business license of the passenger station;
(two) the use of invalid, forged, altered, cancelled and other invalid passenger station certificates to engage in passenger station management;
(three) beyond the licensing matters, engaged in the operation of passenger stations.
Article 81 If a passenger transport operator or a passenger station operator illegally transfers or rents a road transport business license in violation of these Provisions, the road transport management institution at or above the county level shall order it to stop the illegal act, collect the relevant documents and impose a fine ranging from 2,000 yuan to 654.38+0,000 yuan; If there are illegal gains, the illegal gains shall be confiscated.
Eighty-second in violation of the provisions, passenger transport operators have one of the following acts, the road transport management institution at or above the county level shall order the insurance within a time limit; Refuse to insure, the original licensing authority shall revoke the road transport business license or revoke the corresponding business scope:
(1) Failing to take out carrier liability insurance for passengers;
(two) not in accordance with the minimum amount of insurance;
(3) The insured carrier liability insurance has expired, and the insurance has not been continued.
Article 83 If a passenger transport operator who violates the provisions of these Regulations and obtains a passenger transport business license uses a vehicle without a road transport license to engage in passenger transport business, the road transport management institution at or above the county level shall order it to make corrections and impose a fine of not less than 3,000 yuan but not more than 65,000 yuan.
In violation of regulations, if a passenger transport operator fails to carry a road transport certificate in accordance with regulations, the road transport management institution at or above the county level shall order it to make corrections and impose a warning or a fine of more than 20 yuan and less than 200 yuan.
Article 84 If, in violation of these regulations, passenger transport operators (including international road passenger transport operators), passenger station operators and passenger-related service operators do not use special tickets for road transport or transfer, resell or forge special tickets for road transport, the road transport management institution at or above the county level shall order them to make corrections and impose a fine of 1000 yuan to 3000 yuan.
Article 85 If the operators of inter-provincial and inter-city passenger lines or their entrusted ticketing units, starting and ending points and stop operators fail to check the identity of passengers in accordance with the provisions, or provide services for unidentified passengers and refuse to provide identity information, the road transport management institution at or above the county level shall order them to make corrections; Refuses to correct, a fine of 654.38+10,000 yuan but not more than 500,000 yuan, and a fine of 654.38+10,000 yuan for the directly responsible person in charge and other directly responsible personnel; If the circumstances are serious, the road transport management institution at or above the county level shall order it to stop engaging in the relevant road passenger transport or passenger station business; If serious consequences are caused, the business license of road passenger transport or passenger station shall be revoked by the original licensing authority.
Eighty-sixth in violation of the provisions of any of the following circumstances, the road transport management institution at or above the county level shall order it to make corrections and impose a fine of 3000 yuan to 1000 yuan; If the circumstances are serious, the original licensing authority shall revoke the road transport business license or the corresponding business scope:
(a) the passenger bus does not stop at the approved passenger station or does not run according to the prescribed route and frequency;
(two) the overtime bus, the top bus and the shuttle bus do not travel according to the original line, station and frequency of the main bus without justifiable reasons;
(3) The passenger chartered bus does not use the valid passenger chartered bus sign to operate, does not operate according to the matters specified in the passenger chartered bus sign, the two ends of the line are not in the place where the vehicle is registered, operates according to the fixed-point route, and recruits passengers outside the charter contract;
(4) soliciting passengers by deception, violence or other means;
(five) in the process of passenger transport, the transport vehicle is changed or the passenger is transported by others;
(six) without reporting to the original licensing authority, the road passenger transport business is terminated without authorization.
Eighty-seventh in violation of the provisions, the passenger transport operators and passenger station operators did not meet the relevant safety requirements, there are major transportation safety hazards, and the road transport management institution at or above the county level shall order it to make corrections within a time limit; If it cannot be corrected as required within the specified time and the circumstances are serious, the original licensing authority shall revoke the road transport business license or revoke the corresponding business scope.
Eighty-eighth in violation of the provisions, the passenger station operators in any of the following circumstances, the road transport management institution at or above the county level shall be ordered to make corrections, and impose a fine of 30 thousand yuan and 00 thousand yuan:
(a) allow vehicles without business licenses to enter the station to engage in business activities;
(2) Allowing overloaded vehicles to leave the station;
(three) allowing vehicles that have not passed the safety inspection or failed the safety inspection to start;
(four) refusing to engage in passenger vehicle business activities without justifiable reasons.
Eighty-ninth in violation of the provisions, the passenger station operator in any of the following circumstances, the road transport management institution at or above the county level shall be ordered to make corrections; Refuses to correct, a fine of 3000 yuan; Illegal income, confiscate the illegal income:
(a) to change the use and service function of the passenger station without authorization;
(two) the transportation route, station, frequency, departure time and fare have not been announced.
Ninetieth road transport management agency staff in violation of the provisions of any of the following circumstances, shall be given administrative sanctions according to law; If the case constitutes a crime, criminal responsibility shall be investigated according to law:
(a) failing to implement the administrative license in accordance with the prescribed conditions, procedures and deadlines;
(two) to participate in or participate in the operation of road passenger transport and passenger stations in disguise;
(three) did not promptly investigate and deal with illegal acts;
(four) in violation of the provisions of interception, inspection of normal transport vehicles;
(five) illegal detention of transport vehicles, "road transport permit";
(6) soliciting or accepting other people's property or seeking other benefits;
(seven) other illegal acts.
Chapter VII Supplementary Provisions
Ninety-first taxi passenger transport, city bus passenger transport management according to the relevant provisions of the State Council.
Article 92 When a passenger transport operator engages in international road passenger transport business activities, in addition to the general code of conduct, these Provisions shall also apply, and special requirements such as employment conditions shall apply to the Regulations on the Administration of International Road Transport formulated by the Ministry of Transport.
Ninety-third road transport management institutions can collect fees in accordance with the provisions of the road transport business license and the Road Transport Certificate. The specific charging standards for production expenses shall be approved by the finance and price departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government in conjunction with the transportation departments at the same level.
